Dear Mr. Samson: At the meeting held on Monday, January 23, 2023, the Carmel Board of Zoning Appeals Hearing Officer took the following action regarding the Development Standards Variance (V) requests filed by you for the property located at 799 Spruce Drive: APPROVED with Condition: Samson Residence, Pool Variances - Development Standards Variance approvals for: • PZ-2022-00249 V: Max. 35% lot cover allowed, 46% granted, • PZ-2022-00250 V: Pools & their decking must be located at least 3-ft away from any easement and 10-ft away from property lines; 2-ft encroachment into easement requested and 7’9” rear setback granted, and • CONDITION: The Petitioner will work with the Carmel Engineering Department to improve any drainage and/or standing water problems. Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the improvements must be underway, or a written request for a one-time, six-month extension of the approval must have been received and approval granted by this Department. The expiration date of the approval is January 23, 2026. Please include a copy of this letter with any permit application, including the pending swimming pool permit.
