5h. Docket No. 131-01 Z; North Augusta, Section 1, Lots 8-11, 11a, 12-13, Rezone
The applicant seeks approval of a Rezone from the S-I/Residence and B-2/Business
Districts to the B-2/Business District. The site is located northeast of the intersection of
West 96th Street and North Michigan Road. The site is zoned S-I/Residence and B-
2/Business within the US 421/Michigan Road Overlay Zone. .
Filed by the Department of Community Services for the City of Carmel.
The Department of Community Services has recently gone through a months-long
process of verifying all zoning within the City of Cannel and Clay Township in order to
produce an electronic version of the Zoning Map. During this process a significant
mapping error was discovered in the North Augusta Subdivision. In an effort to remedy this
error, the City is undertaking a Rezone to change the zoning on o' roperty from a split-
zoned S-I/Residence & B-2/Business to a straight B-2/Business zone.

Attached are several exhibits illustrating the situation:
Exhibit A illustrates the lots that are the subject of this petition.
Exhibit B illustrates the extent of the B- 2/Business district in this area as it existed in 1961,
when zoning was first established in the area. (Scale 1" = 200')
Exhibit C illustrates the mapping error that occurred when the large format mylar Zoning
Map was adopted in 1976. (Scale 1" = 200')
Exhibit D is a reference map created by the Department in the late 1960s showing the
boundaries on the B-2/Business district overlaid on a plat of North Augusta, Section 1.

Exhibit E illustrates the present zoning situation in the North Augusta Subdivision. (Scale

By adopting this rezone, the City will be removing the difficulties created by the existing
split zoning on these lots.
If there are no concerns raised by the public or comments from Plan Commission members
that may be resolved in committee, the Department recommends that the Plan Commission
suspend its Rules and forward this rezone request to the City Council with a favorable
recommendation.
