Dear Jim:
The Estate of Ellen H. Gould has executed a Petition for Annexation ("Petition")
and will be filing the Petition with the Carmel Board of Puulic Works and the Office of
the Clt rk/Treasurer. The Petition requests the adoption of an Ordinance by t, Carmel
City Council anne-Sing to the City of Carmel, Indiana the 67.4 acre parcel of real estate
local cad West of Keystone Avenue, South of East 106th Street and North of East 99th Street
("Rea. Estate").
Please find enclosed for your review, a drawing prepared by Schneider Engineering
Corporation under date of November 23, 1992, and entitled Annexation - Millbrook
(Drawing). The Drawing identifies the area location and contains the legal description
of the Real Estate.
The Standard Operating Procedure }r Annt. •. tions to the City of Carmel requires
your review and consideration of the impact of the annexation on Sewer and Water
distribution and availability.
It is anticipated that the Real Estate will be purchased by Estridge Development
Company, Inc. and C.P. Morgan Co., Inc. and developed as a single family residential
subdivision to be known as Millbrook pursuant to a Primary Plat approved by the Carmel
Plan Commission in October of this year. It is my understanding that sewer service will
be provided by the Clay Township Regional Water District.
I would appreciate your forwarding to me a letter confirming 1. ur review of the
annexation request and the impact, if any, on the services administered by your office.
If additional information is required or should you desire to meet with me, please call
me at 844-0106. Your immediate response is appreciated since a written response from
your office is required prior to filing with the Clerk/Treasurer.

Carmel Clay Plan Commission and the
Department of Community Development
King of Glory Lutheran Church would like to take this opportunity to express our
continued support for the Miilbrook subdivision presently being considered by
the Plan Commission.
We have had numerous discussions with the developer of this project and have
worked with them to discuss changes in their project which, we believe, will
provide a better project for the neighboring property owners as well as providing
future benefits for our congregations growing need to provide services and
facilities. The Parish Council of King of Glory has approved the transfer of land
in exchange for other considerations that will allow a drainage pond to be
established on approximately two acres of our present property. The Church will
be allowed both access and drainage easements to this area to accommodate future
building plans. In addition, the Church will work with the Developer and
Hamilton County officials to consider granting right-of-way along 106th Street to
allow the construction of an additional lane on the south side of 106th.
We support the revised plans for Millbrook as shown to the Plan Commission
Committee on October 6, 1992, and urge your favorable consideration of this
project.

Dear Plan Commission:
We, at Wolfson Young Corporation, have reviewed the plans
for the Police and Fireman' s Insurance Association building
on property adjacent to ours and are in agreement with the
design of the project . As parties to the original develop-
ment plan, we are in agreement in seeking that this plan be
set aside . We feel that the restrictions that incumber the
land can no longer be honored by the present owners due to
the current property lines . In the future, when it becomes
feasible to develop our parcel of land, we in turn intend to
design a project compatible with the Police and Fireman' s
Insurance Association building which is very compatible with
the existing commercial buildings and residential structures
in the neighborhood.

an addition to Section 4.1 of Article IV of the Declaration of Covenants, Conditions, and
Restrictions, and a new Article XV. The purpose of Article XV is to restrict the sub part
of Millbrook commonly referred to as The Grove (Estate Area).
These revisions will be made a part of the Declaration of Covenants, Conditions and
Restrictions of Millbrook recorded with the Office of the Recorder of Hamilton County,
Indiana, and are in response to certain comments received from adjacent property owners.

