Dear Ms. Piccione:
At the meeting held Monday, January 23, 2023, the Carmel Board of Zoning Appeals took the following
action regarding the Special Exception (SE) request filed by you for the property located at 44 Horseshoe
Lane:
APPROVED with Conditions: PZ-2022-00208 SE – 44 Horseshoe Ln. Group Home
• Condition 1: The Petitioner addresses remaining TAC review comments before the issuance of the
remodel permit,
• Condition 2: The Petitioner complies with all applicable laws, regulations, and restrictive HOA
covenants and limitations as it relates to UDO Section 9.08(E)(3),
• Condition 3: The special exception approval is only valid for 5-year time limit, and
• Condition 4: The implementation of special exception will not otherwise result in a violation of any
limitations or prohibitions imposed by any applicable HOA restrictive covenants.
Please be advised that per Article 5.72.D of the Unified Development Ordinance, along with the
conditions of approval, the aforementioned Special Exception approval is valid for five (5) years. The
expiration date of the approval is January 23, 2028.
