My name is Sue Kelpls. We live at 14341 North Gray Road, exactly 2 houses south of the 11
acres to be re-zoned for high-density housing, known as Hearthview Residential, LLC.
We would like the present zoning to remain unchanged.
The 11 acres is not adequate for the size of this project, which is expected to accommodate 88

This arrangement would heighten the traffic congestion at the intersection of 146th &. Gray
Road. In the current condition, we can barely leave our driveway during moming and evening
rush hour. The traffic problem alone woulcl be unimaginable.
We were told that the wooded area at this location was a wildlife reserve. We have between 3
and 5 deer wandering on our property and In the immediate area daily. Many birds and other
wildlife also consider this area their home. Where will these animals be forced to live if the
wooded area Is destroyed?
An immediate concem is that of the planning for water runoff I drainage systems and how
they will effect our water wells. We have a well and a drainage ditch that runs on the north
side of our property.
We are concerned of flooding in the drainage ditch.
W, are also concerned with the lake area outlined on the plan being on the same water level
asoor well -- concerned our well will run dry. [our well Is very shallow).
We have heard of this happening on other similar projects where the addition of water
features effects local wells.
Therefore, we are apposed to re-zoning the property at the comer of 146t11 a. Gray Road to be
used in the manor that Hearthview Residential, LLC has planned.

attend future meetings with the zoning board.

My wife and I live just a few hundred feet south of 146th Street and Gray Road at 14337
N. Gray Road. We have been at this location for nearly 30 years. We have seen many
changes in our neighborhood during this time; some good and some not so good. Most of
our close neighbors have also been at the same location this long or longer. We are here
for the long run.
We all realize that progress happens. No complaints for the mostjart, but the possibility
of condominiums going in on the southeast corner of Gray & 146 Street is very
disturbing and distressing to all of us. Nice single family homes would be okay, but
please don't let the zoning be changed to allow condos to be built on this alfeady very
busy comer. We all will be very grateful if these proceedings are stopped.

The meeting began with opening remarks by President Clancy Fishero, followed by procedural rules set by VP
Cesare Turrin.Bob Christianson then led the discussion to draft a statement that the Woodfield Homeowners
Association could present to the Cannel Clay Zoning Board about the proposed development and subsequent
rezoning of the parcel of land on the northeast comer of Gray Rd. and 146lh St This parcel of land adjoins the
property of two residents who live along Sue Dr.
During the discussion, points brought to the table included:
. Changing from S-I to R-4 zoning would enable any developer to build lesser quality apartments if
desired, should the current project fail.
. We must consider that the north part of Woodfield borders undeveloped land and this project
could be precedent setting.
. If we merely oppose the rezoning and the board passes the change anyway, assuming the project
goes forward, will we have lost our ability to affect changes to the development to make it more
acceptable?
The first two points were agreed upon, the last not. A significant majority of the group decided to offer a single
message to the rezoning board, that being opposition to rezoning of the land to R-4, requesting it to remain 8-1.
After discussion, a significant majority of those present agreed upon the following first draft statement points:
o We'd all prefer no development, but our preference would be for the development to conform to current
zoning of S-l, (single family residence, large lot, rwal cbamcter) resulting in homes of equal or greater
value than those of Woodfield
o We object to any commercial or public development
o Our concerns with m!Y development are:
1) Land use must be consistent with intended use (as outlined by City of Carmel).
2) Our property values should not suffer.
3) The esthetics of the development should remain high.
4) There should be little impact of additional traffic (congestion).
5) Public Safety concerns such as fire and police department accessibility should be taken into
consideration; sidewalks needed.

6) We must act with an eye to the rest of the undeveloped lands bordering Woodfield and use care in
setting precedents.
The following points of action were also agreed upon:
I. WHA opposes the rezoning and proposed project for the comer of Gray Rd and 146th St. and will accept
only 8-1 status on the land (S-1 is classified as single-family residential, large lots, mral character) We
will address any additional developments individually.
2. Block Captains will be asked to deliver minutes of this meeting to all residents on or around November 7
18. They will then follow up with petition papers for those who wish to sign in support of the land
remaining S-1.. These will need to be done and returned to Mary Christianson by Nov. 14.
3. Tom Jones will contact the individual residents who live along Gray Rd., north of Woodfield and south of
146th St, and Oak Brook residents and poll their opinions regarding this project. This should be done by
November 9.
4 . We will delay hiring an attorney until after the lit council meeting concerning this property.
5. Bob Christianson will contact Councilman John Koven and seek his advice about the necessity of hiring an
attorney. This will be done by Nov. 9
6. A statement of our position was outlined in this meeting. It will be drafted for the WHA board approval
and sent to the Zoning Board and City council by November 15.

