Community Services MY WIFE, NICOLE SAMSON AND I, ZACHARY SAMSON HAVE BEEN DREAMING OF A
POOL FOR OUR FAMILIES USE FOR MANY YEARS. WE MOVED TO CARMEL,
FROM INDIANA (799 SPRUCE DRIVE) IN SEPTEMBER OF 2021 AND DECIDED IN JUNE OF
Zachary and Nicole
Samson 2022 THAT WE WANTED TO HAVE ONE INSTALLED IN OUR BACKYARD. MANY OF
OUR NEIGHBORS HAVE POOLS TO INCLUDE OUR ADJACENT NEIGHBOR AND
CC NEIGHBOR ACROSS THE STREET.
None
WE HIRED A CONTRACTOR TO INSTALL SAID POOL AND ENDED UP HAVING TO
RE FILE FOR PERMITS OURSELVES AFTER MANY MONTHS OF BEING ILL ADVISED. IN
Docket NO'S:PZ-2022- THIS PROCESS OF FILING FOUND OUT THAT OUR CONCRETE DECKING EXCEEDED
0249 V 8 PZ-2022-
00250 V THE ALLOWABLE 35% LOT COVERAGE BY 11% AND WAS 46% OF OUR TOTAL LOT.
WE ALSO LEARNED THAT THERE WAS A 10 FOOT EASEMENT ON OUR REAR
PROPERTY LINE WHICH WAS ENCROACHED UPON BY NEARLY 3 FEET.
I HAVE SINCE APPLIED FOR AND BEEN GRANTED APPROVAL FOR THE EASEMENT
ENCROACHMENT AND AM SEEKING APPROVAL FOR EXCEEDING THE ALLOWABLE
LOT COVERAGE. THE CONCRETE DECKING IS APPROXIMATELY 1200 SQUARE
FEET FOR ENTERTAINING, IN MY REAR YARD, WHICH IS THE ONLY
ENTERTAINING AREA WE HAVE FOR TABLES, CHAIRS, ETC.
IN THIS PACKET, I HAVE ATTACHED HOA APPROVAL SIGNED BY ALL OF MY
ADJACENT NEIGHBORS, A DRAWING OF THE PLOT, AN AERIAL PHOTO FROM
GOOGLE MAPS, PUMP INFORMATION, AND A STATEMENT OF FACTS FOR YOUR
CONSIDERATION AND DELIBERATION.

Petitioner: Zachary and Nicole Samson
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The pool and decking for the pool is installed in the rear yard of our home and the drainage and utilities are not
impeded by the installation of the concrete decking. Additionally, the drainage from my property and grading from
the construction is being done in a manner that improves the current drainage for both of my neighbors on the left
and right side of my yard. While the current lot coverage exceeds the 35%, 600 Square feet of this coverage is the
pool and spa. The concrete decking that was added is approximately 1200 Square feet of space for entertaining
and use of the pool and spa.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
The area is still accessible and unchanged from its previous use. There is approximately 8' to the rear fence for
accessibility which is large enough for most heavy machinery to operate if necessary.
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the
use of the property because:
The area of useable square footage for entertaining and enjoying the pool/spa is enough for my family of 4 and a
couple house guests to be able to enjoy use and access to the pool without tracking dirt and debris from the yard.
There is approximately 1200 square feet of space useable for entertainment. There are plans in the future of
installing an outdoor kitchen for outdoor entertaining which will take 300 square feet of that 1200 square feet away
from entertaining.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.
is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.
