This letter will detail actions we have taken in response to your October 24 review letter. Please also find
a revised landscape plan indicating these changes.
The following is our response to the specific review comments:
1. The note "Guy wires, hose and stakes to be removed one year after planting" has been added to
each tree planting detail.
2. Note 19 has been added to the General Notes stating that "All installed plantings shall be
appropriately watered for a minimum period of one year to allow for their establishment."
3. The note "Root flares to be planted at or slightly above grade" has been added to each planting detail.
4. Shade trees have been added along both sides of the entrance road.

Dear Matt:
As during the TAC review on October 17,2001, and our subsequent phone conversation,
my comments on these two properties are as follows:
CH Land Inc (Dental Office)
1. Planting Notes: a note shall be included which requires the removal of all stakes and
wires within one year. A note shall also be included that details that amount and
manner by which installed plants receive enough water for their establishment.
2. Planting Details: on each detail a note shall be added that requires the root flares of
the plant material to be planted at or slightly above grade level.
3. Along the entrance road through the property to the CMC Inc. site, both sides of the
road should be landscaped at this time, including large maturing street trees.
Attached is a list of recommended street trees.

1. This project falls under the U. S. 31 Highway Overlay Guidelines. Foundation
p1antings are required for the buildings proposed, and plans for such need to be
submitted for review. Also planting strips with landscaping are required around the
parking lot perimeter in addition to the site perimeter buffering requirements, as per
Appendix A of the Carmel/Clay Zoning Ordinance. In areas along the parking lot
perimeter, where other landscape requirements intersect the parking lot perimeter-
planting strip, the parking lot perimeter requirement can be waived. This waiver only
includes buildings being constructed as part of the current project and submittal.
2. Junipers and currants are both listed as species to be planted on the project. Both
species are alternate hosts of a problematic fungal disease called Rust. There is a
high chance that both species would become infected and pass the disease back and

forth between each other. It is recommended that one or the other species be
eliminated from this planting plan.

Dear Mr. Coots:
We have reviewed the subject drawing and revisions. It appears that some of the issues pointed out by the
City of Carmel Engineering Dept. on the plans received July 24, 2001 have been addressed. However, we
did not receive a letter from you or The Schneider Corporation summarizing the plan changes that where
made in response to the comments in the first Project Review Letter from the City of Carmel Engineering
Dept. dated Sept. 18,2001. We would like to have a written response to the comments made in the Sept.
18, 20011etter as well as the following additional comments:
1. We would like to see some details on the Meridian Corners Blvd. entrance and median work. A
right-of-way asphalt section detail should also be provided within this set of plans.
2. Will the new entrance affect any part of the existing median?
3. The "Future Right Turn Lane" area should be crosshatched or delineated and detailed as to how
and when this work will occur.
4. Signage should be indicated in the area of the entrance to safely guide traffic through entrance and
exit movements. For example: "Keep Right" sign in median and a "Do Not Enter" sign at the exit
from the Park Meadows Subdivision.
5. In addition to existing edge of pavement grades, spot elevations or flowline elevations should be
provided at the any swale or grass area within the right-of-way.
6. Note #3 on sheet C101 should be revised to read "Any part ofthe sanitary or storm sewer trenches
rwming under paved areas or within 5 feet of paved City streets to be backfilled with granular
material."
7. The easterly limits of construction of the entrance roadway should be shown.
8. Where does the drainage go? The structures on the plans have not been nwnbered to correspond
with the Storm Structure Schedule. From the Storm Structure Schedule on sheet C102 it appears
that the drainage is being released into the existing storm sewer to the west along Meridian
Corners Blvd. If this is the case, the existing pipe and structures should be shown and sizes
indicated. Additionally, existing pipe flow should be determined so that it can be verified exactly
what added flow the existing system will handle.
9. It appears that no detention is being provided for this site. The calculations indicate that the lack
of detention on the Dentist Office site is balanced by a detention volume and release rate that is
more conservative than required on the CMC site. The City can't approve this "credit" method if
the downstream facilities can't handle additional runoff.
10. If storm drainage from this site is going to be discharged onto the site to the south to drain to the
retention facility on the CMC Development to the east, the swale that will direct this flow should
be detailed. If it is not going to drain to the south, what is the purpose of the pipe stub out?
11. Details should be provided on how the construction of this development will be phased in
relationship to the CMC Development.

