It is also intended to identifY areas where additional measures may be required to control erosion and sedimentation. All practices recommended in this report should be evaluated as to their feasibility by a qualified individual with structural practices designed by a qualified engineer. All erosion and sediment control measures shall meet the design criteria, standards, and specifications outlined in the "Indiana Handbookfor Erosion Control in Developing Areas" or similar guidance documents. Current Site Information: Land development is 95% complete. 2/3 ofth elots and disturbed areas are seeded. Due to recent utility installation, a 30' band behing the curb needs to be seeded and mulched. The Following Items Have Been Evaluated and Assigned a Designation of: S = Satisfactory M = Marginal U = Unsatisfactory NA = Not Applicable Construction Site Management for Erosion and Sediment Control M (1) Disturbed areas have been adequately protected through seeding or other appropriate erosion and sediment control measures. S (2) Appropriate perimeter sediment control measures have been implemented. S (3) Conveyance channels have been stabilized or protected with appropriate sediment control measures. S (4) Erosion & sediment control measures are installed properly. S (5) Storm drain inlets have been adequately protected. S (6) Outlets have been adequately stabilized. S (7) Existing erosion & sediment control measures are being maintained. U (8) Public & private roadways are being kept clear of accumulated sediment or tracked soil. U (9) Erosion & sediment control measures have been installed and maintained on individual building sites. Status of Sediment Retention On-Site Site conditions present a high potential for off-site sedimentation. There is evidence of off-site sedimentation. Install an appropriate sediment control practice between construction areas and lower lying areas. Replace/Repair silt fence and/or straw bale barriers. Entrench silt fence (6-8 in.) and/or straw bale barriers (4 -6 in.) and stake straw bales. Remove accumulated sediment from: o sediment traps/basins, o behind silt fence/straw bales, o around storm drain inlet protection devices, o streets and gutters (Do not flush with water) X Temporary seed, fertilize, and/or mulch: . Behind curbs and other disturbed areas Permanent seed, fertilize, and mulch areas that are at final grade Protect storm drain inlets: o curb inlets, o drop inlets Reshape and stabilize sideslopes of: o sediment traps/basins, o detention/retention basins Install/Maintain construction entrance ( s): Reshape and stabilize conveyance channels: Place greater emphasis on erosion and sediment control on building sites; contractors, subcontractors, material vendors, and others should be made aware of erosion and sediment control X requirements. Appropriate perimeter sediment controls (e.g. silt fence) and stable construction entrances shall be utilized on all sites. Sediment tracked into the street shall be removed (do not flush with water) at the end of each work day. X Other Requirements: The entrance to Structure #267 is plugged with sediment. Warren Holms the land owner to the east has complained about excess drainage and crop damage. This structure needs to function to prevent future damage. Recommend filling the gully above the inlet and stabilizing the soil with an erosion control blanket. Perimeter protection is needed in front and rear of all homes being built. Also attached is a copy of a sample Cinergy street light service agreement for distribution to the Planning Commission to answer questions of maintenance and ownership responsibilities of the electric company and not the neighborhood HOA. As well, Centex will be bringing an exhibit to the January 8 Subdivision Committee meeting to address questions of pedestrian trail connectivity between neighborhoods, Please call with any questions and thank you for your assistance in this matter. Centex has an agreement with Trinity to represent them in the Primary Platting of The Lakes at Hayden Run and therefore will execute this contract for that project as well as the others noted above. By execution of this contract, Centex is agreeing to the costs. distributed by project acreage as handwritten ort page 1 of the contract. Therefore, Centex agrees to the fee of $2,257.25 for Hayden Run, $3,646.46 for The Lakes at Hayden Run, and $3,357.87 for The Ridge at Hayden Run for a total fee of$9,261.58. It is assumed that additional services provided at the hourly schedule will be distributed by project acreage as well. Conduct peak hour turning movement traffic volume counts at 'each of the existing study intersections. These cQunts w.m be made between the hours of 6:00 AM to 9:00 AM and 3:00 PM Lo 6:00 PM. 2t Determine the ex.isting capacity level for each intersection based on the existing geometries and existing traffic volumes. Maintenance is performed after notification from the Customer that a problem exists and/or on a Company scheduled maintenance cycle. Company will stock only , the most common equipment and parts. 3.2 Normal maintenance covers ordinary wear and tear with proper use of the System. Repairs or replacements requested as a result of C;ustomer action will be performed on a time and material basis cost to the Customer where an estimate of costs will be provided to the Customer before the work begins. Company reserves the right to charge Customer for repair costs incurred due to vandalism. 3.3 Maintenance does not include partial or full System replacement or major repairs due to System age. While many Systems last 15 to 25 years, different types of lighting equipment have different life spans. Lighting equipment manufacturers also discontinue equipment from time to time. End of life for a System will be determined by the Company and discussed with Customer. 