Section 4.1. Association's Rights and Obligations.
A. The Association shall also have the obligation to manage, repair, and maintain
the Restricted Common Area. THe obligations of the Association shall include the duty to
maintain and replace all plant material installed by the Declarant in the Restricted
Common Area pursuant to a landscape plan filed by the Declarant with the Department of
Community Development, Carmel, Indiana. The replacement of dead or diseased plant
material shall be made with plant material of a like kind, variety and size until December
31, 1997. Thereafter the replacement of the plant material shall be made with a like kind
and variety and subject to the following size requirements:
December 31, 1997 through December 31, 2002 - 80% of existing size
December 31, 2002 through December 31, 2007 - 60% of existing size
December 31, 2007 through December 31, 2012 - 50% of existing size
December 31, 2012 and thereafter - 40% of existing size
ARTICLE XV
The part of the Real Estate more particularly described on Exhibit "B" hereto shall
not be subdivided into more than nine (9) lots.

north section of Millbrook. The plans reflect changes that were
suggested by the different groups that spoke in favor of the
Millbrook project at the public hearing on September 15. These
groups included homeowners associations of Jordan Woods, Chesterton
and Holaday Hills & Dales as well as the King of Glory Church.
We submit these plans not as a formal filing of an amended plat but
rather to receive your thoughts as well as the Subdivision
Committee thoughts on the proposed modifications. If they are
favorable then a formal amended plat will be submitted.

Dear Mr. Nelson:
Pursuant to the Carmel Plan Commission meeting on 15 September 1992 I have
additional analyses on the intersection of SR 431 (Keystone Avenue) at 106th
Street. The purpose of this work was to determine the existing Level-of-Service
(LOS) for this intersection during the AM and PM peak hours.
I obtained traffic counts recorded for the City during April 1992 and I used
the existing traffic signal controller timing settings. I did not try to optimize
these settings because this intersection is one of many in a traffic signal system
along Keystone Avenue.
The results of these analyses show that the intersection breaks down or is
oversaturated during these two periods of the day.
I also added in the anticipated Millbrook development traffic to determine the
impact it will have on the intersection during these time periods. The results
were the same. The individual approaches to the intersections maintained the
same LOS and the intersection was oversaturated.
It is important to note that the most crucial factors which cause the intersection
to breakdown are the north and south through volumes. With the exception
of the north and south through vehicles and the westbound to southbound, AM
peak hour turning vehicles, all other movements operate at a LOS of B, C or
D. The majority are at LOS C.
I have included copies of the summary reports for your use and information
and I will be available for additional support if requested.

King of Glory Lutheran Church is located at the southwest corner of 106th Street
and Keystone and lies adjacent to the proposed Millbrock Pond development on
cur west and south property line. in the past few months, our Church has
hosted two meetings between the developers cf this project and adjacent property
owners. In addition, representatives of our congregation have met with Mr. Mark
Boyce of C. P. Morgan Company to discuss aspects of this project. We appreciate
the efforts both C.P. Morgan and The Estridge Company have made to meet with
us and other neighboring property owners to discuss our concerns with the
proposed development. We believe several suggested changes the Church and
others have proposed will enhance this project and be of benefit to the
Carmel/Clay community.
On September 14, 1992, the Parish Council of King of Glory Lutheran Church met
and unanimously voted to support the proposed project with certain modifications
and agreed to work with the Developer in working out legal arrangements
regarding the location of the detention pond.
1) We recommend the Plan Commission grant the following:
A) A variance to eliminate one of the proposed two entrances onto 106th
Street.
b) Variance requests for the reduction of street width and to lengthen
cul-de-sac requirements.
These changes would allow a redesign of the property and provide greater
preservation of the wooded area and allow the lots to more closely
correspond to adjoining properties.
2) In addition, The Parish Council has proposed and endorsed allowing the
detention pond to be relocated in whole or in part on King of Glory
property, subject to legal agreement on platting reqirements, maintenence
of the facility and drainage and access easements. This agreement will
provide the Developer, the neighborhood and our Church with the
following advantages:

western property line will be constructed by the Developer.
5) Preservation of existing tree and greenbelt along our west
property line.
6 Inclusion of small area of Church property that is in the
Floodway to be tart cf the area reforested and placed under
the auspices cf the Department of Natural Resources.
We would respectfully request the Plan Commission grant the variances and direct
the Developers to make these suggested modifications in the plans to provide the
Developer, the neighboring properties and the community with the best possible
project.
Once again, we thank the Developers for their cooperation and concern for
working with us and we thank the Plan Commission for this opportunity to present
our suggestions.

