The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: Approval will result in the property being consistent with the area as similar variances have been approved for new homes built in the neighborhood. The original neighborhood had mostly 1,000 sq. ft. ranch style homes and has been going trough a transformation over the last several years. The older homes have been being replaced by bigger, more modern homes that cover a larger percentage of the lot. The larger home will provide occupants with more useable space than smaller home if meeting code ordinance and will not negatively impact surrounding area. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The use is staying the same as a single-family home is being replaced by a single-family home. The variance will permit a larger home be constructed on the property that will be consistent with the newer builds in the neighborhood. This home will be consistent with newer builds so will not negatively impact use and value of the area. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: The prior dwelling is demolished but the driveway and garage remain. With the existing driveway and garage the current 35% lot coverage restriction makes it difficult to build a new home on the lot that will result in a desirable home. Building pursuant to the code ordinance will result in home that is smaller and inconsistent with the newer builds in the neighborhood and will negatively impact the value of this lot as it will be inconsistent with the surrounding area The lot width is also smaller than required which adds a practical difficulty as the lot cannot accommodate a larger home if the lot size was larger. DECISION IT IS THEREFORE the d cision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. PZ_ 0i, -0000'1 V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
