Mr. Clampitt stated that his residence is three quarters of a mile from the area to be protected. Mr. Regan asked Mr. Fortune if he has had any trouble with robberies on his property. Mr. Fortune said no not since moving in and that he keeps valuables locked. Mr. Carl Smith asked Mr. Tarshes about his land at 126th and West Rd. Mr. Tarshes said he had it for sale in 10 acre tracts for residential home sites. One site was sold and a home was built and the rest is being used as a farm at this time. Mr. Carl Smith asked Mr. Wallach about the development across the street from Mr. Clampitt and whether it was private homes or a develop- ment. Mr. Wallach said it is not platted. Mr. Carl Smith asked Mr. Clampitt if he was a gentleman farmer. Mr. Clampitt said that they cash rent and have garden areas for people to use. He does not physically farm the ground. Mr. Clampitt related that he has invested over $200 in security service from Westfield. He does not want to sell off his farm in lots and plans to reforest and keep it up all in one package. Mr. Clampitt said he is hopeful that this trailer would be a temporary situation. Mr. Carl Smith asked the Building Commissioner why a variance is needed. Mr. Van Cauwenberg said a variance is needed because the trailer is a temporary building. The zoning is S-1. Mr. Jim Smith moved that BA 6-77 be approved. Seconded by Frank Regan. Finding of fact forms were completed. The vote was 6 NO, 0 FOR. Motion denied. 2a. SsOO P.M.,%Public Hearing on Docket No. BA 5-?7, Variance Appli- cation for signs in Mohawk Place Shopping Center located in 600 block of S. Range Line Rd. Filed by Harry C. Elliott. The Public Hearing opened at 8:18 with Mr. Elliott making the present- ation for standardisation of signs in the Center. Pictures of each of the buildings were taken and the proposed signs were placed on them. Three buildings are presently empty and they want to lease with the signs UP* Mr. Staley, of Staley Signs, was present stating that the petitioner wants to upgrade the identification signs in the Center. The signs will all be the same color with black background and white letters. They are asking for a maximum of 36 sq. ft. A consistent size is needed that can be read from Range Line Rd. Mr. Staley showed the pictures of the buildings with the proposed signs and then pictures of the buildings with the present signs for comparison. Only the letters will be illuminated at night. There were no comments from the public and the Public Hearing closed at 8s26. Mr. York asked Mr. Elliott if he had permission for the signs there now. Mr. Elliott said no but merchants had handled it individually and there were some variances. Mr. Elliott stated that some of the proposed signs fit the ordinance but some they want to be larger requiring a variance. Mr. Banks moved that Docket No. BA 5-77, Variance Application for Signs, be approved. Seconded by Dr. John Durrer. Mr. York questioned whether there was enough included in the motion and said that it should be more explicit. Mr. Banks amended his motion to include that all signs will have white lettering on a black background, only one sign per business, sizes of the signs to be 3 ft. x 12 ft. for 20 and 25 ft. store frontages and 3 ft. The signs will be changed when new tenants start business in the Center or if a present tenant,who already has a sign, would like to conform. Seconded by Dr. John Durrer. Fact finding forms were completed. The vote was 5 FOR, 1 AGAINST (Carl Smith voting NO). Motion carried. 3a. 8:15 P.M., Public Hearing on Docket No. BA 7-77, variance Appli- cation for General Office Use in R-4 zoning on lot 11 of Simeon Hawkins Addition, 40 1st St. N.W. Filed by Jim Nelson for Lester A. Roberts. The Public Hearing opened at 8:40 with Xim Nelson, Carmel attorney, making the presentation. Mr. and Mrs. Roberts were present. The property involved is immediately north of the police station and they are seeking a variance to use the improvement on the property for general office use. The brick structure was formerly used as a doctor's office and was recently used as a residential dwelling. The size of the improvement is 28, x 36'. They are asking for a variance for business use because they don't feel the property lends itself to a residential use. Mr. Nelson said that be- cause of the character of the property and the area with business to the south and southwest, to require them to use the property for residential would cause substantial hardship. The zoning is R-4, multi -family, and the lot is too small to use for this purpose. Mr. Nelson read a portion of the application. Mr. Horace Hadley, 140 1st Ave. N.W., commented that this would be adequate for a duplex building and feels that residential should be pre- served. The Public Hearing closed at 8:48. A discussion regarding businesses and zoning in that area followed. Mr. York related that when Range Line Rd. North was rezoned for business this piece of property was considered as a possibility but that it was left the way it was instead. Mr. Carl Smith moved that BA 7-?7 be approved for 1 year. Seconded by Jim Smith. Mr. York stated that if a time limit is put on an office building it precludes the owners of spending much money to improve the building so that it can be used. This is permanent structure and not temporary. Mr. Jim Smith asked to withdraw his second to the motion as he had not heard the 1 year time limit inclused when the motion was made. There being no second, the motion died. Mr. Jim Smith moved that BA 7-77 be approved. Seconded by Dr. John Durrer. Mr. Carl Smith expressed opposition to general office use and an open end variance stating that it could become something detrimental to the city of Carmel. Fact finding forms were completed. The vote was 5 FOR, 1 AGAINST (Carl Smith voting NO). Motion carried. F. Old Business lb. Petitioners for Kenny Shoe Corperation, located 1425 S. Range Line Rd., for a variance, request to be tabled an additional month. Filed by Ron Wagner for Am -Cal Corp.
