Dear Mr. Thompson:
This letter acknowledges the receipt of check numbers 2902 and 3134 from Boomerang
Development as payment for commitments concerning the use and development of real
estate made to the City of Carmel for the Claybourne subdivision. After receipt of check
number 2902 in the amount of$61, 677.00 on November 30,2005, the remaining balance
on these commitments was $61, 677.00. This balance was satisfied by the receipt of
check number 3134 on December 21,2005. This commitment has now been satisfied.

TYPE OF EVALUATION: Initial X Routine X Follow-up 0 Complaint
This evaluation is intended to assess the level of compliance with 327 lAC 15-5 (Rule 5). It is also intended to identify areas
where additional measures may be required to control erosion and sedimentation. All practices recommended in this report
should be evaluated as to their feasibility by a qualified individual with structural practices designed by a qualified engineer.
All erosion and sediment control measures shall meet the design criteria, standards, and specifications outlined in the "Indiana
Handbookfor Erosion Control in Developing Areas" or similar guidance documents.
Current Site Information: Site development for sec. 2 is nearly complete. Utilities are being installed behind the curb.
Final grades have been established for several months. The sediment basin is not seeded or mulched. The mounds,
county road R/W and swales have been seeded and mulched. Most of Sec 2 has been left unprotected.
The Following Items Have Been Evaluated and Assigned a Designation of:

removed (do not flush with water) at the end of each work day.
Other Requirements:
. All homes under construction need a perimeter barrier along the curb, stone entrance and inlet protect.
. The outlet for the sediment basin was installed but the dam or basin has not been seeded.
. Because the 8-26-03 site report recommended temporary seeding, and no cover has been established as of
this date, a violation notice is recommended for this project. The responsible parties must know that grass
cannot be established in the winter time. Mulching has still not been established. A violation has occurred.

The Claybourne Subdivision currently is upstream of two ponds that are located on
adjoining parcels. As we have previously discussed and your letter dated December 17
indicates, the owners of the ponds have expressed COncern that there will be a loss of
water going to their ponds if the proposed subdivision is built according to the current
storm design. I have inspected the site and have met with one of those landowners. The
Hamilton County Surveyor has stated that runoff from Claybourne may be discharged to
the existing ponds provided that certain design criteria is cleat'ly spelled out and the
following be taken into account.
1. An easement from the Claybourne subdivision to the ponds would be required.
2. The amount of cf..~ discharged is to be based on current nmoff rates.
3. Adequate erosion control measures be designed and installed.
4. Other off site improvements may be required, such as, grading of swales, installation
of SSD for low trickle flows. etc.. These items would be detennined during the
design of the construction plans and require approval by this office.
5. The final plans should include an agreement between the affected parties.

RE: Status report of 131st Street
County Line (Austin Oaks Subdivision) to West Road
Clay Township
Dear Jon:
This letter serves to update you on the status of the road widening project for 131 st Street from
the County line to West Road. The Highway Department has entered into an agreement with the
Clay Regional Waste Department to acquire the right of way that is necessary for the
improvements of the road and the installation of a gravity flow sanitary sewer line. The acquisition
process of the right of way has begun, at this time none has been acquired. If the Highway
Department is able to secure a right of entry from the necessary property owners, the Department
will address the issue of the drop off at the edge of the pavement this year, by placing temporary
pavement along the existing road edge.
When the necessary right of way has been acquired, a construction project that would shift the
current centerline of the road 21' feet to the north is planned. The new road would consist of 2-
12'-0" lanes with 3'-0" stone shoulders. The road will transition to match the existing pavement at
the Austin Oaks Subdivision and West Road. The funding for the construction project is not in
place as of this letter, however, the Highway Department fully intends to complete the project in
the year 2002.

The undersigned, Boomerang Development, LLC, (hereafter "Own~~lt the Contr~
Purchaser of the following described real estate located in Hamilton County, d.. _ "-
"Real Estate"), makes the following Commitments Concerning the Use and Dev I 'JJ '~of
Real Estate to the CarmeVClay Plan Commission <"Commission").
1. Description of Rea! Estate. See Exhibit "A" hereto. t'Real Estate").
2. Docket # 119-01PP
3. Statement of Commitments.
A. Owner commits to construct roadway improvements to the parts of West
131'& Street and Shelbourne Road adjacent to the Real Estate to provide
the following:
1. a 'l2 roadway (including existing pavement) of two (2) 12 foot
lanes with curb and gutter; or
2. a ~ roadway with an addition of three (3) feet of pavement and
three (3) foot stone shoulder to the existing pavement together with
other roadway improvements determined by DOCS (Other
Roadway Improvements) or at the option of owner in lieu of the
Other Roadway Improvements a cash contribution payable to the
City of CarmeL Indiana, in an amount as determined by DOCS. -
The cash contribution, if elected by Owner, shall be paid at the time of the
approval of a Secondary Plat for a Section(s) in an amount equal to the total cash
contribution divided by 258 times the number oflots shown on the Secondary Plat
for which approval was received. The roadway improvements provided for and
contemplated by these commitments require and are subject to the approval of the
Hamilton County Highway DepartmentlHamilton County Commissioners.
4. Binding on Successors and Assigns. These commitments are binding on the
Owner of the Real Estate, each subsequent Owner of the Real Estate, and each
other person acquiring an interest in the Real Estate from Owner. These
commitments may be modified or terminated only by a decision of the
Commission made at a public hearing after notice as provided by the rules of the
Commission. The foregoing notwithstanding, these commitments shall terminate
upon the recordation of a Secondary Plat as to the part( s) of the Real Estate
described therein.
5. Effective Date. These commitments contained herein shall be effective upon ''the