The Plan Commission considered subject docket at their July 21, 1992 ,
meeting and passed it on to the Subdivision Committee, who met on
August 6 . It was then tabled until their October meeting, to allow
the Estridge Group time to get approval to close the street connection
to North Augusta and redraw one cul-de-sac (on the agenda of the
September 15 Plan Commission meeting) .
Now by accident we find it to be on the Agenda for the Plat Committee
meeting on September 1. Somehow this does not seem like the normal
"chain of events" .
This docket includes a request to amend the Commitments dated January
16 , 1990 . Unless we were completely deaf, we heard no mention of any
"commitment" at the original July 21 meeting. It was mentioned
several times, however, at the Subdivision Commission meeting on
August 6 . Another interesting fact is that the only persons attending/
speaking at the July 21 and August 6 meetings were residents of either
North Augusta or Ashbrooke. It would certainly seem that if the
proper notices had been sent to those residents to whom the original
Commitment was made, they would have been represented at the meeting.
In talking with some of them, we find no such notices were received.
When that Commitment was made, it was promised in good faith not to
allow "cluster housing" and now less than 3 years later, with no
notice to those involved in the original commitment, it appears this
amendment is passing easily through the Commissions. It would seem

that the "first order of business" for the Plan Commission would be to
vote on whether to amend the Commitment. If they vote "no" , the rest
of the application/discussion would be meaningless because the whole
project depends on receiving the cluster-option approval.
An interesting point, which makes us wonder who enforces a document
like the "Cluster Housing Variance" , is that they made no provision
for the 3-car on-site parking requirement for a 4-bedroom home and
even admitted that they had completed three projects without adhering
to this requirement.
We were also given contradicting statements regarding the 20' buffer.
We were told that the 20' buffer was part of the lot, and in reading
the Variance regulations, it clearly states "The front, rear or side
yard abutting a Green Belt Buffer shall be measured from the interior
boundry of the Green Belt Buffer" . If an Ashbrooke-adjoining lot
happens to be one of their 8438 square foot lots, they use a 22'
set-back, build a 4-bedroom 2-story house, and the backyard includes
the 20' buffer, it sure wouldn't leave much rear yard ! !
We're concerned with who takes care of that buffer? Who replaces any
trees that die? We certainly don't want a weed-covered "hill" full of
dead trees like we see on some neglected subdivisions in our area. If
this cluster housing option were to pass, then the Ashbrooke residents
would certainly expect a "respectable" buffer area.
In our opinion, the Cluster Housing was originally planned to save on
expenses and not increase the gross density of S-2 zoning. Estridge
offers the "favor" of leaving the creek and woods in return for the

cluster housing option. George Sweet planned a retention pond approxi-

does Estridge need the smaller lots? Isn't this simply a request for

are currently trying to resolve the remaining issues with the Surveyor's Office.
3. At this time, the developers are considering making the storm sewers regulated.

5. The rear yard building setback along lots 24-31 is 20 feet and has been shown on the
primary plat.

15. A. It is my understanding that Carole Boleman has completed and furnished you with
copies of landscape plan. Please advise me as to the contrary. On the landscape
plan treatment of the sign has been shown. Dimensions of the sign shall be
provided to you when they become available.
B. Landscaping for the off-street parking areas have been shown on the landscape
plans.
C. The developers have attempted to provide a layout that is very sensitive to the
existing woods that are present on the property. This is the main reason that they
have incorporated an area of large lots in the southwest portion of the property.
There are hundreds of mature trees located in this area and the developers are
attempting to preserve as many as possible.
D. The developers shall attempt to use trees that need to be removed due to
construction. This effort shall have possible benefits to the landscaping of the
project. It would provide larger, more mature materials than if brought in offsite
and the relocated materials would remain similar to what already exists onsite.
The tree relocation shall be coordinated with DOCD.
E. The developers are currently working with Clay Township Regional Waste
District to determine what the District will view as acceptable landscaping within
their 40' easement along Keystone Avenue. The developers also feel that the
landscape plan reflects adequate green belt buffer along Holaday Hills and Dales.