RE: Review ofPUD and Landscape Plan for Hearthview, LLC, - 146th and Grey Road
November 5, 2001
Dear Paul:
My review of the Rezone Application for Hearthview's PUD and Landscape Plan is as
follows:
PUD
1. The landscaping requirements for in Section 5 of the PUD Ordinance are not
adequate. Sizes and planting requirements for all planting areas need to be
established in the PUD. These include dimensions, plus number and type of plants,
for all greenbelts, planting strips, parking areas, buffering areas, landscape easements,
and preservation areas. Perimeter buffer requirements shall be equal to or greater
than those found in Appendix A of the Carmel/Clay Land Use Regulations.
2. In Section 5.3 Landscaping Standards: Shade trees adjacent to roadways or Right-Of -
Ways and in perimeter buffering areas need to be at least 2" in diameter six (6) inches
above the root flare. Evergreen trees in these same areas need to be at least eight (8)
feet in height. In other areas, the plant material can be of the size proposed.
3. Tree preservation requirements and areas need to be defined within the PUD
Ordinance and on the Site Development and Landscaping Plans. This includes areas
and type of vegetation to be preserved. The methods of preservation need to be
detailed in the PUD and on the Landscaping Plan.
4. An evaluation of the site's existing vegetation by an arborist, landscape architect,
horticulturist, or other qualified professional needs to be submitted as a written report
and site plan for review.
Landscape Plan
1. There are no planting details; these must be included with landscaping plans.

2. There are no planting notes; these must be included with landscaping plans. These
notes include specifications for plant materials, and maintenance standards.
3. Tree preservation areas, practices, and method details must be included on the plan.
If tree preservation areas are designed as easements for common areas or other use,
those restrictive uses must be defined as part of covenants and on the plat plan.
4. Foundation planting areas must be included for building structures. Details for these
plantings must be included on or with the landscape plan.
5. Existing topography should be maintained as much as possible. The storm water
detention areas need to be landscaped, as well as other common areas, unless
designed for a specific function that excludes trees and shrubs.

RE: 146tb Street and Gray Road PUD
Dear Paul:
This letter is in response to the rezone application you filed for the above referenced PUD. The following comments
need to be addressed and/or plans/applications updated accordingly:
1. Defme a private Recreational Development or Facility. We would not support this as a stand-alone
use. There is no restriction in the Ordinance. I can only assume that it would be a facility for the
exclusive use of the residents of the development.
2. Pictures/exhibits of the type of proposed buildings would be helpful.
We do not want to see rows of garage doors facing 146tb Street or Gray Road. You may want to
commit to a design that had the front door facing the streets and the garage accessing from the rear.
3. Be specific in the ordinance about building setbacks.
4. Landscaping (address Scott Brewers letter dated November 6tb)
Are any shrubs proposed for the entire site? None are shown on the plan. This is not acceptable. It
appears that there are discrepancies between the landscaping language and the proposed plan. (no
dimension to greenbelts, no detail of screening areas, etc.
5. The buildings should be pushed up closer to the street with access at the rear, i.e. 146tb Street,
buildings, access drive.
6. No sign plan has been submitted for review.
7. Revise ordinance language whereby the Plan Commission would be approving a preliminary DP with
the rezone not a landscape plan. Final DP could go to the Department for administrative review. We
will not support this request as written in regard to this matter. The plan commission must see at least a
preliminary c1evelopment plan. What is the rational for calling it site plan approval?
8. Provide a general layout and density calculation for the property as zoned today. We want to convey to
the Plan Commission what could be constructed on the property under the existing zoning. The
proposed number of units will exceed the maximum intensity of the uses permitted for the property
today. How do you intend to address or offset the additional impact on the adjacent roadway network?

RE: Review ofPUD and Landscape Plan for Hearthview, LLC, - 146th and Grey Road
Dear Paul:
My review of the Rezone Application for Hearthview's PUD and Landscape Plan is as
follows:
PUD
1. The landscaping requirements for in Section 5 of the PUD Ordinance are not
adequate. Sizes and planting requirements for all planting areas need to be
established in the PUD. These include dimensions, plus number and type of plants,
for all greenbelts, planting strips, parking areas, buffering areas, landscape easements,
and preservation areas. Perimeter buffer requirements shall be equal to or greater
than those found in Appendix A of the CarmeVClay Land Use Regulations.
2. In Section 5.3 Landscaping Standards: Shade trees adjacent to roadways or Right-Of-
Ways and in perimeter buffering areas need to be at least 2" in diameter six (6) inches
above the root flare. Evergreen trees in these same areas need to be at least eight (8)
feet in height. In other areas, the plant material can be of the size proposed.
3. Tree preservation requirements and areas need to be defined within the PUD
Ordinance and on the Site Development and Landscaping Plans. This includes areas
and type of vegetation to be preserved. The methods of preservation need to be
detailed in the PUD and on the Landscaping Plan.
4. An evaluation of the site's existing vegetation by an arborist, landscape architect,
horticulturist, or other qualified professional needs to be submitted as a written report
and site plan for review.
Landscape Plan
1. There are no planting details; these must be included with landscaping plans.

