MEETING MINUTES
Date: Wednesday, May 19, 2021 Place: Virtual meeting. Time: 9:00 a.m. (Approximate start times for each item are listed below) 9:00 a.m. Docket No. PZ-2021-00040 DP/ADLS: Mexican Restaurant at Legacy The applicant seeks site plan and design approval for a new restaurant. The site is located at 7299 E. 146th Street between Community Drive and Beallsville Drive. It is zoned PUD (Legacy Z-501-07.) Filed by Tami Lakes of Versatile Construction Group, LLC, on behalf of Don Rigo Properties, LLC.
Marc Tworek of Versatile Construction Group, LLC. presented the project. This project includes a new building for a new restaurant in the Legacy PUD. Dave McCoy – City of Carmel Addressing - Mr. McCoy verified 7299 E. 146th Street as the correct address for the proposed building. Christina Girod – Duke Energy - Ms. Girod confirmed the project’s contact at Duke was Reece Heilers and recommended coordinating with Mr. Heilers regarding servicing the site. Sam Clark – Hamilton County Surveyor’s Office - Mr. Clark stated that he had not submitted his comments on ProjectDox but would in the next couple of days. Jason Stewart – City of Carmel Utilities - Mr. Stewart inquired if the developer was constructing the sewer line. Mr. Tworek confirmed that the sewer line was being constructed by the vet clinic project adjacent to the subject site. Daren Mindham – City of Carmel Urban Forestry
- Mr. Mindham stated that the landscape plan was ready to be stamped and approved. Alex Jordan – City of Carmel Engineering
- Comments submitted on ProjectDox and awaiting revised plans. Trent Baxter with Versatile Construction Group, LLC. stated that he would contact Mr. Jordan to set up a time to discuss his review comments. David Littlejohn – City of Carmel Alternative Transportation - Comments submitted on ProjectDox regarding the location for ADA parking near the entrance. Mr. Baxter stated that the applicants could not achieve an accessible route due to slope and inquired about the variance process. Mr. Littlejohn stated that ADA requirements are federally mandated and
requires that an “accessible route from ADA parking spaces needs to be the shortest route provided to the main entrance of the building.” Mr. Littlejohn added that if the applicants could not accommodate this requirement and a patron had an issue, the responsibility falls on the property owner.

Ryan Hartman – TriCo Regional Sewer Utility
- No comments. Rachel Keesling – City of Carmel Planning & Zoning - Ms. Keesling stated that she issued comments on ProjectDox the day before. Ms. Keesling requested additional plans for the screening wall. Mr. Tworek held up a paper featuring an illustration of the screening wall and explained the intention was to hide electrical/telephone services and match the proposed building materials. Mr. Tworek held up another paper featuring a side elevation and explained the material on the sides of the overhangs would be a stucco material. Mr. Tworek held up a third paper featuring the patio wall with bronze rails to match the window and door treatments. Mr. Tworek held up a fourth paper featuring the dumpster screening wall and confirmed it would match the same design and style as the electrical/telephone screening wall.
Mr. Tworek addressed Ms. Keesling’s ProjectDox comment. The first comment was addressed by Mr. Tworek stating that the windows would be regular windows with a lighted mural behind with
no spandrel glass on the job. The second comment was addressed by Mr. Tworek stating that the applicants could not duplicate the canopies on the north side of the building due to the lack of room with the proposed sidewalk. Ms. Keesling explained that she would like to replicate the wooden
feature canopy. Mr. Tworek and Ms. Keesling confirmed they would discuss the possibility of replicating this look along the north side of the building further at a later time. Mr. Tworek stated that the applicants had not yet determined decorative lighting selections at that time. Mr. Tworek inquired about a review comment made by Carmel Water regarding the irrigation meter. Ms. Lopez recommended the applicants reach out to Steve Cook with Carmel Water to discuss the comment further. 9:15 a.m. Docket No. PZ-2021-00073 PP: Albany Village Subdivision Docket No. PZ-2021-00074 SP: Albany Village Secondary Plat The applicant seeks primary plat approval for 82 lots (36 single-family detached dwelling units and 46 two-family attached dwelling units) on 36 acres. The site is located at 14407 Shelborne Rd. and is
zoned Albany Village PUD/Planned Unit Development (Ordinance Z-666-21). Filed by Jim Shinaver and Jon Dobosiewicz of Nelson & Frankenberger on behalf of Lamb Property Developer, LLC.
Jon Dobosiewicz of Nelson & Frankenberger presented the project. This project includes primary and secondary plat approval for a new subdivision including 82 lots, 46 two-family homes, and 36 single-family homes. Dave McCoy – City of Carmel Addressing - Mr. McCoy confirmed he was working on the addresses for the subdivision. Christina Girod – Duke Energy - No comments.

