MODIFIED COMMITMENTS CONCERNING
USE AND DEVELOPMENT OF REAL ESTATE
The undersigned makes the following modified commitments concerning use and
development of real estate ("Modified Commitments") to the Carmel/Clay Plan Commission
("Commission").
RECITALS
A. On November 19, 1991, P.I.A. Indianapolis, Inc., predecessor-in-interest to J.B. &
M.J.M. of Indiana, Inc., an Indiana corporation made certain Commitments
concerning the use and development of real estate, which consists of approximately
10.63::1:: acres ("Real Estate") in connection with the construction of a new 40 bed
residential treatment center ("Building"), a copy of which (including exhibits) are
attached hereto as Exhibit "A" ("Original Commitments").
B. These Original Commitments provided that any modifications or additions to the
Building and any new building( s) to be constructed on the- Real Estate shall be
approved by the Commission.
C. J.B. & M.J.M. of Indiana, Inc., the current owner ("Owner"), desires to construct a
two-story maintenance building to be located on the Real Estate.
D. The Owner received the approval of the Commission at a meeting on October 16,
2001, which approval is reflected in a Letter of Grant attached hereto as Exhibit "B".
E. The Owner is now required to modify the Original Commitments as follows to reflect
the Commission's approval for the construction of the maintenance building.
MODIFIED COMMITMENTS
1. Paragraph 1 "Description of Real Estate" shall be amended by replacing the legal description
attached to the Original Commitments and designated thereon as Exhibit "A" with the legal
description attached hereto as Exhibit "C".
2. Paragraph 2 "Docket Numbers" shall be amended to read: "45-91-Z and l07-0l-CA".
3. Paragraph 3( d) shall be amended by replacing the development plan attached to the Original
Commitments and designated as Exhibit "B" with the development plan attached hereto as
Exhibit "D".
4. Except as modified herein, all other terms and provisions ofthe Original Commitments shall
remain in full force and effect.

COMMITMENTS CONCERNING THE
USE AND DEVELOPMENT OF REAL ESTATE

In accordance with Indiana Code Section 36-7-4-613, the
undersigned, P.I.A. Indianapolis, Inc. (hereinafter "Owner"), the
owner of the following described real estate located in Hamilton
County, Indiana (hereinafter "Real Estate"), makes the following
Commitments Concerning the Use and Development of Real Estate to
the Carmel Plan Commission (hereinafter "Commission") and the
City of Carmel.
1. Descriotion of Real Estate. See Exhibit "A" hereto.
2. Docket No. - 4S-9l-Z
3. Statement of Commitments -
a. Owner commits that the provisions of the B-6
Business District Classification notwithstanding, the
Real Estate shall be used as an establishment for
humans providing physical or mental health services,
including inpatient, outpatient or overnight
accommodations and medical or surgical care of the sick
and injured.
b. Owner commits that the Real Estate shall be
developed pursuant to the Development Plan attached
hereto as Exhibit "B", except for such modifications
recommended or required by the Department of Community
Development, the Carmel Plan Commission, or the Carmel
City Council prior to the Effective Date of these
Commitments.
c. awOer commits that no buildings will be
constructed on the part of the Real Estate lying South
of the line identified on Exhibit "0" as Gas Line.
d. Owner commits that following completion of the
building identified on Exhibit "B" as "New 40 Bed
Residential Treatment Center" (Building), the
architectural design, lighting, and landscaping of any
modifications or additions to the Building and any new
building(s) to be. constructed on the Real Estate shall
be approved by the Carmel Plan Commission.
e. Owner Commits that the identification sign(s)
constructed by the Owner on the Real Estate or used by
the Owner to identify the location or business purposed
of the mental health treatment center shall not contain
the words 'psychiatric' and 'institute'.
f. Owner commits that any person or persons
adjudicated mentally insane shall not be admitted or
cause to be admitted to the mental health treatment
center.
g. Owner commits to contribute its fair share to
the cost of signalization of the intersection of East
lIlth Street and Pennsylvania upon determination by the
appropriate governmental authority that signalization
is warranted.
4. Binding on Successors and Assigns. These commitments
are binding on the Owner of the Real Estate, each subsequent
Owner of the Real Estate and each other person acquiring an
interest in the Real Estate, unless modified or terminated by the
Commission. These commitments may be modified or terminated only
by a decision of the Commission made at a public hearing after
notice as provided by the rules of the Commission.
S. Effective Date. These commitments contained herein
shall be effective upon ~he adoption of an ordinance by the
Carmel City Council changing the zoning classification of the

Real Estate from B-7 to B-6 and shall continue in effect for so
long as the Real Estate remains zoned to the B-6 classification
unless modified or terminated by the Commission as provided
above.
6. Recording. The undersigned hereby authorizes the
Director of Community Development or the Secretary of the Carmel
Plan Commission to record the these commitments in the Office of
the Recorder of Hamilton County, Indiana upon the granting of the
approvals referred to in paragraph 5 above.
7. Enforcement. These commitments may be enforced by the
Carmel Plan Commission and the City of Carmel, Indiana.

Dear Mr. Crowley:
At the meeting held October 16, 2001, the CanneVClay Plan Commission took the following action regarding the
Commitment Amendment and Architectural Design, Lighting, Landscaping & Signage petition filed for property located
at 11075 North Pennsylvania Street:
APPROVED: Docket No. 107-01 CA (Commitment Amendment), a petition to modify a previously approved
Development Plan and construct a maintenance building. The Plan Commission voted twelve (12) in favor, zero (0)
opposed, thereby granting the petition as presented.
APPROVED: Docket No 108-01 ADLS, a petition for approval of a maintenance building. The Plan Commission
