Thank you for the opportunity to bid on the construction of your spa and equipment renovation of
the swimming pool. Our proposal is inclusive of expenses for our portion of the project. We strive
to use the highest quality materials with the best craftsmanship in the industry. We look forward

This proposal is valid for 30 days and was prepared based on information gathered at the
property owner’s residence.
• This contract is between David Barrett and Barton Pool Company, LLC
• Approximate Start Date of work: December 2022 – January 2023
• Approximate Completion of work: April 9th, 2023
• Work to be performed at this address: 13280 West Rd. Westfield, IN 46074
• The driveway and side yards will be used to access the jobsite for material delivery &
storage, waste removal, company vehicles, and employees
• All construction debris to be removed from the sites and left in broom-clean condition
• Contractor will take every precaution to minimize damage to the access route between the
city street and the construction site
• Contractor will take every precaution to avoid buried utilities
• Any changes that are requested of Barton Pool Company shall be submitted in writing and
agreed to by both parties
• Access to adequate electric and water supply must be provided to Barton Pool Company,
LLC
• Barton Pool Company will begin working on permits once agreement is signed
• Anything not mentioned is not included
Barton Pool Company, LLC agrees to furnish labor and materials to complete the project to the
specifications below:
Construct new spa and retaining wall:
• Spa Structure 7’ x 10’Pneumatically applied concrete (shotcrete/wet mix, guinite/dry
mix). Bond beam to be 14” thick, walls to be 12” thick, pool floor to be 8” thick.
o Shotcrete to have a minimum strength of 4500psi.
• Compacted limestone base / footer to be installed under spa floor
• Steel reinforcement shall be #4 rebar tied 12” on center both directions
• One (1) skimmer, four (4) quad cluster jet zones, and two (2) main drains
• Schedule 40 rigid PVC pipe and fittings
• White Marcite plaster finish
• Install 6”x6” solid porcelain tile
• Concrete pool coping to be subcontracted to Mike Shepherd by Barton Pool Company
• Spa startup chemical package: Liquid chlorine, acid, and stain and scale preventative
• All necessary permits from the local jurisdiction for spa construction
• Schedule 40 rigid 2” PVC pipe and fittings
• Haul away excess dirt, Rough grade disturbed areas
• City water from truck delivery to fill spa included
• Five post construction service visits will be performed by Barton Pool Company to brush
plaster, adjust chemistry, and calibrate equipment
• Tutorial once spa is operational
• Two (2) Pentair Intelliflo VSF 3HP variable speed pump for filtration and jets
• Pentair CCP320 cartridge filter for spa filtration
• Raypak 266,000 BTU electronic ignition natural gas heater

• Pentair Bioshield UV Disinfection sterilizer
• Pentair Intellichem Water chemistry controller
• Additional Pentair Intellichem Water chemistry controller to be installed on swimming
pool equipment
• Pentair Intellicenter Automation system for control of both swimming pool and spa
§ To be controlled through application from smartphone or tablet
§ Four button controller to be installed at spa side for control of jets and
lights
• One (1) Pentair Intellibrite 5G white LED light with stainless steel niche
• Maintenance package: 8’- 16’ telepole, vac head, vac hose, brush, net, and test kit
• Concrete equipment pad (Estimated size of pad 8’ x 12’
• Versa-Lok wall to be constructed around spa, and at equipment pad
• Automatic spa cover
Retaining Wall:
• Compacted limestone base with landscape fabric
• Covering 175 face feet around spa, and 70 face feet around equipment pad
• Versa-Lok wall system with matching wall caps
• Geogrid reinforcement
• #8 limestone gravel backfill for drainage
• Rough grade behind wall to ease slope
• 4” drain tile full length wall
Move pool equipment and utilities to new equipment pad area:
• Disconnect electrical and gas service to the existing equipment pad
• Remove swimming pool equipment from the equipment pad and place onsite for use later
• Extend utilities (electrical and gas) from existing equipment pad to new equipment pad
• Install new (additional) electrical line from main house to new equipment pad
o Trench from electrical area on south side of house around west side of pool basin
to new equipment pad
• Terminate plumbing stubs at existing equipment pad and extend these lines to the new
equipment pad
• Reinstall existing pool equipment
• All waste materials will be removed from site

