of the street when lessons are being taught. Said
parking was the primary focus of the initial
complaint filed with DOCD.

SITE VIOLATIONS: Existing use (swimming lessons) dose not comply with the
Home Occupation guidelines, therefore is in violation of the
current zoning ordinance.

requested documentation has been filed.
TAC COMMENTS: None
PUBLIC COMMENTS: DOCD has received several complaints with regard to this
situation, however they have consistently been filed
anonymously. Another neighbor did call in, not to complain, but
to express his view. He feel that Carmel offers adequate
facilities for the teaching of swimming lessons and that this type
use and encroachment into a residential area is not warranted.
PLANS (Site, Landscape, Lighting, Signage, Elevations):
-As of the drafting date of this report, none of the requested documentation has been
filed, however we do not believe that there are any changes planned or proposed from
how the site exist presently.

STAFF COMMENTS/RECOMMENDATION:
-DOCD questions the appropriateness of the procedure in which the petitioner has
chosen to follow. The adjacent property owner's concerns are valid and need to be
addressed. DOCD recommends denial due to the lack of cooperativeness on behalf of
the petitioner. DOCD could have cited the petitioner directly into court, however
choose to attempt to work with the petitioners and allow them time to apply for this
use variance.
