Dear Mr. Fleming:
The City has received your comment letter and drawings dated September 12,2005 based upon the City
review of August 25, 2005.
The conmlents from the City review have been satisfactorily addressed with the following exceptions:
COMMENTS-SECONDARY PLAT
12. The Department does not allow common areas within right-of-way. Please eliminate Common
Area #7 from the right-of-way. It can still be misconstrued that part of Common Area #7 is
-~till within the City right-of-way. Please just remove the Common Area #7 label.
14. Has permission been obtained for providing drainage easements within the Marathon Pipeline
easement along the backs oflots 106-ll2? How far into the Marathon Pipeline easement are these
lots? The Department of Engineering commented at primary plat review "Lots are being
platted such that they encroach on pipeline easement. This could be a problem with future'.
homeowners." This is still a potential problem for future homeowners. Is the note identified
in additional comment #1 below meant to address this issue? The area of concern represents
a significantly large area for the City to police after the developer and builder are no longer
involved with this proj ect. Is this area being reserved as some type of restrictive easement
on the plat?
COMMENTS-CONSTRUCTION PLANS
15. Sheet C200 - Please remove Common Area #7 from the right-of-way. It can still be
misconstrued that part of Common Area #7 is still within the City right-of-way. Please just
remove the Common Area #7 label.
20. All lots adjacent to side yard easements shall be wide enough toaccolnmodate the anticipated
house model and any planned driveways such that there is no encroachment into the easements.
Sheet C902, the Handing Plans, indicates encroachment into several of the easements. Please
revise Sheet C902 such that there is no encroachment indicated and resubmit. Your response
letter stated "The Handing Plan has been revised as requested." The Handing Plan still
shows several driveways encroaching into the casements. Each of these encroachments will
require an executed consent-to-encroach agreement approved by the Board of Public \Vorks
and Safety. How will this be communicated to the builders and the homeowners?
Based on additional review, the City provides additional conunent:
1. It appears there is something incorrect with the note, that appears on several sheets: NO HOUSE,
GARAGE, MOBILE HOME, HOUSE TRAILER, DECKS, SEPTIC TANK, DRAIN PIPES,
TREES, SHRUBS, BERM, LAKE, SWIMMING POOL, FENCE OR ANY OTHER
STRUCTURE, FACILITY TO TREE LIKE GRO\VTH SHALL BE PLACED, ERECTED OR
PLANTED ANYWHERE WITHIN 50 FT. OF THE MARATHON ASHLAND PIPELlNE. Will
this restriction be communicated to the future property owners? Is this being written into
the restrictive covenants? Is this area being reserved as some type of restrictive easement on
the plat?

VERIFY DEPTHS OF ALL EXISTING ONSITE UTILITIES PRIOR TO CONSTRUCTION TO
CONFIRM THERE IS NOT ANY CONFLICTS WITH OTHER UTILITIES, STORM SEWERS
OR STREETS. CONFLICTS AFTER CONSTRUCTION BEGINS ARE SOLELY THE
CONTRACTOR'S RESPONSIBILITY," please understand that this will not allow construction of
infrastructure to anything less than the City's standards. The City would expect that unknown
utility conflicts that are discovered during construction will result in changes to the approved
construction drawings and possible changes to existing construction to the greatest extent possible
to ensure that the City standards are still satisfied.
These comments represent the Department of Engineering's third review of this project. We request that
all responses to our comments be provided in writing. Failure to provide written responses may result in
the delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re-submitted,
particularly if any such changes are considered "new" or fall outside of our previous reviews. Please
provide revised plans including all revisions. Please notify us of any changes and specifically state any
changes, including changes resulting from plan Commission, BZA or other committee meetings.
All bonds and performance guarantees must be posted prior to Engineering Department approval of
construction plans. Also, Board of Public Works and Safety approval and any other governing agency
approvals (if required) must be obtained prior to Engineering Department approval.
The Department reserves the right to provide additional comments based on subsequent reviews and on
receipt of Crossroad Engineer's drainage reviews. These comments may affect the drainage system layout
and/or the Development Plan.

The technical review and comments are intended to evaluate the completeness of the Construction/Stormwater Pollution
Prevention Planfor the project. The Plan submitted was not reviewedfor the adequacy of the engineering design. All
measures included in the plan, as well as those recommended in the comments should be evaluated as to their feasibility
by a qualified individual with structural measures designed by a qualified engineer. The Plan has not been reviewed

The construction component of the Stormwater Pollution Prevention Plan includes stormwater quality
measures to address erosion, sedimentation, and other pollutants associated with land disturbance and
construction activities. Proper implementation of the plan and inspections of the construction site are
necessary to minimize the discharge of pollutants. The Project Site Owner should be aware that
unforeseen construction activities and weather conditions may affect the performance of a practice or the
effectiveness of the plan. The plan must be a flexible document, with provisions to modify or substitute
ractices as necessary.