Top Luminaire. On their homes in the cluster area, they plan to use lights mounted on

providing 2 onsite parking spaces in the driveway for each lot. Also, they are providing
one-half space per lot of offsite parking totalling 44 spaces as per Section 7.1.8 of the
cluster ordinance.

I have discussed this project with the County Surveyor and he wished for me to make
'^_is feelings known to you. He has expressed reservations about any lakes located within
- e 100 year flood level being used for detention of runoff. The concern rests in the
feet that at a certain point during a 100 year flood, the ponds, which are required to
retain up to the 100 year storm, would be inundated. At that point, they would not be
varying as retention ponds and any runoff from the subdivision would not be retained but
would contribute to the flooding along Carmel Creek.
Another source of concern deals with the amount of fill in the floodplain. As we
rave previously discussed, the Surveyor's main objective is to protect landowners along
tee creek from additional flooding. He expressed that lost capacity for storage due to
llinc in the floodplain should be minimized wherever possible. Compensated storage
~as been discussed on other projects. The reasoning is that when storage capacity is
lost, the water has to go somewhere else. It is recognized, however, that any fill will
require approval from DNR.

Section 2 - Lots 24 to 111
1) Indicate MPH design speed.
2) The 40 foot right of way for the interior streets must be
increased to 50 feet right of way. The 40 foot right of
way does not meet county street standards. All roads
must have an adjacent D.U. & S.E. -- including common
areas.
3) We are requesting a corner cut be shown for the right of
way of interior streets. A 20 foot radius off each lot
at intersecting streets.
4) Provide a 10 foot wide utility easement north of the 40
foot right of way of 99th Street from the proposed
entrance of Millbrook Parkway to Keystone Avenue.
5) Millbrook PKWY entrance needs more details and is subject
to further review.
6) Indicate length of tapers and width of decel lane for
Millbrook Parkway onto 99th Street.
7) Eyebrow on Mill Pond Circle shall be private, not a
county maintained road and shall be in an easement -- not
right of way.
8) Eliminate existing lift station access drive onto 99th
Street and eliminate proposed emergency access road.
9) Remove 40' street cross section on sheet S-4.
Review of Section 3 - Lots 112 - 120
1) Stonebrook Lane onto 99th Street -- shall be directly
aligned with Haverstick Road or connect into Millbrook
Pkwy.
2) The proposed 18 foot width of Stonebrook Lane does not
meet county street standards. It shall be redesigned to
meet the standards (as per County Ordinance 19/5/89/1) .
3) Provide drainage information.

On all streets, indicate curb radius. Driveway permits will
be required with bonds for all entrances. Plaris must be approved
by the County Highway Department prior to any construction. Road
improvement may be required on 99th Street from the west property
line to Keystone Avenue consisting of a wedge and level, 2" of
binder and 1" of surface to accommodate the increased traffic load.

1. It is recommended that the drainage facilities for this site become regulated
drain.
2. Please forward a copy of the drainage calculations to our office.
3. For lake outfalls we request that some sort of debrislanimal guard be installed.

5. How much offsite flows onto this site?
6. Are DNR, IDEM or Corps permits required?
7. What are the building pad elevations?
8. Please provide a cross-section of the relocated ditch on the construction plans.

2. Provide a good drainage outlet for Holiday-Hills and Dales

S. Would prefer less filling of the flood fringe south of Carmel
Creek_ Recommend the proposed pond be at or below existing grade.
4. The existing pond needs to be rebuilt.
5. Cool Creek should be cleared and snagged.
6. Recommend the culdesac be removed at the end of Mill Creek Drive.
This reduces filling in the flood fringe.

Dear Mr. Ernst:
Carmel Clay Schools appreciates notification of the Millbrook
primary plat application . The school corporation has two areas of
concern . In the interest of safety, the installation of sidewalks
should be mandated within the subdivision . In addition , any
cul —de—sacs should be a minimum of 93 ft. to accommodate the
turning radius of an 84 passenger school bus .
Information regarding the development of new subdivisions is
extremely beneficial as the school corporation continually reviews
long range plans to accommodate the educational needs of this
growing community. Carmel Clay Schools fully intends to provide a
quality educational program for the patrons of the Millbrook
Subdivision .
