The applicant seeks the following development standards variance approvals:
3. Docket No. PZ-2022-00249 V UDO Section 2.08 Max.35% lot cover allowed,46% requested.
4. Docket No. PZ-2022-00250 V UDO Section 5.02(C)(7) Pools&their decking must be located at least 3-ft
away from any easement and 10-ft away from property lines;2-ft encroachment into easement requested and
7'9"rear setback requested. The site is located at 799 Spruce Dr.(Smokey Knoll Subdivision Lot 152). The site is
zoned R1/Residence. Filed by Zachary Samson, owner.

Public Comments:
Margie Dash,809 Spruce Drive: I have concern about the stormwater drainage.It flows from Arrowwood downhill to
Spruce,across the backyards. There's a beehive drain in the rear yard,presented pictures of standing stormwater. I wish
there was a better way for the water to flow underground, instead of across the backyards.
Department Report: Angie Conn:
• The Cannel Engineering Department is comfortable with this variance request. We can have Engineer Dept.come
out to this area and inspect for any drainage and flooding problems. They do review the pool permit to make sure
the grading is done correctly.
• Staff recommends approval of both variance requests
Board Comments: Leo Dierckman:
• Is the pool already built?Zachary Samson: The Contractor did not file for the proper permitting;thus,I am
going through the permitting process now myself.
• Can you commit to any necessary improvements for the drainage?Zachary Samson:Yes. The goal is to have the
overall drainage improve with the addition of this pool.
Approved 1-0,condition upon the Petitioner will work with the Carmel Engineering Dept. to improve any drainage
and/or standing water problems.
