HomeMy WebLinkAboutDepartment Report 01-23-221 of 8 CARMEL BOARD OF ZONING APPEALS | HEARING OFFICER DEPARTMENT REPORT MONDAY, JANUARY 23, 2023 (V) Trahin Residence, Lot Coverage Variance. The applicant seeks the following development standards variance approval: 1. Docket No. PZ-2022-00242 V UDO Section 2.01 Maximum 35% lot coverage allowed, 42% requested. The site is located at 231 Carmel View Dr. (Carmelview Subdivision Lot 33). The site is zoned R2/Residence. Filed by Mary Ellen & Roger Trahin, owners. General Info & Analysis: The Petitioner seeks approval to remove some existing pavement from the lot he recently purchased, as well as add a sunroom and front entry slab to the existing house. A variance for exceeding lot coverage is requested. Please see the Petitioner’s info packet for more detail on the variance request. Lot Coverage: The existing site is around 43.49% lot cover. The Petitioner will remove some of the existing pavement and improve the overall lot coverage situation. The R2/Residence zoning district allows for a maximum 35% lot cover, and 41.85% is requested. This is a net reduction of 1.64% lot cover. And, this is a variance request to exceed the maximum allowed 35% lot cover by 6.85%. Engineering Dept. Comments: In general, the Carmel Engineering Dept. has no major concerns with the lot cover variance. However, the City continues to work with the Petitioner regarding the UDO Section 1.07 requirement for Compliance with the Transportation Plan (related to the sidewalk requirement aspect). (The City Engineer asks that ½ the approved construction cost estimate for the sidewalk along the Petitioner’s frontage ($5,280 ÷ 2) be contributed to the sidewalk fund. However, the Planning Director is comfortable with the lot cover variance being approved with a condition that if or when sidewalks are installed on the Petitioner’s side of the street by the City, that the Petitioner will either install their segment of sidewalk or pay into the Non-Reverting Thoroughfare Fund the cost of construction of said sidewalk.) The City Engineer supports waiving some of the on-site stormwater detention requirements due to the age of the lot and the existing site conditions. (On a separate but related note, the sidewalk project for the neighborhood came about when the city was first doing a drainage improvement project. Then, it was decided that sidewalks should be installed, too, while they were in the area.) Final Comments: The Petitioner addressed all planning/zoning review comments. The Planning Dept. supports the variance request, with the condition listed in the Recommendation below. Findings of Fact: Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of PZ-2022-00242 V with the condition: the Petitioner continues to work with the City regarding Compliance with the Transportation Plan (sidewalk requirement).
