the signage at the Carmel Drive Executive Office Park. If you have not already done so, please refrain from sending out
the Notice of Violation for this site. I will provide Dawn a copy of the Commitments for the ADLS packet for this site, and
instruct her that it is now appropriate to review their Sign Permit Applications.

PROJECT UPDATE
The project update is in response to your letter dated October 9, 2001. In your letter, it was
requested to produce for review a recorded copy of the commitments for V-37-98. Additionally,
sign permits were to be issued for all projecting signs on the site and a Commitment Amendment
must be filed with the BZA.
Based on this notice by the Department of Community Services we checked in our files for a
copy of the recorded commitments. It was discovered the commitments were reviewed and
approved by Department of Community Services and the Legal Department, yet were never
signed by the owner and recorded. The attached commitments were signed by the owner on
October 24, 2001 and recorded with the Hamilton County Recorder's Office at the earliest
possible time on October 30, 2001.
Please contact us at your convenience to determine if all required sign permits have been issued
for all signs on the site. In addition, we may need to schedule a short meeting to discuss the
Commitment Amendment petition to be filed and approved by the BZA. What is the status of the
ADLS Amendment and do we continue with that filing once the BZA acts on the Commitment
Amendment?

Dear Mr. Cosmas:
As outlined in a letter from the Department to you dated September 27, 2001, the property
located at 755 & 765 West Carmel Drive is in violation of the Developmental Standards Variance
approval granted per Docket No. V -37-98. The Motion for Approval made at the October 26,
1998, meeting of the Board of Zoning Appeals stipulated that the approval would only be valid
upon receipt by the Department of Community Services of Recorded Commitments to the
following effect:
. The Projecting Signs would not exceed 8.75 square feet in Sign Area.
. No Wall Signs would be erected on the buildings.
. The Projecting Signs would only be allowed on the Ground Floor.
To date there is no record that this requirement has been met. If you have a copy of the
recorded instrument, please submit it to the Department immediately. If the document has not been
recorded, please submit a copy to the Department immediately for review prior to recording.
Until the Commitments have been recorded and filed with this office, and Sign Permits issued for
the existing signs, each sign currently on site constitutes a separate violation of Section 25.7.02-
]O(a), Section 25. 7. 02-] o (b), and Section 25.7.07 of the Carmel/Clay Sign Ordinance (Z-302).
There is currently an ADLS Amendment petition (Docket No. 112-01 ADLS Amend) filed

for this property. Before it can proceed further:
1) the Department must receive a copy of the recorded Commitment instrument;
2) Sign Permits must be issued for all signs currently established on site; and
3) a Commitment Amendment petition must be filed with and approved by the Board of
Zoning Appeals.

Petitioner seeks Architectural Design, Lighting & Signage approval of previously approved tenant signage. The
site is located at 755 and 765 West Carmel Drive. The site is zoned M-3.
Filed by Carol Shideler of Shideler Dermatology Group.
The petition will be placed on the October 2,2001 Special Studies Committee agenda. We will need 10
information packets in our office no later than September 21, 2001 to be mailed out to Commission members
with the Special Studies Committee Agenda. The information for distribution to committee members should
contain elevations of the building, sign elevations in color and a site plan at a minimum.
In addition, it is my understanding that there are signs on the property today that have been placed without the
appropriate permits. Please have the applicant contact Dawn Pattyn to resolve this matter. The item will be
removed from the agenda if this issue is not resolved by September 21, 200 I.
Please contact Ms. Shideler at 846-2396 with this information. Once the docket is assigned please return the file