The undersigned has reviewed the proposed plans for

and has approved the plans subject to the following:
1. We are requesting that a Knox Box be installed on the building for fire department emergency
access. An application for this secure box can be obtained through our office.
2. It appears that the building will be sprinklered. A meeting will need to be set up for the location of
the fire department connection. We are also requiring Knox fire department connection caps for
the fire department connection.

Hello everyone:
Following are CTRWD comments on the agenda items effecting our sanitary sewers or service area for the October 17
TAC meeting. Please feel free to copy and distribute this email or attach it to your meeting minutes.
CMC & CH Land Properties
To follow on our comments from last month's TAC meeting, the District has reviewed the plans and notes that the sewer
connection is proposed through core drilling a manhole. District specifications need to be added to the plans and special
permit conditions will apply for the core drill. Building permits should NOT be issued unless the District has issued its
connection permit.
Claybourne Estates
The District has reviewed the plans and has been in discussions with the developer about sanitary sewer service. An
offsite sewer extension, the location of which is being negotiated with the Hamilton County Highway Department, will be
needed to serve this property. construction plans would still need to be reviewed by the District's consulting engineers.
Once that review is complete, the plans will be ready to be submitted by the District to IDEM for State approval along
with the District's plans for the offsite sewer extension.
Papay Subdivision (136th Street East of Towne Road)
The District has not received any plans for this proposed subdivision. Please advise the applicant to contact the District
and provide plans for our review.
The Sanctuary (1 06th & Crooked Stick Lane)
The District has not received any plans for this proposed subdivision. Please advise the applicant to contact the District
and provide plans for our review.
Carpenter GMAC (790 West 122nd Street)

right-of-way. Building permits should NOT be issued unless the District has issued its connection permit.

We have reviewed the drawings submitted for this project and offer the following comments:
GENERAL INFORMATION
1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:
. Street and Right of Way - City of Carmel.

. Sanitary Sewer - Clay Township Regional Waste District
. Storm Sewer - Hamilton County Surveyor's Office
3. Board of Public Works and Safety Approval Requirements:
. Commercial Curb Cut. Please provide an exhibit that shows the location of the curb cut and
aceIVdecel1anes if applicable; appropriate dimensions including drive width, overall width at the
street, acelVdecel dimensions, radii, etc.; and location of existing opposing curb cuts, if applicable.
The exhibit should be 8 Y:z x 11 or of a size that can be reduced to 8 Y:z x 11 such as 8 Y:z x 14 or 11
x 17.
. Temporary Construction Entrance. Same requirements as for the Commercial Curb Cut.
. Consent to Encroach Agreement for any permanent improvement to be installed within dedicated
right of way or within dedicated easements.
. Right of Way Dedication
. Secondary Plat (if applicable)
I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines
for your use. Please use the Engineering Department deadlines for submissions to the Board.
Any submission to the Board requires prior final approval hy the Carmel Clay Plan Commission
and/or the Board of Zoning Appeals and completion of review by the Technical Advisory
Committee. All written requests to be place on the Board's agenda must include the appropriate
Docket Numbers and the date (or dldes) of approval by the Plan Commission and/or BZA.
4. T AC Review/Drawings submitted for approval:
We request that all comments and comment letters generated by this office be answered in writing and
be accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all issues have been resolved. The design engineer must certify all drawings
submitted for final approval. TIus office will require three-sets of approved drawings after all issues
have been resolved. TIle drawings will be stamped approved and signed by the City Engineer. The
Developer/Owner will receive one-set which is to be maintained on the construction site at all times.

Our Public Works Inspector will receive one-set and one-set will be maintained in the Department of
Engineering. If more than three-sets are requested to be approved, the additional sets must be
submitted with the three required sets.
5. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated right of
way will require a Consent to Encroach Agreement between the OwnerlDeveloper and the City of
Carmel. This Agreement requires Board of Public Works and Safety approval.
6. I am including copies of the following with this correspondence:

. Performance Release Procedure.
. Permit Data, Contacts, etc.
. Commercial Permitting Procedures.
I will send a copy of our Residential Subdivision and Commercial Irrigation System Requirements

