DEPARTMENT REPORT

(V) Kruse Garage Size Variance.
The applicant seeks the following development standards variance approval:
2. Docket No. PZ-2022-00245 V UDO Section 5.02(B)(3) The combined square footage of
the ground floor area of a garage and/or accessory building shall not exceed 75% of the ground floor
area of the principal building, 111% requested. The site is located at 1491 Pondview Dr. (Springmill
Ponds Subdivision Lot 165). It is zoned S2/Residence. Filed by Richard & Susan Kruse, owners.
General Info & Analysis:
The subject site includes an existing house with attached garage. The Petitioner seeks approval to construct an
approximate 27’ x 34’ garage (connected with a breezeway to the house) that will be located in the side and
back yard area, near the end of the driveway. It will not encroach into any easements or setbacks. The exterior
materials will be brick veneer and siding to complement the house, and the roof will have fiberglass shingles.
BZA variance approval is needed for the total combined square footage of the accessory uses. Please see the
Petitioner’s info packet for more detail on the variance request.
Floor Area: The UDO (Unified Development Ordinance) requires that the combined square footage of the
ground floor area of garages and/or accessory buildings shall not exceed 75% of the ground floor area of the
principal building, and 111% is requested. This is a variance of 36%.
According to the Hamilton County Property Tax Report Card for this parcel, the existing attached garage has an
area of 828 sq. ft. The sum of the two garages will be equivalent to 111% of the ground floor area of the ground
floor area of the Principal Building (which is 1,492 sq. ft. according to the Tax Report Card). That being said,
298 sq. ft. of additional garage area is allowable without a variance from the Board of Zoning Appeals. The
petitioner proposes an approximate 27’ x 34’ garage (around 826.5 sq. ft.).
Homeowners Association approval has been granted.
All review comments have been addressed. The Planning Dept. supports the variance request.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of PZ-2022-00245 V, also with
adoption of the Findings of Fact submitted by the Petitioner.