Stormwater from the south-west comer of phase II drains offsite. Please extend a ridge or swale from the temporary
sediment basin to the gasline easement. The intent is to direct this water into the basin instead of having it flow to the
west side of the basin..
Sequence- After step 7 the diversion at the south end and the silt fence should be installed. In step #8 include seeding the
sediment basin immediately after it is installed.

double wall Hancor Hi-Q or equivalent for subsurface drain.
These comments represent the Department of Engineering's second review of this project. We request that
all responses to our comments be provided in writing. Failure to provide written responses may result in

Dear Mr. Fleming:
We have reviewed the construction plans submitted to the Hamilton County Surveyor's
Office on July 5, 2005 for this project and have the following comments:
1. This proposed project falls within the corporate limits of the City of Cannel.
2. This proposed project DOES NOT fall within a Cannel Wellhead Protection
Zone.
3. This project will be a Hamilton County Regulated Drain Subdivision, along with
the other sections of this development.
4. Please submit the following procedural items with the construction plans to this
office, engineer's estimate, and all associated bonds for 120% of construction
cost. The applications are available on our website at
http://www.co.hamiltoIl.in.us. go to Departments, Surveyor, and Forms.
5. The HCSO would like to see the same SSD access point method that was used in
Maple Knoll at the end of the cul-de-sac. Please include this is the plans with a
note that this is for SSD access only.

6. Hamilton County Ordinance 4-26.99-C(2)e does not outlet to directly discharge
onto the ground as surface flow. The primary plat shows the outlet from Pond 3
draining back to Pond 1. Why was this changed? The HCSO has concerns that
the pipe under West Road is not adequately sized and the downstream condition
of this channel will not handle this constant flow. AlsO, I do not have letter from
these downstream property owners consenting to the discharge as required per
Hamilton County Ordinance 4-26-99-C(S). Further discussions will need to take
place on this proposed outlet for Pond 3 as soon as possible.
7. The HCSO understands that the handing plan (C902) provided in the plans is only
a representation and may not actually be what is constructed. but it must be
brought to your attention that we do NOT allow driveway or buildings
encroachments into the R.D .E. Please see attached letter dated 8-1-03.

8. Please remove the generic 4342 detail and 3S01-L2 detail from the construction
plans. All casting details will be replaced with HCSO Standard Casting Details.
9. No landscape planting will be pennitted or allowed within the proposed regulated
drainage easements per Indiana Code 36-9-27-33(d). In common areas that are
dedicated as Diainage Easements, no trees will be allowed within 15 feet in each
direction from the centerline of pipe. Any'street trees should be behind the
sidewalks to prevent the root infiltration into the SSDs under the curb line. Tbe
provided landscape plans for this section show trees iD swales. on the banks
on the pOBds, and very close to the regulated draiBS. Please review and
revise.
10. The HCSO has new standard details for the required castings. The details are
available for download on our website at http://www.co.hamilton.in.us. go to
Departments, Surveyor, and Documents for Download. The details are CT-l, CT-
2, CT -4, CT -5~ CT -6, CT -7, CT -8. and CT -10. These are our required casting and any other casting must be approved by this office.

We have reviewed the construction plans submitted for this project for the July 20, 2005 Technical
Advisory Committee meeting. We offer the following comments:
GENERALINFO~ATION
1. The project site is located within current City of Carmel Corporate Limits.

appropriate Docket Number and the date (or dates) of appro val by the Plan Commission and/or

We request that all comments and comment letters generated by this office be answered in writing
and be accompanied by a drawing reflecting requested revisions. Final drawings will not be
approved for construction until all Engineering Department, Carmel Utilities and Hamilton
County Surveyor's Office issues have been resolved. The design engineer must certify all
drawings submitted for final approval. Because of the dual jurisdiction between the City of
Carmel and the Hamilton County Surveyor, we will require a minimum of eight-sets of drawings
for approval after all issues have been resolved. The drawings will be stamped as approved and
will be signed by the City Engineer and by Carmel Utilities. The eight-sets will then be sent to the
Hamilton County Surveyor's Office for approval and signatures. Three approved sets are to be
returned to the City of Carmel. The Hamilton County Surveyor's Office will retain two-sets. The
Developer, the Engineer and the Contractor will each receive one-set.
5. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated
right of way will require a Consent to Encroach Agreement with the City of Carmel's Board of
Public Works and Safety.
6. Carmel Utilities/W ater Distribution should be provided copies of all drawings and revisions for
review of water issues. They will provide a separate review regarding these issues.
7. Carmel Utilities subscribes to "Holey Moley" who should be contacted directly for all water main
locations.
8. I have sent copies of the following previously and will not send additional copies unless requested
to do so:

