3d. Brookshire Village Subdivision - Entry Signs
The applicant seeks the following development standards variance approval:
Docket No. 06070005 V ZO Chapter 25.07.01-04 off-premise sign age
The site is located at the comers ofCharjing Cross Rd & 126th, Kensington Rd & Gray Rd, and
Bentley Dr & Gray Rd and is zoned R-2lResidence.
Filed by Dixie Packard for the Brookshire Village Home Owners Association.
General Info: The petitioner seeks approval to
place 3 new entry subdivision signs within the road
median, located within the road right of way. The
sign ordinance does not permit signs within the road
right of way, which are also considered to be off-
premise signs. Any newly erected signs must follow
the current sign ordinance, even if they are replacing
an existing sigp.s.
Analysis: The new proposed signs will replaC(.e
three older existing signs. These signs let drivers &
pedestrians know that they are entering the
Brookshire Village residential subdivision.
Additionally, the signs will need "consent to
encroach" approval by the Engineering Dept, in
order to be located within the road rights of way.
Findings of Fact:
1.) The approval of this variance will not be
injurious to the public health, safety, morals, and
general welfare of the community because: The
proposed signs will replace signs that already exist
within the road median. The new signs will
rejuvenate the entryways to the subdivision.
2.) The use and value of the area adjacent to
the property included in the variance will not be
affected in a substantially adverse manner
because: The proposed signs will replace signs that already exist within the road median. The new
signs will rejuvenate the entryways to the subdivision.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: the signs will have to be located elsewhere
along the road within the common area or on a resident's property, possibly creating a hardship to the
neighborhood association. The proposed signs will replace signs that already exist within the road
median.
Recommendation: The Dept. of Community Services recommends positive consideration of
Docket No. 06070005 V with the condition that the signs receives "consent to encroach" apProval by
the Engineering Dept and the Board of Public Works.
