PZ-2022-00211 V, PZ-2022-00212 V, PZ-2022-00214 V, PZ-2022-00215 V, PZ-2022-00216 V, and PZ-2022-00218 V: Chick-fil-A Variances Dear Mr. Vavrina: At the meeting held on Monday, November 28, 2022, the Carmel Board of Zoning Appeals took the following action regarding the Development Standards Variance requests filed by you for the property located at 9965 N. Michigan Rd: APPROVED: Chick-fil-A Variances: Development Standards Variance approvals for: • PZ-2022-00211 V: Drive Thru location: Must be located to the rear of the parcel, Site has two public street frontages and one private street frontage, therefore, this requirement cannot be met, • PZ-2022-00212 V: Two signs facing south: wall sign & ground sign oriented south, • PZ-2022-00214 V: 8’ offsets required for facades greater than 90’ in width, at intervals of 60’; 4’ provided, • PZ-2022-00215 V: Lighting plan does not meet 0.3 footcandle maximum at property lines, • PZ-2022-00216 V: Foundation plantings required, none provided, and • PZ-2022-00218 V: Signage – Number: 3 proposed, 2 allowed. Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the improvements must be underway, or a written request for a one-time, six-month extension of the approval must have been received and approval granted by this Department. The expiration date of the approval is November 28, 2025. Please include a copy of this letter with any permit application.