BONDING REQUIREMENTS
7. Upon initial review, it appears the following bonding requirements will apply to this project:
Performance Guarantees
. Sidewalk (in right of way)
. Monuments & Markers (if platted)
Please provide individual, detailed certified Engineers Estimates for 100010 of the cost of labor and
materials for the above improvements. Post individual Performance Guarantees in the amount of the
Engineer's Estimates. Three-year Maintenance Guarantees will be required upon release of the
Performance Guarantees.
Street CutlRight of Way Permit and Bonding Requirements
Any work in dedicated right of way will require a Street Cut!Right of Way Permit and a License and
Permit Bond. The bond amount will be determined by the number of instances of work in the right of
way (curb cut, storm sewer work, etc.) @ $2,000.00 per instance. From the drawings submitted, it
appears there are at least four instances of work in the right of way including a commercial curb cut, a
temporary construction entrance, water service line installation and sanitary sewer service line
installation.
PROJECT COMMENTS
8. Please prepare dedication documents for the additional15-feet of right of way.
9. Show and identify/dimension existing right of way lines on both sides of Meridian Corners Boulevard
on all sheets. TIle existing right of way is 45-foot half, 90-foot total. With the dedication of an
additionaI15-feet, the new right of way will become 60-foot half (south halt).
10. Please include either an asphalt path or sidewalk in the right of way of Meridian Corners Boulevard.
II. A median cut, or what appears to be a median cut, is indicated on Meridian Corners Boulevard for the
temporary construction entrance. This would be a Board of Works issue. However, this office would
not recommend approval of the temporary construction entrance as indicated on the plans.
12. The City Engineer has not approved the entrance road or its location/alignment as indicated on the
plans.
13. Is the entrance road intended to be private? If so, provide a right of way pavement section in the
general details. The minimum acceptable right of way pavement section is 10" stone, 3" binder and I
W'surface. Also, remove that portion of what appears to be a median from the Meridian Corners right
of way (new right of way).
14. If the entrance road is intended to be dedicated, City of Carmel standards will apply.
15. In either case, this office requests that the road plans and specifications be included with this project.

16. We must have all entrance issues resolved, including:

17. We will not accept the Plan Note on Sheet ClO1. The entrance road will either
1) Be built prior to these plans being approved or
2) Be on a set of approved plans for the adjacent site or whatever site "others" is referring to.
We do not allow for "pending" conditions or approvals to be placed on proposed plans. This decision
and the arrangements for whom and when the entrance road shall be constructed will be made prior to
approval for this project.
18. What are the plans or intended use ofthe south portion of the lot, south of the entrance road? Any
future development shall only have access to the "Entrance Road" and should align with curb cuts.
19. On Sheet C 1 02, the end section appears as a half moon in the north travel lane of the entrance road.
Label or indicate the connection pipe. What will happen to tIus stonn pipe/structure?
20. What is to become of the curb inlet, the pipe, the end section, the curbing on Meridian Comers
Boulevard that is indicated to be in the construction path of the entrance road?
21. Drainage for tIus site shall be accomplished showing connections to existing facilities, or to
structures/pipes that are part of an adjacent, approved site. The sinlilar "by others" note is not
acceptable, as tile City cannot be guaranteed that drainage from this development could impact City
streets, as this is tIle current drainage flow pattern.
22. Please provide proposed grading plans for the entire site, including areas seeded, etc. As stated
previously, storm sewers/storm drainage for this site is under the jurisdiction of the Hamilton County
Surveyor. We request that this office be included in the distribution of drainage cales and to be copied
on drainage issues effecting this and the adjacent site(s).
23. Regarding Plan Notes 1,2 and 3 on Sheet C102, what is tile development time period for tile CMC
property in relation to this site? Will plans be forthcoming for the CMC site?
24. Regarding the General Notes on Sheet CIOI and C102, there are references to the City of Lawrence,
Citizens Gas and Coke Utility and the City of Indianapolis, all of which need to be corrected.
25. Please remove the responsibility statement above the certification on Sheet CIOO on all future
drawings submitted to tIlis office for review and/or approval.
Many of these questions would have been answered if either "Entrance Road" plans (in full) had been
provided or the CMC plans had been presented or received approval prior to this development. Then the
notes would refer to "under construction" or "built by others".
The above comments are based upon tile Engineering Department's initial review. Please provide our
office with a follow up letter and revised plans, indicating all revisions. A second review will focus only
on revised items. It is critical that our office be made aware of all modifications made on tile plans being
re-submitted, particularly if any such changes are considered "new" or fall outside of our initial review. If