Sam Clark – Hamilton County Surveyor’s Office - Mr. Clark stated that he had submitted his comments on ProjectDox the day before regarding
Little Creek Regulated Drain. Chad James of HWC Engineering addressed Mr. Clark’s question and stated the original plans featured a path connecting to Shelborne Road and had since been revised to keep the path out of the regulated drain easement. Mr. James stated that the culvert was planned to be extended to provide a right-turn lane into the subdivision, but it was discovered that the culvert did not have enough cover to extend and maintain the existing slope. Mr. James stated they would likely need to remove, replace, and lower the culvert in order to keep flows crossing Shelborne Road. Mr. Clark inquired if the applicants would be removing the existing open ditch. Mr. James confirmed the applicants would not remove the ditch. Mr. Clark noted that he would like to walk the site drain with the applicants and discuss the possibility of incorporating an offsite area with the County Surveyor. Daren Mindham – City of Carmel Urban Forestry - Comments submitted on ProjectDox regarding tree preservation labeled and locations. Mr. Mindham also inquired about the sidewalk connection to the southwest corner appearing to be
located within the tree preservation area on some but not all plans. Mr. James stated that the Engineering Department wanted to direct Albany Place offsite drainage through “lake 2” in Common Area B on the site plan and use the outfall to drain into the culvert that crosses Shelborne
Road. Mr. James argued that the path had to be pushed into the tree preservation area to provide adequate drainage. Mr. James stated that if the path is relocated outside of the tree preservation area, the applicants would not be able to make Albany Place drainage convey through the proposed lake. Mr. Jordan stated he would need to discuss with the Stormwater Administrator and Drainage Consultant and recommended setting up a separate meeting to discuss further. Alex Jordan – City of Carmel Engineering - Mr. Jordan stated that he was still in the process of submitting his comments on ProjectDox and was hopeful to finalize those comments later that day. Mr. James inquired about storm sewer along the backside of lot 79-82 and requested confirmation if the Engineering Department wanted a swale in place of the existing natural low point. Mr. Jordan stated that the existing drainage channel could
remain as is with a waiver if approved by the City Engineer. Mr. Jordan commented that he would look for the replacement of water quality units with bioswales on future plans. David Littlejohn – City of Carmel Alternative Transportation - Comments submitted on ProjectDox regarding path along Shelborne Road. Mr. Littlejohn stated that the path width needed to be adjusted to meet the 10’ width requirement outlined in the Bicycle
and Pedestrian Plan and inquired if the path would connect to the path at the intersection of 146th and Shelborne Road being installed by the Hamilton County Highway Department. Mr. Dobosiewicz stated that the intention is to connect and that the applicants would meet to discuss
installation with the Hamilton County Highway Department. Mr. Littlejohn inquired about a crosswalk connection at the southwest corner to the new park. Mr. Dobosiewicz confirmed the connection and stated that the connection may not be made until the park site was developed. Ryan Hartman – TriCo Regional Sewer Utility - Comments made to HWC Engineering on May 3rd. Rachel Keesling – City of Carmel Planning & Zoning - No comments.

Alexia Lopez – City of Carmel Planning & Zoning - Ms. Lopez stated comments had been submitted on ProjectDox regarding the Primary Plat and
that Angie Conn had submitted comments on ProjectDox regarding the Secondary Plat. Ms. Lopez requested the tree preservation easements be correctly illustrated on the plat per the PUD, mentioned about the park connection crosswalk, and inquired about the possibility of meandering the path in Common Area B along the pipeline as mentioned in the PUD. Mr. Dobosiewicz stated that the easement holder wanted the path to cross at a 90-degree angle and the path would remain as illustrated. Mr. Littlejohn stated his preference was to keep the path straight and not meander. Ms. Lopez also requested the applicants note the native species for the ponds and wildflower plantings along the pipeline easement on the plans.
9:25 a.m. Docket No. PZ-2021-00075 DP/ADLS: Bank of America – The Bridges The applicant seeks site plan and design approval for a new bank branch on a new out lot within The Bridges. The site is generally located at the SW corner of Illinois Street and Zotec Drive, with a planned
address of 11530 N. Illinois Street. It is zoned PUD – The Bridges (Z-550-11). Filed by Jon Sheidler of Woolpert on behalf of JLL.
Jon Sheidler of Woolpert presented the project. This project includes the development of a new bank building located within the Bridges PUD. Dave McCoy – City of Carmel Addressing - Mr. McCoy verified the address of 11530 Illinois Street and stated that Carmel usually does not use the directional prefix as outlined in the agenda and docket. Christina Girod – Duke Energy - No comments as this project would be serviced by Indianapolis Power & Light Company. Sam Clark – Hamilton County Surveyor’s Office
- Mr. Clark stated that he had not submitted his comments on ProjectDox but would in the next couple of days. Daren Mindham – City of Carmel Urban Forestry - Comments submitted on ProjectDox regarding the plans reflecting existing plant material and that the construction documents mark this area as preserved. Alex Jordan – City of Carmel Engineering - Comments submitted on ProjectDox including requested Right-of-Way dedication in the northeast corner by the City Engineer as pieces of the parcel are located within the roadway. David Littlejohn – City of Carmel Alternative Transportation - Comments submitted on ProjectDox regarding location of bicycle parking and notified the applicants that Section 11.3 of the PUD specifies that “walkways should be designed to allow for pedestrian access to the buildings” and requires a pedestrian connection from the path along Illinois Street to the building. Ryan Hartman – TriCo Regional Sewer Utility - No comments can be made until offsite sanitary sewer plans are shared with TriCo.

Rachel Keesling – City of Carmel Planning & Zoning - Ms. Keesling commended the applicants for accommodating her site plan and architectural
requests. Ms. Keesling noted a request in signage spacing and inquired about the addition of awnings/overhead door coverings. Kevin Curry with RS&H confirmed that Ms. Keesling’s requested changes would be accommodated. Alexia Lopez – City of Carmel Planning & Zoning - No comments.
