TO CHANGE THE OFFICIAL ZONING MAP

CITY OF CARMEL AND CLAY TOWNSHIP
PURSUANT TO
INDIANA CODE 36-7-4-605

Dear Members:
The Carmel/Clay Plan Commission offers you the following report on an Ordinance Amendment
to change the official Zoning Map for the City of Carmel and Clay Township as follows:
The designation of certain real property from the S-I/Residence and the B-2/Business
District Classifications within the US 421/Michigan Road Overlay Zone to the B-
2IBusiness District Classification within the US 421/Michigan Road Overlay Zone, more
particularly described as follows:
Certain real estate situated in Hamilton County, Indiana, known as Lots 8, 9, 10, 11, lla,
12, and 13 within the North Augusta Subdivision located northeast of the intersection of
West 96th Street and North Michigan Road. .
The Carmel/Clay Plan Commission's recommendation on the Ordinance Amendment is
FAVORABLE.
At its regularly scheduled meeting held November 27,2001, the Carmel/Clay Plan Commission
approved the Ordinance Amendment by a vote of 13 in favor, none opposed, none abstaining.

SECTION 1, LOTS 8-13
ORDINANCE No. Z-367-01
Notice is hereby given to the taxpayers ofthe City of Cannel, Hamilton County, Indiana,
that the proper legal officers of the City of Cannel will meet at their regular meeting
place, Cannel City Hall, One Civic Square, Council Chambers, 7:00 PM on the 1 ih day
of December, 2001 to consider the following:
Ordinance Amendment petition for the City of Cannel to amend the Cannel/Clay Zoning
Ordinance to Rezone certain real estate located in Hamilton County, Indiana, known as
Lots 8, 9, 10, 11, 11a, 12, and 13 within the North Augusta Subdivision located
northeast of the intersection of West 96th Street and North Michigan Road.
Taxpayers appearing at the meeting shall have the right to be heard.

AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
REZONING DISTRICT CLASSIFICATION
Rezoning Lots 8, 9, 10, 11, 11 a, 12, and 13 within the North Augusta Subdivision from the S-
l/Residence and B-2/Business District Classifications within the US 4211Michigan Road Overlay
Zone to the B-2/Business District Classification within the US 421/Michigan Road Overlay Zone
WHEREAS, the Carmel/Clay Plan Commission has favorably recommended the rezoning
of the real property, the legal description of which is attached hereto as Exhibit A.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana,
as follows:
Section I:
That the Official Zoning Map accompanying and made part of the Zoning Ordinance is hereby
changed to designate the real property from the S-l/Residence and the B-2/Business District
Classifications within the US 421/Michigan Road Overlay Zone to the B-2/Business District
Classification within the US 421/Michigan Road Overlay Zone.
Section H: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed.
Section HI: This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.
PASSED by the Common Council of the City of Carmel, Indiana this _ day of
2001, by a vote of ayes and nays.