future development shall only have access to the "Entrance Road" and should align with curb cuts.
19. On Sheet CI02, the end section appears as a half moon in the north travel lane of the entrance road.
Label or indicate the connection pipe. What will happen to tins stoon pipe/structure?
20. What is to become of the curb inlet, the pipe, the end section, the curbing on Meridian Comers
Boulevard that is indicated to be in the construction path of the entrance road?
21. Drainage for tins site shall be accomplished showing connections to existing facilities, or to
structures/pipes that are part of an adjacent, approved site. The sinlilar "by others" note is not
acceptable, as the City cannot be guaranteed that drainage from this development could impact City
streets, as this is the current drainage flow pattern.
22. Please provide proposed grading plans for the entire site, including areas seeded, etc. As stated
previously, storm sewers/storm drainage for this site is under the jurisdiction of the Hamilton County
Surveyor. We request that this office be included in the distribution of drainage cales and to be copied
on drainage issues effecting this and the adjacent site(s).
23. Regarding Plan Notes 1, 2 and 3 on Sheet C102, what is the development time period for the CMC
property in relation to this site? Will plans be forthcoming for the CMC site?
24. Regarding the General Notes on Sheet ClOl and C102, there are references to the City of Lawrence,
Citizens Gas and Coke Utility and the City of Indianapolis, all of which need to be corrected.
25. Please remove the responsibility statement above the certification on Sheet CIOO on all future
drawings submitted to this office for review and/or approval.
Many of these questions would have been answered if either "Entrance Road" plans (in full) had been
provided or the CMC plans had been presented or received approval prior to this development. Then the
notes would refer to "under construction" or "built by others".
The above comments are based upon the Engineering Department's initial review. Please provide our
office with a follow up letter and revised plans, indicating all revisions. A second review will focus only
on revised items. It is critical that our office be made aware of all modifications made on the plans being
re-submitted, particularly if any such changes are considered "new" or fall outside of our initial review. If

Following are CTRWD comments on the agenda items effecting our sanitary sewers or service area for the September
19 TAC meeting. Please feel free to copy and distribute this email or attach it to your meeting minutes.
Village of West Clay, Section 6501-B (Secondary Plat)
The District has received the plat and has no comments at this time since construction plans would still need to be
reviewed by the District's consulting engineers. Once that review is complete, the plans will be ready to be submitted by
the District to IDEM for State approval.
CH Land ADLS (Development Plan)
The District has reviewed the plans for this project and notes that the developer is proposing a 6" lateral sewer tie-in
directly to an existing manhole. District specifications will need to be followed for such a connection and building permits
should NOT be issued unless the District has issued its connection permit.
College Hills PUD Text Amendment
The District has no comments relative to the text of the proposed PUD ordinance. We have previously provided
comments on a number of construction related issues including sewer capacity in the area, capping of individual private
wells, and proper abandonment of individual private septic systems which will be effected by this project.
Hilton Garden Inn (Revised Development Plan)
It is unclear if this property will require sewer service from the District or not. From the location description (southeast
comer of Meridian and West Main Street) it is more likely within the service area for Carmel Utilities. However, please
have the applicant provide plans for the District to review so that we can make a definitive determination.

We will need 20 information packets in our office no later than October 5,2001 to be mailed out to Commission

At this time I have not received copies of the recorded covenant for this property in addition to a copy of a
dedication of right-of-way. These two items were a condition of the rezone. If copies of these documents are
not received from the petitioner by September 19, 2001 (the day ofTAC) this item will not be placed on the Plan
Commission Agenda for October 16th.
In addition, the site plan submitted with the application is not complete. The areas illustrated as, "by others" can
be constructed by whomever the property owner has an agreement with. However, the detailed construction
drawings for these improvements shall be included on the plans for this site. To date, the applicant as not
requested to meet with the Department to discuss the logistics of how the overall site will develop.
In addition, the application that was submitted was a ADLS Amendment. This is not an amendment. The
application must be filed as an ADLS. We will accept a new application form from the applicant as opposed to a
refileing.
At this time there should be no expectation on the part of the applicant that this item will appear on the October
16th Plan Commission agenda. I will provide the applicant with information regarding the action necessary to
proceed. The timeliness of satisfying the rezone conditions and of filing a complete site construction plan are the
responsibility of the applicant. The preparation of the documents necessary for the dedication of the right-of-way
is not a process that can be addressed overnight and our department has not received to date the survey and legal

