Docket No. 96-01 Z; Old Town Overlay District Petitioner seeks a favorable recommendation for the establishment of the Old Town Overlay District. The area affected is commonly known as Old Town. Filed by the Department of Community Services for the Old Town Task Force. 6i. Docket No. 135-01 Z; Home Place District Overlay Zone Petitioner seeks a favorable recommendation for the establishment of the Home Place District Overlay Zone. The area affected is generally known as Home Place. Filed by the Department of Community Services for the Home Place Task Force. . . These two items have been placed back on the Plan Commission agenda for the Commission to forward an additional recommendation to the City Council. The Plan Commission acted on both petitions last month. However, at the time only two Ordinances had been prepared to address the text and map amendments for each overlay. Legal Council has brought it to the attention of the Department that the Council must act on two separate ordinances for each area overlay. One . ordinance would address the creation of the text for the new overlays and the other would amend the Official Zoning Map identifying the designated areas. Nothing of substance has changed. If the problem had been recognized within ten days of the Plan Commission meeting we would not have had to place the item back on the agenda. However, the statute requires the Plan Commission Certification to come within ten days of the vote. As a technical matter, we need the Plan Commission to duplicate its recommendation. The Department recommends that both items be forwarded to the City Councll, with . favorable recommendations (separate votes for each). This will allow the Department to assign the Certification to the appropriate Ordinances and forward the items to the City Council for action. 1___
