HomeMy WebLinkAboutFindings of Fact CARMEL BOARD OF ZONING APPEALS CARMEL, INDIANA Docket No: IL Public Hearing Date: July 23, 1990 Petitioner:CARMEL CLAY SCHOOLS Notice Requirements Met: FINDINGS OF FACT - SPECIAL USE EXCEPTIONS 1 . The Special Use in Flood Plain District, Ordinance 2160, Section 21 . 6 as amended does not apply and all prerequisites have been met by Petitioner as verified by review of NFIP community flood hazard maps . There is no flood plan associated with the site. 2 . The Special Use Exception will be consistent with the Character and Permitted Land Use of the zoning district and Carmel-Clay Comprehensive Plan because the contiguous High School will require the parking as an accessory use. The existing parking use will be expanded. 3 . The Special Use is physically suitable for the land in question because off-street parking already exists . 4 . The Special Use will injuriously or adversely affect the adjacent land or property values because enlarging the parking area from 50 to 450 spaces removes a large green area and buffering to the adjoining and neighboring properties . Bright lights , noise, traffic and trash all will affect property values . 5 . The Special Use will adversely affect vehicular or pedestrian traffic flow; there is inadequate storm draining facilities proposed because the Petitioner has no viable plan for safely getting pedestrians from the proposed new parking lot on the south side of Main Street to the high school on the north side of Main Street. Further, no stop light commitment has been made by the school and the traffic study shows that a stop light would be required. The chance for accidents will increase dramatically due to the proposal of the Petitioner and there is not adequate provision to safeguard pedestrians and traffic during high activity times . Additionally, the close proximity of the elementary school to the proposed lot and the increased congestion and traffic, both pedestrian and vehicular, would substantially increase the potential of inflicting injury on the elementary school children. 6 . The Board has reviewed the requirements of Ordinance 2160, Section 21 . 3 ( 1-25) as they relate to this Special Use, and finds that those criteria prevent the granting of the Exception as provided in this Findings of Fact. The Special Use will not adversely affect vehicular or pedestrian traffic flow, nor the adequate availability of water, sewage, or storm drainage facilities , or police or fire protection because: All necessary services/infrastructure will be planned for with the site development . 6 . The Board has reviewed the requirements of Ordinance 2160 , Section 21 . 3 ( 1-25 ) as they relate to this Special Use, and does not find that those criteria prevent the granting of the Exception: DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Special Use Exceptions Docket No . is (not) granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
