Dear Council Members:
The Department of Community Services has recently gone through a months-long process
of verifYing all zoning within the City of Carmel and Clay Township in order to produce an
electronic version of the Zoning Map. During this process a significant mapping error was
discovered in the North Augusta Subdivision. In an effort to remedy the effects of this error, the
Department has initiated this Rezone to change the zoning on the subject properties :from a split-
zoned S-I/Residence & B-2/Business within the US 421/Michigan Road Overlay Zone to a straight
B-2/Business zone within the US 421/Michigan Road Overlay Zone.
Attached are several exhibits illustrating the situation:
Exhibit A illustrates the properties that are the subject of this Rezone.
Exhibit B illustrates the extent of the B-2/Business district in this area as it existed in 1961,
when zoning was first established in the area.
Exhibit C illustrates the mapping error that occurred when the large format mylar Zoning
Map was adopted in 1976. The error shows the B-2 District approximately 225 feet farther
east than it actually is. (Scale 1" = 200')
Exhibit D is a reference map created by the Department in the late 1960s showing the
correct boundaries of the B-2/Business district overlaid on a plat of North Augusta, Section
1. (Scale 1" = 200')
Exhibit E illustrates the present zoning situation in the North Augusta Subdivision. (Scale

AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
REZONING DISTRICT CLASSIFICATION
Rezoning Lots 8,9, 10, 11, 11a, 12, and 13 within the North Augusta Subdivision from the S-
I/Residence and B-2/Business District Classifications within the US 421/Michigan Road Overlay
Zone to the B-2/Business District Classification within the US 421/Michigan Road Overlay Zone
WHEREAS, the Carmel/Clay Plan Commission has favorably recommended the rezoning
of the real property, the legal description of which is attached hereto as Exhibit A.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana,
as follows:
Section I:
That the Official Zoning Map accompanying and made part of the Zoning Ordinance is hereby
changed to designate the real property from the S-l/Residence and the B-2/Business District
Classifications within the US 421IMichigan Road Overlay Zone to the B-2/Business District
Classification within the US 421IMichigan Road Overlay Zone.
Section ll: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed.
Section lll: This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.
PASSED by the Common Council of the City of Carmel, Indiana this
2001, by a vote of ayes and nays.

Dear Members:
The Cannel/Clay Plan Commission offers you the following report on an Ordinance Amendment
to change the official Zoning Map for the City of Cannel and Clay Township as follows:
The designation of certain real property from the S-l/Residence and the B-2/Business
District Classifications within the US 421/Michigan Road Overlay Zone to the B-
2/Business District Classification within the US 421/Michigan Road Overlay Zone, more
particularly described as follows:
Certain real estate situated in Hamilton County, Indiana, known as Lots 8, 9, 10, 11, 11a,
12, and 13 within the North Augusta Subdivision located northeast of the intersection of
West 96th Street and North Michigan Road. .
The Cannel/Clay Plan Commission's recommendation on the Ordinance Amendment is
FAVORABLE.
At its regularly scheduled meeting held November 27,2001, the Cannel/Clay Plan Commission
approved the Ordinance Amendment by a vote of 13 in favor, none opposed, none abstaining.

NOTICE OF ADOPTION OF
AN AMENDMENT TO THE CARMEL/CLAY
ZONING MAP
Notice is hereby given to the taxpayers of the City of Carmel and Clay Township, Hamilton County,
Indiana, that the proper legal officers of the City of Carmel met at their regular meetin~ place, Council Chambers,
Carmel City Hall, One Civic Square, Carmel, IN 46032, at 7:00 p.m. on Monday, the 7 day of January, 2002, and
adopted the following:
Ordinance No. Z-367-01, rezoning Lots 8, 9, 10, 11, 11a, 12, and 13 within the North Augusta
Subdivision from the S-llResidence and B-2/Business District Classifications within the US 421/Michigan
Road Overlay Zone to the B-2/Business District Classification within the US 421/Michigan Road Overlay
Zone.
Ordinance No. Z-367-0l affects only the aforementioned Lots.
Ordinance No. Z-367-01 does not amend any provision of the Carmel/Clay Zoning Ordinance regarding
penalties or forfeiture prescribed for a violation of the ordinance.
