City of C Carmel Plan Commission COMMERCIAL COMMITTEE Tuesday, December 6, 2022 Meeting Minutes Location: Carmel City Hall Caucus Rooms,2nd Floor, 1 Civic Square,Carmel,IN 46032 Members Present: Alan Potasnik(Chair),Jeff Hill, Kevin Rider,Dubbie Buckler Staff Present: Rachel Keesling(Planning Administrator),Aliza Shalit(Sign Permit Specialist),Mike Hollibaugh (Director of DOCS) Legal Counsel: Ally Lynch-Mcgrath Time of Meeting: 6:00 PM The Commercial Committee met to review the following items: 1. TABLED TO JANUARY 3: PZ-2022-00034 ADLS Amend: Circle K Rebrand—College Plaza. The applicant seeks approval for signage and brand modifications/updating. The site is located at 10598 College Ave. It is zoned B-1Business and is located in the Homeplace Business Sub-Area Overlay District. Filed by Amy Leska of Corporate Identification Solutions on behalf of the owner. 2. TABLED TO JANUARY 3: PZ-2022-00036 ADLS Amend: Circle K Rebrand. The applicant seeks approval for signage and brand modifications/updating. The site is located at 545 S. Rangeline Road.It is zoned B-1Business and is located in the Rangeline Road Overlay District. Filed by Amy Leska of Corporate Identification Solutions on behalf of the owner. 3. Docket No.PZ-2022-00169 DP/ADLS: Chick-Fil-A—US 421. The applicant seeks site plan and design approval for a new restaurant with drive thru on 1.97 acres. The site is located at 9965 N.Michigan Road(previous location of Red Robin),part of West Carmel Marketplace,Block F. It is zoned B-2 and is within the US 421 Overlay District. Filed by Joe Vavrina of HR Green,on behalf of Chick-Fil-A. Petitioner: Joe Vavrina,HR Green; Justin Lurk, Chick-fil-A Petitioner covered 8 items Staff identified as comments and concerns: • Added pedestrian striping to the parking lot from the access over 99th to the building • Lighting—No lighting proposed within awnings o Lighting: Flagpole—flood light was originally mounted on the building shining up at the flag,that has been revised to be a ground flood light with a shield so the luminant side cannot be seen. This will shine straight up at the flag. o Lighting: Dumpster—There is a light in the dumpster enclosure, it is shielded,not visible when the gates are closed.Lights are on dusk until dawn for after hour pick-up or for team members clean-up after hours. The fixture is not visible outside of the trash enclosure itself. (Accounted for in the photometric plan) • Landscaping—It needs to be approved by the Urban Forester. We have a couple of rounds of comments with Daren,we just sent back our final set this morning with two comments he wanted us to address. I would expect that he will approve that, I would assume,tomorrow. • Building—the remaining changes were on the building itself. Canopy, building, and order pick-up:the canopy over the top of the columns wasn't in concert with the scale of the column rafts, so we thickened fascia around the canopies on both the order point and pick-up window. • We made sure that the column rack goes all the way to bottom of the canopy itself so that you don't see 1 Commercial Committee Meeting Minutes 12-6-22 the internal column. • Window—there was a question of whether this was a faux window or not, it is a real window. The floor plans just needed to be updated. Only two windows are faux(south facing wall, right most and second to right most). Everything else is real glass. • Signage on the west elevation—The spandrel behind sign was revised to meet the intent of the code, which is 70%of height x 85%of width within that panel. At the Plan Commission these elevations weren't updated, so we have made some revision to the elevations. We made the entrance a bit more prominent, some of the brick color was changed so it's all tan with red behind it, so that it sticks out when you pull into the site. The awnings are now fabric instead of metal avoiding a Variance. One sign on the East elevation was removed to reduce the number of Variances sought. Justin Lurk,Chick Fil A We installed bollards instead of wheel stops to avoid tripping hazards for our customers coming from the parking lot to the building still meeting the intent of the code. We will also have signs on bollards on handicap spaces. We rotated the handicap spaces over to the west side of the building. Department Report: Rachel Keesling All outstanding items listed in Department report have been addressed. We identified 11 items that needed to be either changed or variances sought. 