Dear Councilor Wilson:
This letter is in response to comments and concerns raised regarding the above referenced
petitions. The Department Report to the Cannel/Clay Plan Commission on June 19 (see 1st
attachment) indicates that it was the intent ofthe Department to make the City Council aware of
concerns regarding the nexus between the DePauw parcel and the granting of the rezone for the
CMC and CH Land petitions. This intent was forwarded in the form ofthe Certification of Plan
Commission's Recommendation (see 2nd attachment).
It appears that all of the pertinent information regarding this request has not been forwarded to
the City Council members. ill order to clear up any confusion the Department would like to see
the following addressed/considered to the satisfaction ofthe City Council prior to action on the
two rezone requests:
1. That the applicant dedicates or will dedicate right-of-way pursuant to the
Thoroughfare Plan along both Meridian Comers Boulevard and 1315t Street.
2. That the applicant provided sufficient evidence that they commit to file ADLS for CH
Land property (see 3rd attachment). The attachment is an unsigned copy.
3. That the applicant provided sufficient evidence that they will construct access onto
Meridian Comers Boulevard in accordance with the plan proposed by the City
Engineer (see 3rd attachment). The attachment is an unsigned copy.
4. That the applicant submit documentation whereby DePauw would agree to reserve the
property covered under Docket Number 188-00 Z for future State Highway
Improvements (see letter dated June 21, 2001, from the DePauw attorney, the 4th
attachment and the 5th attachment which it is our understanding is a work in progress,
also unsigned).

Copies of this transmittal will be provided to members of the Land Use and Annexation
Committee this afternoon as well as Mr. Coots. I will also copy John Molitor. This is
information the Department feels is necessary for review by the City Council in making any
decision regarding the proposed rezone. The Department recommends that the rezones be
approved subject to the following:
1. Dedication of right-of-way pursuant to the thoroughfare plan.
Along Meridian Comers Boulevard there exists a 90-foot wide right-of-way. The
Ordinance requires a 120-foot wide right-of-way. We would request the City Council
approve the rezone requests subject to the dedication of an additional 15 feet of right- of-
way along the full extent of the DePauw parent tract and the CH Land tract as identified
in the Thoroughfare Plan. In fairness to the petitioner the Plan Commission did not
address this issue. However, Staff had discussed the issue with the petitioner. At this
time we feel it is necessary and the Council has the authority to request it under the
existing Thoroughfare Plan.
In addition, the Department will require additional right-of-way to be dedicated on the
site along 131 st Street when the applicant submits a Development Plan Application for
that site. As an alternative, the City Council may desire that the applicant commit to
dedicate the subject right-of-way for 131 st Street as part ofthe rezone. Whichever the
case, the Department would recommend requiring a legal description as well as a general
survey ofthe area to be dedicated. This description should then be reviewed by the City
Engineer to confirm its accuracy.
2. Commitment to file ADLS for CH Land Property
The applicant has submitted a draft of a covenant agreeing to ADLS for the CH Land
parcel. However, we do hot have a signed copy of the covenant. A recorded copy ofthis
covenant should be presented in commitment fonn by the applicant prior to action on the
rezone by the City Council.
3. Construction of entrance onto Meridian Corners Boulevard
The applicant has submitted a draft of a covenant agreeing to construct the improvements
as proposed (see 1 st attachment, third page) subject to final approval by the City Engineer.
However, we do hot have a signed copy ofthe covenant. A recorded copy of this
covenant should be presented in commitment fonn by the applicant prior to action on the
rezone by the City Council.
4. Execution of the document prepared by John Molitor (see 5th attachment)
This document concerns the reservation of the real estate described under the application
filed under Docket Number 188-00 Z (the area ofland required to be reserved for
Pending State Highway Improvements). The fourth attachment to this letter is from the
attorney representing DePauw and is the basis for the drafting of the commitment. It is
the understanding ofthe Department that this document is a work in progress. A
recorded copy of this document, once completed, should be presented by the applicant
prior to action on the rezone by the City Council.

1. We are requesting that a Knox Box be installed on the building for fire department emergency
access. An application for this secure box can be obtained through our office.