3.4 This item (3.4) is applicable to this Agreement. YES (Yes or No). When applicable, Company reserves the right to update or modify the monthly maintenance charges to reflect changes in Company costs for materials and labor no more often than every three years. In these unique Systems the monthly maintenance charges may be based on location, lamp source and wattage, luminaire and pole styles that are uncommon to Company known standards. SECTION V. - TERM OF AGREEMENT 5.1 Service under this Agreement shall commence as soon as practicable, and Company shall notify Customer in writing as to the date on which service hereunder will commence. 5.2 The initial term of this Agreement during which Customer shall take and Company shall render service hereunder shall be TEN (10 ) years from the date when service commences hereunder ("Initial Term"), and after the Initial Term this Agreement shall continue in force and effect for successive terms of ONE (1) year(s). unless terminated by either party ("Extension Period"). OTHER TERMS AND CONDITIONS 2. 3. .The obligations of Customer to pay the monthly invoice ani:! any: 'applicable late fees or any amount due and owing to Company as a result of this Agreement or in connection with the rights and privileges granted hereby, are independent of the liabilities or obligations of Company hereunder. Customer shall make all such payments due to Company without any deductions, setoffs or counterclaims against such payments on account of any breach or default by or <<'aims against the Company pursuant to this Agreement or otherwise or on account of any claims against or default by any third party. 4. Company's installation of the System is contingent upon obtaining adequate written easements if necessary, and Customer agrees to assist the Company when necessary in obtaining adequate written easement covering permission to install and maintain service lines and facilities required for serving and providing the System. 5. Company is an independent contractQr and not an agent or employee of Customer and nothing contained in this Agreement shall be so construed as to justify a finding of the existence of any rela,tionship between Company and Customer inconsistent with that status. Company shall have exclusive control of and responsibility for its labor relations. 6. Company does not warrant nor guarantee the safety of Customer or any third party, nor does it warrant or guarantee the security of Customer's property or any third party property, lighting levels, or uniformity of lighting as a result of Customer's use of the System. Company is not liable for any injury to Customer, or any persons or property arising out of the System use. THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE, EITHER EXPRESSED OR IMPLIED, PROVIDED BY COMPANY TO CUSTOMER. 7. If a breach or default occurs, the non-breaching party shall provide the breaching party with a thirty (30) day written notice to cure such default or breach, or if the defect cannot be cured within thirty (30) days, the breaching party shall commence the cure of such defect. If the breaching party fails to cure or to commence the cure of the defect within the prescribed timeframe set forth herein, the non-breaching party, at its sole discretion, shall provide notice to the breaching party of, the immediate termination of this Agreement. Events beyond Company's control, including but not limited to acts of nature, electricity outages, and inability to obtain needed replacement parts, shall not constitute material breaches of this Agreement. 8. The operation or maintenance of the System does not guarantee security of Customer property or that of any third party or, nature, including attorney fees, against Custom'er caused in whole or in part by Customer's own negligence and/or its failure to comply with the terms of this Agreement. It also does not guarantee that initial lighting levels or lighting uniformity will be maintained. 9. Customer desiring a Company installed System on a public right- of-way or on other property not under customer's jurisdiction must provide the Company with written permission from the entity with legal jurisdiction over that right-of-way or property, before installation will begin. Company shall not be liable for any claims, demands, cause of action, liabilities, loss, damage or expense of whatever kind or nature, inclUding attomey fees, against Customer for actions inVOlving a structure not Company-owned on which the Company has placed Company-owned equipment at Customer request. Additionally, the Company will not be responsible for any repairs needed by the structure that is not owned by Company. If the structure becomes unsuitable, or unsafe to support Company- owned equipment the Company retains the right to remove the equipment from the structure. If Company equipment is removed under these conditions Customer will owe Company a prorated amount for the removed equipment plus removal costs minus salvage value. 12. When changes are requested by Custom.er at any time after the System is installed and before the normal end of System life, Company will evaluate and estimate the costs of the changes. The changes will be made after the Customer pays the agreed upon amount if any to make changes. Changes include such items as relocating poles, changing luminaire styles (post top, rectangular cutoff, floodlight), their locations, wattage, and lamp source (i.e., metal halide, high pressure sodium). Any such agreed upon changes will be documented either on a new Agreement or on an Amended Agreement. New equipment added to the System will require a new Agreement. 13. If any part, term, or provision of this Agreement is adjudged to be contrary to the law governing this Agreement by a court of competent jurisdiction, the validity of the remaining parts, terms, and provisions shall not be affected thereby. 14. This Agreement, and all the terms and provisions hereof, shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, executors, administrators, successors, personal representatives, and/or permitted assigns. 