5 of those Variance requests have been withdrawn. One was altered to have less signage requested as a Variance.The remaining Variances were heard and approved by the BZA last month. They have addressed the last 8 items that were brought up in the Staff reviews. Some of the changes were making entrances more defined(a requirement of the 421 Overlay),metal awnings were not permitted, so they changed them to fabric,etc. The changes they made were directly related to requirements of the Overlay. We are in support of this project being approved tonight. Committee Comments: None A Motion made by Jeff Hill and seconded by Dubbie Buckler to approve Docket No. PZ-2022-00169 DP/ADLS: Chick Fil-A—US 421 subject to addressing Staffs remaining concerns. Approved 4-0. 4. Docket No.PZ-2022-00190 ADLS Amend: Ozwell Fitness& Wellness Center The applicant seeks design approval for a building addition and remodel to the former Williams Comfort Air building for a new fitness facility. The site is located at 1077 3rd Avenue SW. It is zoned I-1/Industrial and is not located within any overlay district. Filed by Shawn Jones of CEC Inc. on behalf of the owner, Gemi Ozdemir. Petitioner: Dan Moriarty,Studio M,Architect. We are asking for your review of the fitness center.Along 3rd Avenue there is the old,battled Comfort Air building,with a two-story office that sits in front of it which is in really poor condition.Gemi went through this process previously with a much larger project,they ran into some issues with cost and meeting some of the requirements. We have scaled back and simplified the design of the building to something that was more manageable, so our intent has been to build a new addition in the front of the warehouse that is exactly within the foundation footprint of the old building to try to avoid disturbing anything beyond what we absolutely have to in the parking area. In that new building is where the locker rooms,care rooms(massage rooms,saunas, IV vitamins,etc.),there is a small childcare facility for patrons, spin studio,aerobics room,and the old warehouse will be where the workout equipment will be. A Dynadome will be built in the back.A greenhouse type 2 Commercial Committee Minutes 12-6-22 attachment that slides open and moves like the Lucas Oil roof.All the sections slide over,a completely free- standing building, it has its own structure, its own shop drawings,etc. We have a list of comments on Project Dox to which we have responded. We look forward to any questions or comments tonight. I also brought samples of materials for anyone who wants to see them. Department Report: Rachel Keesling There was a previous approval for the Dynadome portion on the back side of this building and then they came back for a separate ADLS Amendment to change the building and redo everything. That quickly got out of budget. That project was withdrawn.Now we have another proposal that suits the site much better, it is within the footprint of the existing building. Taking the second story component of the building that is there now will be a great addition to the streetscape along here. Showed views of what would be seen from 3rd Avenue.Described real windows that will allow light into the area and then the upper windows are also real. Dan was great at working with Staff at adding more windows into this facade. This part has no windows,but it is housing the HVAC equipment.As you round to the south is the Sign that needs variance. The Dynadome is in the back. There is no planned connection to the Monon right now and they will have to come back and work with engineering on the connection to make sure that it was going to be in the right location and safe, it will have to go over the ditch,etc. They meet all the requirements except with the sign that needs a variance. We don't have any issues with this project, it is much better than the previous iterations.One thing we asked for was the possible inclusion of long- term bicycle parking.Not required,but if you have room for it, it would be great. Recommended,not required. We have to keep working through Project Dox review cycles. We recommend approval tonight.ADLS Amendment only. It only needs Committee approval. Committee Comments: Alan: Can you point out the dumpster for the facility?It would be on the north side.You mentioned that there will be giving some kind of IV's. Is there a hazardous waste dumping area?Dan: I imagine they will take care of the sharps in those medical disposal containers.Alan: I want to make sure it won't be dumped out in the dumpster.Dan: It is a registered nurse that runs that side of the services with an office in the building. I would assume her training would allow for the proper disposal of hazardous materials.Alan: Cannot assume anything. Just commit to that.Rachel:we can email and find out what the plan is and get it on the record.Alan: I just don't want to have something like that out on the street.
