COMMONLY KNOWN AS
THE OLD TOWN DISTRICT
Z-379-02
Notice is hereby given to the taxpayers of the City of Carmel and Clay Township, Hamilton County, Indiana,
that the proper legal officers of the City of Carmel will meet at their regular meeting place, Council Chambers, Carmel
City Hall, One Civic Square, Carmel, IN 46032, at 7:00 p.m. on Monday, the 15th day of April, 2002, to consider the
rezone application (CarmeVClay Plan Commission Docket No.96-01b Z) of the City of Carmel Department of
Community Services to establish the Old Town Overlay District. The property is located generally between Smokey
Row Road on the north; 5th Street Southeast on the south; 4th Street Southwest on the west; and 3rd Street Northeast on
the east (commonly known as Old Town Carmel) within the City of Carmel, Hamilton County, Indiana.
Taxpayers appearing at the meeting shall have the right to be heard.

Committee and Subdivision Committee Agendas for February 5th: A copy of the agendas has

The Special Studies Committee Chair has asked that the discussion of items 2 (Old Town
Overlay District) and 3 (Home Place District Overlay and Comprehensive Plan Policies) be held
on Thursday, February ih at 7pm due to the number of items on the agenda. The Department has
reserved the room and enclosed an agenda for this meeting with this transmittal. We will also
make efforts to contact interested parties to let them know of the change in the meeting date for
these two items.

1. Our business is in the proposed overlay zone at 770 N. Range Line
Rd., Carmel
2. We are the owners of the land-Anita & Wayne Adkins J,wt..J rf\;c.hell~

3. We have a legal non conforming use for the site as retail going
back to 1924 as a retail use long before subject zoning and the
site is essentially with the same space used for retail now as
then.
4. We are grandfathered for our use and style of use on this site.
5. The Carmel Plan Commision and the Carmel City Council have no
jurisdiction over us by the proposed ordinance.
6. We have vested property rights in the real estate at 770 N. Range
Line Rd., Carmel which the city, state or federal government
or any other governmental agency cannot take from us without our
consent and WE DO NOT CONSENT TO YOUR ACTIONS TONIGHT OR IN THE
FUTURE WITH REGARD TO THE HISTORIC DISTRICT OVERLAY ZONE AS
REGARDS OUR NON CONFORMING USE.
7. A non-conforming use is one that is permitted in a given area,
despite being against zoning, because nonconforming use was in
existence on or before the controlling zoning ordinance took effectc

8. Existing nonconforming uses are generally exempt from use restrict-
ions because the right of a municipality to enact zoning restrictions

9. The present proposal is so flawed by the inclusion of us and non-
conforming uses as to be invalid and unconstitutional.

Old Town Overlay District
I would like to take this opportunity to urge the members of the Planning
Commission to pass the Old Town Overlay District proposal.
The Old Town Overlay task force, made up of residents and business owners
from the area, has worked for more than a year to bring this plan to
fruition. We believe it would be extremely beneficial to the city of
Carmel, its residents and its businesses.
With the completion of the Monon Trail, the City Center and various other
improvements, the Old Town area of Carmel will be faced with increasing
growth and change. This is a plan that will provide consistency and manage
the growth in a very positive way.
This plan encourages renovation and rehabilitation in the area, it also has
the potential to increase property values and improve commercial activity in
the business district.
Most importantly, this plan will serve to protect the very unique and
special area that is Old Town.
The time and money spent on the Old Town area over the past several years
has lent great improvement to the area. Increasingly, Old Town Carmel is
becoming known as a quaint district and with desirable real estate. This
proposal will protect and improve the city and taxpayers' investment.
It is crucial that we recognize the unique opportunity that Old Town offers
and can continue to offer the City of Carmel.
Again, I urge you to do that by passing the Old Town Overlay District
proposal.

Preservation of Old Town
Dear Ramona,
Unfortunately, I have only been able to attend the first meeting last summer.
But from that and talking with neighbors, I believe I understand the basic
plan.
I am in support of the preservation of Old Town. I have only been a
homeowner for 18 months so naturally I am concerned about my investment,
retaining the uniqueness of Old Town, and the encouragement of rehabilitation
and renovation.
Especially with the two huge "grand lady's in disquise" that are for sale in
the 3rd and 4th blocks of North Range Line, we need guidelines now more then
ever. And I trust we will have some imput as to what the new owners will
plan for them!!!(not to mention the empty lot behind the house in the 3rd
block!)
I also feel if we had had guidelines I wouldn't have to look at a 3 story bus
garage built to the back of a small house on Range Line that also has had
apartments added to it. These kinds of renovations I hope will be stopped!

Hi,
My name is Jill Taylor and I live at 450 1st Avenue NW. I am a home owner and have lived in this neighborhood for the
past 12 years. I am very much in favor of the plans for implementing some standards for the overlay district. I believe that
these guidelines will improve my property value and will maintain the integrity of "old town." All over Carmel are cookie
cutter housing additions. Our area is unique, and these guidelines ensure that the character of our neighborhood will be
maintained. I appreciate all of the efforts the town council has made in improving old town, but we must make sure that
these expenditures were not wasted. Please convey my vote of support for the overlay district.

past 12 years. I am very much in favor of the plans for implementing some standards for the overlay district. I believe that
these guidelines will improve my property value and will maintain the integrity of "old town." All over Carmel are cookie
cutter housing additions. Our area is unique, and these guidelines ensure that the character of our neighborhood will be
maintained. I appreciate all of the efforts the town council has made in improving old town, but we must make sure that
these expenditures were not wasted. Please convey my vote of support for the overlay district.
