May 25, 2023 Mr. Alex Jordan Engineering Department City of Carmel One Civic Square Carmel, Indiana 46032 Re: Request for Variance – Stormwater Detention Restoration (48 hours) Docket No. #PZ-2022-00237 DP/ADLS – Carmel Medical Office at the Bridges Dear Mr. Jordan: American Structurepoint, Inc., on behalf of our client, Cornerstone Development Group, respectfully requests the following variance from The City of Carmel Stormwater Technical Standards. We are requesting a variance from standard 302.06.1, which requires a minimum of 90% of the maximum storage volume within the detention system to be restored within 48 hours from the start of the storm, unless additional storms occur within this period. The detention system has been designed to meet the maximum allowable release rates per Ordinance and is able to restore approximately 82% of the maximum volume within 48 hours and can achieve 90% restoration within approximately 54 hours. There will be no undue burden placed on the City’s infrastructure or adjacent sites as a result of this variance request. Flood routing has been analyzed extensively should back to back storm events occur, allowing for the safe passage of excess runoff away from the proposed building. We are requesting a variance from standards 102.03.i.b and 302.06.12, which require detention basins to be sized to detain the runoff from the fully developed right-of-way per the City of Carmel 20-year Thoroughfare Plan. The right-of-way along Illinois Street has recently been improved (within the last 10 years) with new drainage throughout the entirety of the street and is completely independent of the site. Given the recent improvements and developments adjacent to Illinois Street, it is unlikely any future improvements will be made to the right-of-way that would necessitate additional stormwater detention volume be provided, which is understood to be the intent of section 302.06.12 of the Standards. In addition, during the master planning efforts for the Bridges PUD development, the Illinois Street right-of- way was always viewed and drained independent of the adjacent properties. The subsequent master planned drainage for the Bridges PUD did not include this right-of-way. The proposed design is consistent with all previous work and approvals associated with the Bridges PUD and the various outlots. There will be no undue burden placed on the City’s infrastructure as a result of this variance request and with the reduced release rate from the site as a result of development, the downstream infrastructure will likely see a benefit to the overall system. We are requesting a variance from standard 104.02, which requires the building finished floor to be a minimum 2 feet above the Minimum Flood Protection Grade (MFPG). Due to grading constraints, ADA accessibility to building, there is less than 2 feet of freeboard from the emergency overflow weir elevations adjacent to the site. There are several emergency overflow locations adjacent to the building and throughout the site, with all overflow locations have greater than 1 foot of freeboard from the finished floor elevation. The site has been graded to perpetuate all drainage away from the building to the south and 111th Street where elevations are approximately 5 feet lower than the finished floor elevation of the building. We are requesting a variance from Chapter 100 of the Stormwater Ordinance that requires stormwater detention to be provided for any disturbed site. We are providing stormwater detention per the Ordinance for the north parcel that is currently proposed for full development under Docket No. PZ-2022-00237. Due to the nature of the site and the need to redistribute existing soil stockpiles from the site to the south parcel, the south parcel will be disturbed. There are imminent plans to provide full development plans for this parcel, at which time permanent detention would be provided. We are seeking a variance from the standards to forego temporary detention for the south parcel only, while final design documents are prepared and permitted for construction. In the event the project on the south parcel stalls or does not move forward, we are proposing to disk the land, respreads topsoil and provide permanent seeding for this parcel to try and restore it to as close to an existing condition as possible. The point of these documents is to create a cohesive look on a building or group of buildings. 1. Determine what type of building is proposed (i.e. Multi‐Tenant Ground Floor Building or Multi‐Tenant, Multi‐Level, Mixed‐Use Building). This will determine what Sign Types are permitted (See the Sign Standards section (5.39) of the UDO for specifics). a. Remember that if the property is zoned C‐1 or C‐2 refer to 5.39.L Permanent Signs in a C1 & C2 District 2. Determine all the possible locations for signage on elevation drawings. Please identify the Spandrel Panels and provide measurements (height and width). 3. Outline the following criteria: a. Illumination method (face or halo/reversed lit. Non illuminated is also an option) b. Mounting method (flush to fascia or raceway). Raceway specifics may also be included. c. Any color limitations for sign face, trim caps, or returns. Raceway color should be specified to match fascia color. d. Any size criteria. Sign size criteria will revert to predetermined City Sign Standards if not specified. e. Sign Types/specs for each specific sign location 4. Create a document that includes all this information. Document should include the name and address of the development, details, and drawings. See Approved Sign Package and Approved Sign Criteria for examples. This document will be adhered to in perpetuity. If changes are desired after this is recorded, an ADLS Amend will be required.
