Our business is in the proposed overlay zone at 770 N. Range Line Rd., Carmel 2. We are the owners of the land-Anita & Wayne Adkins J,wt..J rf\;c.hell~ ..J ~ei' ve.1o- 3. We have a legal non conforming use for the site as retail going back to 1924 as a retail use long before subject zoning and the site is essentially with the same space used for retail now as then. 4. We are grandfathered for our use and style of use on this site. 5. The Carmel Plan Commision and the Carmel City Council have no jurisdiction over us by the proposed ordinance. 6. We have vested property rights in the real estate at 770 N. Range Line Rd., Carmel which the city, state or federal government or any other governmental agency cannot take from us without our consent and WE DO NOT CONSENT TO YOUR ACTIONS TONIGHT OR IN THE FUTURE WITH REGARD TO THE HISTORIC DISTRICT OVERLAY ZONE AS REGARDS OUR NON CONFORMING USE. 7. The Old Town Overlay task force, made up of residents and business owners from the area, has worked for more than a year to bring this plan to fruition. We believe it would be extremely beneficial to the city of Carmel, its residents and its businesses. With the completion of the Monon Trail, the City Center and various other improvements, the Old Town area of Carmel will be faced with increasing growth and change. This is a plan that will provide consistency and manage the growth in a very positive way. This plan encourages renovation and rehabilitation in the area, it also has the potential to increase property values and improve commercial activity in the business district. Most importantly, this plan will serve to protect the very unique and special area that is Old Town. The time and money spent on the Old Town area over the past several years has lent great improvement to the area. Increasingly, Old Town Carmel is becoming known as a quaint district and with desirable real estate. This proposal will protect and improve the city and taxpayers' investment. It is crucial that we recognize the unique opportunity that Old Town offers and can continue to offer the City of Carmel. But from that and talking with neighbors, I believe I understand the basic plan. I am in support of the preservation of Old Town. I have only been a homeowner for 18 months so naturally I am concerned about my investment, retaining the uniqueness of Old Town, and the encouragement of rehabilitation and renovation. Especially with the two huge "grand lady's in disquise" that are for sale in the 3rd and 4th blocks of North Range Line, we need guidelines now more then ever. And I trust we will have some imput as to what the new owners will plan for them!!!(not to mention the empty lot behind the house in the 3rd block!) I also feel if we had had guidelines I wouldn't have to look at a 3 story bus garage built to the back of a small house on Range Line that also has had apartments added to it.