GUARANTEE OF WORKMANSHIP
Contractor guarantees that all material furnished by him will be of good standard quality, free from
defects, and will be installed or applied in a good workmanlike manner. Such labor and materials
are guaranteed for a period of 1 year when subject to normal use and care and provided Owner has
complied in full with the terms and payments and other conditions of this contract. The liability of
the Contractor for defective material or installation under this guarantee is hereby limited to the
replacement or correction of said defective material and/or installation, and no other claims or
demands whatsoever shall be made upon the Contractor. Items purchased by Contractor and
included in this contract are sold and installed subject to manufacturers’ or processor’s guarantee
or warranties and not Contractor’s.
PLASTER
All swimming pool plaster is subject to staining due to local water conditions and improper service
performed by the owner. If this agreement provides that the Contractor will plaster the pool at the
above address, then Contractor will warranty that the plaster will not delaminate for a period of
two years provided that the pool structure remains sound and that start-up and winterization
procedures are properly maintained in accordance with the instructions from Contractor. Water
chemistry consists of: total alkalinity, pH, hardness (calcium and magnesium), iron, copper and
total dissolved solids (TDS). Chemical treatment alone will not produce sanitary pool water. A
filtration system in proper operational condition is also required. Since pool plaster is composed
of natural materials which have certain inherent characteristics, a certain amount of shading or
color variation is a natural occurrence which should not be construed as a defect and which only
enhances the natural beauty of your pool. Owner agrees that plaster is NOT guaranteed for
evenness of color and may not be the exact shade anticipated. The shade of color may vary and
fade over time. The plaster may become streaked, blotchy, or have a mottled appearance over
which the Contractor has no control. Homeowner understands that crazing (check cracks and
hairline cracks) may be noticeable and may be quite pronounced with colored plaster. Due to
atmospheric conditions (humidity, temperature, etc.) during plastering, light and /or dark streaks
(a marbleized look) may appear in the plaster and may be more pronounced on a cloudy day or at
night with the light on. These conditions are beyond the Contractor’s control.
CONCRETE DISCLAIMER
Barton Pool Company, LLC tries to control cracks by proper jointing and use of reinforcement.
However, concrete cracks and surface deterioration can never be totally avoided. By signing this
agreement, it is recognized that, concrete, in its finished solid state, can crack, chip, spall, and
otherwise show any or all of these signs at any time in its lifetime. No warranty is provided. We
do not repair cracks unless additional costs are agreed upon. Concrete is a masonry art form that
“weathers” with the time and elements. All rough textures eventually smooth out, and all color
variations eventually blend together.

RELEASE OF LIABILITY
Hydrostatic pressure (ground water, area water table) can cause shifting and/or upheaval of
fiberglass and concrete/gunite pool shells.
Due to these inherent risks involved with entirely draining pools, Barton Pool Company cannot
be held responsible for conditions outside their control.
Barton Pool Company will take every precautionary measure possible to insure the best outcome
for the safety of the pool.

Barton Pool Company, LLC proposes to furnish material and labor – complete in accordance
with the above specifications, for the sum of: $125,800.00
40% deposit before work begins- $50,320.00
40% to be collected once spa shell is installed - $50,320.00
20% due upon completion of project - $25,160.00
Acceptance of proposal: The above prices, specifications and conditions are satisfactory and are
hereby accepted. You are authorized to do the work as specified. Payment will be made as outlined
above. In the event of a breach of this agreement the property Owners agree to pay all court costs,
attorney fees, and expenses of litigation incurred by Barton Pool Company, LLC. Unpaid balance
will be subject to an 18% interest rate (1.5% per month.)
NPC Agreement:
I have read and understand the swimming pool start-up and maintenance procedures outlined by
the NPC and will follow these procedures. Barton Pool Company, LLC will not be held liable for
any surface conditions that develop on the pool surface related to improper startup or
maintenance of the swimming pool.
