G1. Mylin Pool—Swimming Lessons
The applicant has received the following use variance approval:

The site is located at 19 Circle Drive and is zoned Rl/Single Family Residential.

General Info: The petitioner was granted a use variance in 1993 to conduct swimming lessons for 8-9 weeks, from
9 am to 12:30 pm,in their private pool. Since approval,the home-based business has been in operation every
summer,and has recently expanded its hours and scope.
Analysis: Letters were sent from the Division of Building&Code Services regarding the use expansion earlier this
summer,as well as last summer. The Department of Community Services has been made aware of concerns from
neighbors regarding parking and driveway access; lessons for sports other than swimming; extended lesson hours;
and use of an adjacent pool as well as the approved pool for lessons.
While providing swimming lessons is a service to the community as a whole,care should be taken to minimize any
potential negative impact on neighboring residences. This includes limiting the number of students,and thus cars
parked; not blocking any ingress/egress from the street; and limiting to the greatest extent possible excess noise.
This outline is provided to the Board of Zoning Appeals to provide background information to what has been an
ongoing enforcement issue,if additional enforcement action should need to be taken next summer. However,the
attorney for the petitioner has submitted a letter indicating the original terms of the variance will be followed. An
update will be provided at the hearing,including any recommendations on additional enforcement action.