In connection with the Primary Plat Application for Claybourne Estates, and as represented to the
Subdivision Committee last Tuesday, please accept the following as amendments to the Plans now on file
with the Department of Community Services:
The Primary Plat is amended to eliminate the street extension to the West
property line of the part of Claybourne lying south of 131 st Street. The area
created by the elimination of the street extension will be incorporated into the 5
to 8 nearest lots.
The trail system to be constructed within Block A will be redesigned on the
secondary plat so as to connect to the adjacent multi-use path; and
The street lighting as approved by the Hamilton County Highway Department

Claybourne, please find enclosed a Traffic Operations analysis (Study) prepared by A&F
Engineering. The Traffic Study was initially prepared for The Thompson Companies as part of
it's initial planning. Please note that the Study assumes 288 home sites, but the planning process
resulted in a reduction of the number of lots from 288 to 258. A copy of the Study has also been

bordering on the north side of proposed subdivision. Upon our real estate lies a pond
approximately two acres in size. This pond receives natural run off waters from your
tract ofland. Has any consideration been given to the natural flow of water or any other
problems that may arise because of the new development? We would appreciate a
discussion of this topic at the November 20th hearing before the Carmel Plan
Commission.
We would also hope that you or your representatives would discuss the proposed housing
density as well as the present inadequate road facilities. Does the future include

This letter serves to acknowledge receipt of a transmittal containing the Primary Plat for the
ailbove--mentioned project. After reviewing the plat, the Highway Department has the following
comments:
1. An APplication for Project Review needs to be completed and the appropriate review fees
for a PrImary Plat paid. before any approvals will be granted from this office. I have endosed
a blank form tor your use. ,
2. In accordance with the Hamilton County Thoroughfare Plan, additional right of way Is
required at the intersection of 131st Street and Shelborne Road. On Shelbome Road. the
right of way from the intersection to a point SOO' to the north Is a 60' half. From that point to
the northem property line the right of way Is 46'. On 131ft Street, the right of way from the
intersection to a point 500' to the west is a 65' half. From that point to the eastern property
line the right of way Is a 50' half.
3. Please Include the 25-MPH design speed on the cover sheet.
4. Please dimension the accelldecellanes. The decellane 5hould consist of a 200' taper and a
150' lane. The accel taper should be 200' in length.
5. The Highway Department requests that stub streets be extended at or near the following
streets; Tolbert Place, Ponte II Place and Rowlett Place or Elseth Drive.
6. All offsite utilities must be placed outside of the future right of way.
7. Please provide horizontal curve infonnation for all street centerlines. All centerline curves
must be a 150' minimum.
8. The curb radII at all entrances must be a minimum 0140',
9. Please note that decorative signs. sprinkler systems, trees, landscaping mounds, light poles
or other such amenities are not permitted In the right of way.
10. A 2' non-access easement Is neeclecl behind the right 01 way of Shelborne Road and 13111t
Street.
11. All cul-de-sacs must be less than 600' in length. Please verify that all cul-de-sacs meet the
minimum requirements.
12. Drainage and utility easements are needed behind all right of ways.
13. The right of way for the expanded areas near the Intersections can overlap with the right of
way for the Interior streets. A D&UE must be provided between the right of ways.
14. The following offslte Improvements wi/l be required of Boomerang Development In connection
with this project: 131. Street - 3' widening on the entire north side ot the project and the
. south side of the project within the limits of the property. She/bome Road - 3' widening on the
west side of She/bome Road plus resurladng the road with a 900 tonlmile wedge and level.

Following are CTRWD comments on the agenda items effecting our sanitary sewers or service area for the October 17
T AC meeting. Please feel free to copy and distribute this email or attach it to your meeting minutes.
CMC & CH Land Properties
To follow on our comments from last month's TAC meeting, the District has reviewed the plans and notes that the sewer
connection is proposed through core drilling a manhole. District specifications need to be added to the plans and special
permit conditions will apply for the core drill. Building permits should NOT be issued unless the District has issued its
connection permit.
Claybourne Estates
The District has reviewed the plans and has been in discussions with the developer about sanitary sewer service. An
oftsite sewer extension, the location of which is being negotiated with the Hamilton County Highway Department, will be
needed to serve this property. construction plans would still need to be reviewed by the District's consulting engineers.
Once that review is complete, the plans will be ready to be submitted by the District to IDEM for State approval along
with the District's plans for the offsite sewer extension.
Papay Subdivision (136th Street East of Towne Road)
The District has not received any plans for this proposed subdivision. Please advise the applicant to contact the District
and provide plans for our review.

have a few comments that I would like to have you mention if you would.
CMC & CH LAND PROPERTIES
These two projects each be addressed off of Meridian Corners Blvd. Assignment will come at a later Date.
CLAYBOURN ESTATES
All the names on the primary plat will have to be approved by the county;layout looks ok as far as street cutoffs go: Only
concern is name"Donavan Blvd";it needs to be cut off at 131st st, will need additional name for either North or South
entrance off of 131 st(to replace Donavan Blvd).
FECITT SUBDIVISION
Is this a totally seperate structure: if so it will get a different address then what is stated on the plans.