2. There are no planting notes; these must be included with landscaping plans. These
notes include specifications for plant materials, and maintenance standards.
3. Tree preservation areas, practices, and method details must be included on the plan.
If tree preservation areas are designed as easements for common areas or other use,
those restrictive uses must be defined as part of covenants and on the plat plan.
4. Foundation planting areas must be included for building structures. Details for these
plantings must be included on or with the landscape plan.
5. Existing topography should be maintained as much as possible. The storm water
detention areas need to be landscaped, as well as other common areas, unless
designed for a specific function that excludes trees and shrubs.

GENERAL INFORMATION
1. The project site is located outside current City of Cannel Corporate Limits. Comments listed below
are contingent upon tlle site being annexed.
2. Jurisdictions:
. Street and Right of Way (l46th Street and Gray Road) - CurrentIy Hamilton County

I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines
for your use. Please use tile Engineering Department deadlines for submissions to tile Board.
Any submission to the Board requires prior final approval by the Carmel Clay Plan Commission
and/or the Board of Zoning Appeals and completion of review by the Technical Advisory
Committee. AU written requests to be place on the Board's agenda must include the appropriate
Docket Numbers and the date (or dates) of approval by the Plan Commission amVor BZA.
4. Water and Sanitary Sewer Availability (acreage) and Connection Fees:
. Availability-(acreage) Fees are based upon total acreage (legal description) @ $1,010.00 per acre
for water and $1,365.00 per acre for sanitary sewer.
. Connection Fees will be dependent upon the total nwnber of condominiums in tile development @
1.0 EDU per single family residence. Connection Fees are $1,310.00 per EDU for water and
$795.00 per EDU for sanitary sewer.
5. Carmel Utilities will provide a separate review of this project for water and sanitary sewer issues.
PROJECT COMMENTS
6. This project is located witItin the City of Carmel service area for water and sanitary sewer. Therefore,
by ordinance, tItis property will require annexation. AltIlOUgh tile adjacent properties are not identified
on tile drawing, it appears tIlat at least a portion of tIle property could be contiguous to a boundary of
tile Woodfield Subdivision. If contiguity is not possible at tItis time, a written and recorded letter of
commitment to annex or agreement to enter into a Non Remonstrance Agreement with the City of
Carmel will be required. The annexation should include tile entire right of way of Gray Road. It is
assumed that tile annexation would be to the south right of way line of 146th Street, since Hamilton

County has jurisdiction over 146th Street via an lnter]oca] Agreement with Cannel, Westfield and
Noblesville.
7. The Gray Road right of way, contiguous to the project would be dedicated to the City of Carmel'. Per
our Thoroughfare Plan, Gray Road would require dedication of a 45-foot half right of way.
8. Future submissions should include a title page with area and location maps, street names, right of way
and easements labeled and dimensioned, floodplain elevation information, drainage calculations,
traffic impacts, etc. It should also be noted that a DNR permit will be required to fill in the floodplain
and detention will not be allowed within the floodplain.
9. This office will withhold further comments until such time that detailed construction drawings are
submitted for the project.

This letter serves to acknowledge receipt of a transmittal containing the request for the rezone of the
above.mentloned parcel. After reviewing the submitted Information, the Highway Department has the
following comments:
1. Through an Interfoqll Agreement. the Hamilton County Highway Department is responsible for the
maintenance of 146'" Street.
2. In accordance wtt~ the Hamilton County Thoroughfare Plan. additional right of way is required at the
Intersection of 146 Street and Gray Road. On Gray Road, the right of way from the centerline of 14611!
Street to a point 500' to !J,e south is a 60' half. From that point to the southern property line the right of
way Is e 45 half. On 146 Street, the right of wey from the oentertlne Of Gray Road to a point 500' to the
east is an 85' half. From that point to the eastern property line the right ~ way Is a 75' half. All right of ~y
descriptions and dedications should be from the new ce~rllne of 146 Street and Gray Road.
3. A triangular comer cut Is needed at the Intersection of 146 Street and Gray Road; the cut should consist
of two 50' legs.
4. Aceelldecellanes will be required at both entrances; the lanes Should be 12'In width. The decellane shall
consist of a 100' taper and a 1 SO' lane. The aCGellane should consist of a 100' taper.
5. The entrance on 14611I Street shOuld be relocated to the east to align with the tRorthlSOUth Interior street.
6. A 150' minimum offset must exist between the Interior Intersections and 146 Street/Gray Road at the
entrances.
7. Left turn lanes will be required at both entrances. The median on 146lh Street win need to be reconstructed
to accommodate the left turn lane. On Gray Roed, additional right of way will need to be acquired and the
southbound lane widened to accommodate the addltional/anes.
8. All existing storm sewer structures will need to be relocated to accommodate the Improvements.
9. The existing structure under Gray R~dt south of the proposed entrance will need to be replaced.
10. The curb radii at the entrance on 146 Street must be a minimum of 40', On Gray Road the minimum
radius is 35'.
11. Will stub streets be provided to all contiguous property?
12. Is the street wtthln the development to be privately maintained?
13. Permits for both entrances and all utility worle within the right of way will be required. Please contact Mr.
Dave Lucas. for the necessary forms and Information.
14. Please be aware that further comments may be necessary at a later time.
