1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
Our house(1491 Pondview Dr) is at the north end of Pondview where it ends in a cul-de-sac.The north property line is
on 146th Street.The east property line is at 1515 W 146th St and that house is approximately 175 feet from the rear of
the proposed structure.The south property line is at 1497 Pondview Dr and that house is approximately 75 feet from
the south side of the proposed structure.The west property line is on Pondview Drive.The proposed structure is located
at the.rear of the lot and does not obstruct the view of any of the neighbors.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The proposed structure will be constructed of the same materials and in the same style as the existing house. It will
appear to have been built at the same time as the existing house.The driveway is being replaced at the same time so
that it will be lined up with the new structure also.
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in
the use of the property because:
It does not allow enough square footage for garages to be built on larger lots such as this one.The ordinance is based
only on the square footage of the 1st floor, not the total square footage of the entire living area and also taking into
account the size of the lot.

IT IS ThEREFORE the deci i ,9f the Carmel Board of Zoning Appeals that Development Standards Variance Docket
No. VZ -2OZ2 —00 2 v is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof. 2
