The site is located at 14415 Cherry Tree Road. The site is zoned S-I/Residence. Docket No. 122-01 PP; Fecitt Subdivision Primary Plat The applicant seeks approval to plat a two lot residential subdivision on 4.41 acres. The site is located at 14415 Cherry Tree Road. The site is zoned S-I/Residence. The petitioner also seeks approval of the following Subdivision Waiver: 122-01a SW seo 6.2 Suitability of Land Filed by Adam. DeHart of Keeler-Webb Associates for Robert Fecitt. Note: This item paired with Item 1 h under Public Hearings. As the Commission may recall, the issue of compliance with sca 6.2.1 regarding the suitability ofland was discussed at the public hearing on November 2ih. It was determined that the applicant would be required to file for a Subdivision Waiver in order to have the subdivision plat approved. The Subdivision Committee discussed this issue at the December 4th committee meeting. The applicant would have been heard at the December 18th special meeting however they did not meet notice for the waiver request. The Department is in support of the waiver request. The Subdivision Committee forwarded the Primary Plat request back to the full Plan Commission with a favorable recommendation on the primary plat request as well as the forthcoming subdivision waiver regarding sca 6.2.1 at this meeting. The Department recommends that the Plan Commission approve the subdivision waiver request after the public hearing. Voting on the waiver will require a suspension of the rules. Pending a favorable vote on the subdivision waiver request the Department would recommend that the Plan Commission then approve the primary plat request. Note: The Department recommends that the Commission act on both the Waiver Request (under Public Hearings) and the Primary Plat (under Old Business) at the same time as opposed to waiting for the old business item as listed under agenda. This would only require a reordering of the agenda that could occur prior to bearing the waiver request. Additional Note: As a Primary Plat, written findings are required for action on this item.