BONDING REQUIREMENTS
9. Individual Performance Guarantees will be required for the following subdivision improvements:
. Streets (Base, Binder and Surface). The asphalt surface may not be bonded separately from
the stone base and asphalt binder.
. Curb & Gutters
. Water Mains (Offsite Water Mains may be bonded separately, if applicable).
. Street Name Signs
· Sidewalks/Asphalt Paths within dedicated right of way. Interior (builder's lot) concrete
sidewalks and Exterior concrete sidewalks/asphalt paths (Sidewalks/asphalt paths within
dedicated right of way and adjacent to common areas or perimeter roads) may be bonded
separately.
Storm sewer/storm drainage bonding (including sub surface drains) will be under the jurisdiction
of the Hamilton County Surveyor's Office. They also require bonding for Monuments & Markers
and for Erosion Control. Sanitary sewers are under the jurisdiction of the Clay Township
Regional Waste District.
The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100%
of the cost of labor and materials to construct the individual improvements, to be provided by the
design engineer. Please provide detailed Ene:ineers Estimates for each improvement
includine: unit costs. Quantities. materials and types of materials. etc. This office is to be
provided with this detailed estimate prior to or in coni unction with the submission of the
estimate to the Owner/Developer. Upon completion and release of individual Performance
Guarantees, a three-year Maintenance Guarantee will be required. The Maintenance Guarantee
amount is based upon 15% of the Performance amount for Streets and Curbs and 10% of the
Performance amount for all other improvements. Performance Guarantees may be Performance or
Subdivision Bonds, Irrevocable Letters of Credit or Cashier's Checks, Certified Checks or Official
Checks. Please reference the enclosures for more detailed explanation of our procedures.

AVAILABILITY AND CONNECTION FEES
10. Availability (acreage) Fees must be paid after all other Engineering Department requirements
have been satisfied and prior to the start of construction activities. Availability Fees are based
upon total platted acreage for the development at the current rate of$I,010.00 per acre (Water
Availability Fee). Based upon the secondary plat indicated acreage, the following Water
Availability Fees would apply:
26.995 Acres @ $1,01O.00/Acre == $27,265.00
Connection Fees are currently $1,310.00 for water per single-family residence. Connection Fees
are paid when the infrastructure has been complete, satisfactory test results obtained and the
subdivision has been released for permits. Water Connection Fees are paid on a per-lot basis.
. If an irrigation system, swimming pool or clubhouse is planned for these, or any future
section of the development, additional Water Connection Fees will be assessed based
upon the recommendation of the Director of Carmel Utilities.
11. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations
submitted for review to this office. We will share Crossroad's comments as they are received.
COMMENTS-SECONDARY PLAT
12. The Department does not allow common areas within right-of-way. Please eliminate Common
Area #7 from the right-of-way.
13. Please provide monuments at all external comers.
14. Has permission been obtained for providing drainage easements within the Marathon Pipeline
easement along the backs of lots 106-112? How far into the Marathon Pipeline easement are these
lots?
COMMENTS-CONSTRUCTION PLANS
15. Sheet C200 - Please remove Common Area #7 from the right-of-way.
16. Any off-site easements necessary for installation of utilities must be secured prior to the
Department of Engineering approving the drawings.
17. ADA ramps are required at all locations where the sidewalks or asphalt paths cross the streets.
18. Please remove Sheet C900 - Landscape Plan from set of plans submitted for approval by
Department of Engineering. The Department of Engineering does not approve the landscape plan.
19. Please indicate and label a minimum of20-foot curb return radius at each of the interior street
intersections.
20. All lots adjacent to side yard easements shall be wide enough to accommodate the anticipated
house model and any planned driveways such that there is no encroachment into the easements.
Sheet C902, the Handing Plans, indicates encroachment into several of the easements. Please
revise Sheet C902 such that there is no encroachment indicated and resubmit.
These comments represent the Department of Engineering's initial review of this project. We request that
all responses to our comments be provided in writing. Failure to provide written responses may result in
the delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re-submitted,
particularly if any such changes are considered "new" or fall outside of our previous reviews. Please
provide revised plans including all revisions. Please notify us of any changes and specifically state any
changes, including changes resulting from plan Commission, BZA or other committee meetings.
All bonds and performance guarantees must be posted prior to Engineering Department approval of
construction plans. Also, Board of Public Works and Safety approval and any other governing agency
approvals (if required) must be obtained prior to Engineering Department approval.
The Department reserves the right to provide additional comments based on subsequent reviews and on
receipt of Crossroad Engineer's drainage reviews. These comments may affect the drainage system layout
and/or the Development Plan.
