Dear Dave:
This letter serves to acknowledge receipt of a transmittal containing the plans for DP01-B. After reviewing
the plans and the submitted material, the Highway Department has the following comments from the
September 17, 2001 plus several other comments:
SecondarY Plat
1. The Application for Project Review was received but the fees were not included. Please forward
the fees to my attention.
2. A 15' DUE is needed along the right of way for Rhettsbury Street to connect the easement through
Block A to the alley.
3. A 2' non-access easement is needed along Rhettsbury Street.
4. There is no reference to the DUS&AE in the plat legend.
Construction Plans
5. A Maintenance of Traffic Plan is needed for the work along Rhettsbury Street.
6. The wall shown in the right of way south of Rhettsbury Street will not be permitted. The wall and
planter shown at the east end of the project south of Rhettsbury Street will not be permitted to
remain in the right of way.
7. Granular backfill is needed in the right of way south of storm sewer structures 600 and 601.
8. Please correct the Commissioners signature block names to Steven A. Holt and Steven C.
Dillinger.
9. The SSD located under the curb must be extended and connected to the new storm structure to
be installed.
10. Plan and profile sheets are needed for the new storm structures.
11. Is the existing stub street to be removed? Please provide a note stating the actions to be taken.
12. How will the pavement be removed in the area of the new curb? Patching of the existing street will
not be permitted. Please provide more information concerning this matter.
13. Please provide a note stating all pavement and curbs are to be sawcut before removal.
14. Include all applicable HCHD standards.
15. Do any existing utilities need to be relocated for this project?

Dear Jon:
This letter serves to follow up on our appearance before the Technical Advisory Committee at
their meeting on September 17, 2001, regarding the above referenced section of the Village of
WestClay. At the meeting you correctly identified issues with the build-to-line, front yard setback
and lot dimensions that required us to amend our original plan to comply with the governing
PUD ordinance. We have revised our land plan and plat in accordance with the following:
1. Build- To-Line
Its definition is:
Build-to Line. An alignment which dictates the maximum front yard setback from a
street or public riJ!ht-of-wav. to be followed by buildings or structures fronting thereon.
The build-to line does not apply to building projections or recesses. Where a build-to
line is specified, the area between the frontaJ!e line and the area forward of the build-to
line specified in Section 9.1.B is the reouired minimum front vard setback, subject to the
variation permitted by Section 9.1.B.
The variation permitted by Section 9.1.B is as follows:
9.1. The following standards and guidelines apply to blocks within the Primary Area:
B. Each block shall be designated with a build-to line which shall establish
the front yard setback for the lots on the block. The build-to line shall not be
closer to the frontage line than the build-to line for the proposed uses established
in Section 15. A minimum of 95 70 vercent of all buildings on the block shall
sit back no further than the build-to line. with the remaininl! Z5 30 percent
allowed to van bv beinJ! further setback no J!reater than 75 percent of the
distance from the frontaJ!e line to the build-to line for residential or no further
than the maximum setbackfor commercial uses. Buildings shall be allowed to
come forward of the build-to line by no greater than 25 percent of the distance
between the frontage line and the build-to line for residential structures and 50
percent of such distance for other buildings.

Hence, up to 30 percent of the lots on a block could be placed 35' from the frontage line (20' BTL
plus an additional 75% of that 20').
2. Front Yard
The frontage line is measured relative to the street serving the lot:
Frontage Line. The property line adjacent to the street.
In the case of the proposed duplex homes, the front of the home is designated as that part of the
home that faces the alley serving that home. On an alley, the "right-of-way" of the street is a 24'
wide street easement, thus the frontage line would be the limit of the alley easement, or 12' from
the center of the alley. Hence, allowing the maximum 20' of front yard permitted in a duplex
would place the limit of the front yard 32' from the center of the alley.
On the attached plat we have indicated BTL's that are either, 18',24' or 30', measured from the
property line of each lot, which is the center of the alley. In accordance with the variance
permitted by Section 9.1.B discussed above, the BTL could be pushed back as far as 47' from the
property line (35' plus the 12' "half right-of-way of the alley") for up to 30% of the units in a
block. Although the plat shows a uniform BTL on a block, it is conceivable that the custom
design of a particular duplex unit could take advantage of the variance. The variance would be
shown on the plot plan submitted at the time a building permitted is requested.
We will proceed with preparing the construction plans for the development of this section,
anticipating delivery of lots, and start of the construction of homes, in the Spring of 2002. We
will submit the plans for your and the TAC member's review. Note too that we realize that the
density limits on the Village call for no more than 28 duplex units ("attached two-family villas"),
and that the permitting of the homes on lots 663 and 677 was done so under the "duplex"
guidelines; therefore, of the 30 units shown, four will need to be developed as "attached
townhomes" .