15. Each party to this Agreement represents that it is sophisticated and capable of understanding all of the terms of this Agreement, that it has had an opportunity to review this Agreement with Its counsel, and that it enters this Agreement with full knowledge of the terms of the Agreement. 16. No delay of or omission in the exercise of any right, power or remedy accruing to any party under this Agreement shall impair any such right, power or remedy, nor shall it be construed as a waiver of any future exercise of any right, power or remedy. 17. Neither party shall assign this Agreement without the prior written consent of the other party, which consent, if given shall not relieve the party of making such assignment from full responsibility for the fulfillment of its obligations under this Agreement. Species selection - Red Maple use should be kept to a minimum. They amount to over 30% of the shade trees on this plan. Red Maple species should account for no more than 10% of the shade trees at this site. They are an extremely overplanted species and suffer many problems in this area. They should not be used along streets. Austrian Pine (and other two needle varieties) is not well suited for planting in this area due to soil types and insect and disease pressures. Please substitute a more appropriate evergreen species. Beside the Spruce species, Douglas Fir and other Fir species (i.e., Abies coneD/or) are better alternatives in Clay Township. 2. There are no planting notes (specifications) or planting details (graphic specifications) on the plans. These need to be included with landscape plans. 3. There no tree protection details on the plans. Details and placement of tree preservation features for existing single trees and woodlands need to be represented graphically on the plans. 4. Plans do not meet the perimeter buffering requirements found in "Appendix A" ofthe Carmel Clay Land Use Regulations. Perimeter buffering is required even where private lots border the parcel. 5. Any landscaping for the pool and amenity area needs to be included as a detail on the landscape plan. All Open Space areas shown on the plan need to fit definitions found in Chapter 7 of the Carmel Clay Land Use Regulations. 2. Open Space common areas must be protected by delineation and definition in the covenants and restrictions of the subdivjsion and on the primary plat. I respectfully request the plan commission to consider the impact the two proposed subdivisions will have on this estate property. tn an effort to protect property value as much as possible and to limit the expected trespassing from congested neighborhoods, I believe it would be appropriate to r~ire both subdivisions to provide for attractive fencing so as to demarcate the boundaries. Ideally the fencing should be coordinated between the two subdivisions so that the fencing will be uniform on both the eastern and western boundaries of the estate. Please feel free to copy and distribute this email or attach it to your meeting minutes. Hayden Run (Secondary Plat); Lakes at Hayden Run (Primary Plat); and The Ridge at Hayden Run (Primary Plat) Please have the developer or their representative contact the District to discuss these projects as we only seem to have plans for Section 1 on 23 acres. The District has not received the plats for the other named sections and it is unclear if Section 1 of Hayden Run is the same as any of the listed TAC agenda items. An offsite interceptor and lift station must be constructed by the District before any of this project will be able to receive sanitary sewer service, so the Developer should ensure that proper coordination with the District is achieved as soon as possible. The Hamptons (Primary Plat) The District has not received the plat for this development; please have the developer provide plans for the District to review. Service to this site is also dependent on the construction of the same offsite interceptor and lift station which must be constructed by the District near the Hayden Run developments. The Developer should ensure that proper coordination with the District is achieved as soon as possible. Shelbourne Park The District has not received the plat for this development; please have the developer provide plans for the District to review. Since the District has not received any plans or plats, service to this site may also dependent on the construction of the same offsite interceptor and lift station which must be constructed by the District near the Hayden Run and Hamptons developments. The Developer should ensure that proper coordination with the District is achieved as soon as possible. North Haven Replat While this project is technically in the service area of Carmel Utilities, the District has advised the petitioner's attorney of the location of the District's 16" force main in 96th Street. If this project has any impact on utilities in 96th Street, the District should be notified and Holey Moley should be contacted. Village of West Clay, Commercial/Apartment Building 3 The plans received by the District show the removal of a portion of existing 8" line and construction of a new section of 8" sewer and 6" lateral. Approval of the sewer plans by the District's engineering consultant will be required. Building permits should NOT be issued unless the District has issued its connection permit. 1 1- CMC & CH Land Properties 0;. U. To follow on our comments from the last two TAC meetings, the District has reviewed the plans and notes that the sewer connection is proposed through core drilling a manhole. District specifications need to be added to the plans and special permit conditions will apply for the core drill. The District still has not received any revised plans as yet. Building permits should NOT be issued unless the District has issued its connection permit. As a final general comment, the last few TAC meetings have included a number of projects where the District has not been provided any plans to review in advance.
