Following are CTRWD comments on e agenda items effecting our sanitary sewers or service
area for the February 19, 200 TAC meeting. Please feel free to copy and distribute this
email or attach it to your eeting minutes. We have also created a new page on our
website linked to the "C struction" page where we have posted all CTRWD TAC comments from
2001 and 2002 meetings eld to date. We will continue to add to this page every month so
please let everyone ow they can view our comments online now too.
Westwood Estates (Secondary Plat and Construction Plans)
The District has received the plans for this project. These plans have been reviewed and
forwarded to IDEM for permit approval.
The Anderson Corporation (Primary Plat)
The plans received by the District need to be revised to show labeled sewer profiles and
manhole, lateral and bedding details which are in accordance with District specifications.
The plans also need show the most recent version of the District specifications. Revised
plans need to be submitted. An IDEM permit will be required and the submittal packet
should be sent to the District for review. The District will then submit the project to
IDEM for permit approval. A preconstruction meeting will need to be held before the
construction of the proposed sanitary sewers. Building permits should NOT be issued
unless the District has issued connection permits.
The Ridge at Hayden Run, Sections One & Two (Secondary Plat and Construction Plans)
The plans received by the District have been reviewed and comments were sent to the
Project Engineer on February 10, 2003. Revised plans need to be submitted. An IDEM
permit will be required and the submittal packet should be sent to the District for
review. The District will then submit the project to IDEM for permit approval. A
preconstruct ion meeting will need to be held before the construction of the proposed
sanitary sewers. Building permits should NOT be issued unless the District has issued
connection permits.
Clarian Hospital North - (Rezone/Preliminary Development Plan and Final Development Plan
for Hospital site only)
The plans received by the District need to be revised to show the entire sanitary system
on the plan profile sheets as it is shown on the overall utility plan. Revised plans need
to be submitted. An IDEM permit will be required and the submittal packet should be sent
to the District for review. The District will then submit the project to IDEM for permit
approval. A preconstruct ion meeting will need to be held before the construction of the
proposed sanitary sewers. Building permits should NOT be issued unless the District has
issued connection permits.

The site is located on the south side of West 141 st Street approximately one half mile

The petition for the Primary Plat is on the December 18,2001, Plan Commission agenda
under Public Hearings. The public hearings for the Subdivision Waivers will be held on
January 15th.

need to be in our office by Friday, January 4th for mailing. Mr. Olmsted's office is aware
of the docket numbers and it is my understanding that they are sending notice for the

Project: Hayden Run Section 1
Item 3A- Show construction limits on the plan.
Item 4A- The following items are recommended to be added to your construction
sequence:
· The construction entrance and silt fence need to be installed first.
. At the start of constru.ction of pond #3. a temporary diversion swale will be
constructed to intercept the existing drainage way south of 10t#6 to the south end
of the project and discharge into pond #3. (show on plan view)
· Storm sewer inlets are to be protected immediately after installation.
Item 4B- See the IDNR Indiana Handbook for Development in Urban Areas. Each
practice has a monitoring and maintenance $chedme. I would prefer to see this
information with each practice detail.
Item 4C- If changes are made to the sequence this will satisfy my concerns.
Item 40- Inlet 115 needs protection. Please show a detail for end-sections and a detail for
rear yard drop iIiJets. A silt fence box or wire inlet protection is recommended for the
drop inlets.
Item 4K- The roadside ditch needs to be seeded.
Other Notes: The existing tile needs to be replaced though your property and discharged
into a pond or storin sewer.

Attached is a copy of the signed Traffic Impact Analysis Contract for the above mentioned projects

Attached is a signed copy of the Traffic Impact Analysis for the above mentioned projects. Centex has an
agreement with Trinity to represent them in the Primary Platting of The Lakes at Hayden Run and therefore
will execute this contract for that project as well as the others noted above. By execution of.this contract,
Centex is agreeing to the costs. distributed by project acreage as handwritten on page 1 of the contract.
Therefore, Centex agrees to the fee of $2,257.25 for Hayden Run, $3,646.46 for The Lakes at Hayden Run,
and $3,357.87 for The Ridge at Hayden Run for a total fee of$9,261.58. It is assumed that additional
services provided at the hourly schedule will be distributed by project acreage as well. It is our
understanding that the Traffic Impact Analysis will commence after the holidays to obtain accurate traffic
counts.

SCOPE OF WORK
The scope of work for this project is:
Existing Conditions
1.
Conduct peak hour turning movement traffic vofume counts at 'each of the
existing study intersections. These counts W.m be made between the hours of 6:00
AM to 9:00 AM and 3:00 PM LO 6:00 PM.

Determine the existing capacity level for each intersection based on the existing
geometric!; and existing traffic volumes.
Existing Conditions Plus Future Traffic Volumes
3. Estimate the number of trips that will be generated by the proposed developments.
4. Assign and distribute the generated trips from the proposed developments to the
, existing roadway sysrem and the futUre parkway system.
5. Summarize lhe generated trips from the proposed development and the existing
traffic volumes on th~ existing roadway system to determine the future total
traffic volumes.
6. Determine the capacity level for the study intersections with the added traffic
volumes from each of the proposed developments.
Report
7. Prepare a Traffic Impact Analysis Report documenting aU data., analyse.I;,
conclusions and recommendations to provide for the safe and efficient movement
of traffic through and ar.ound this proposed site.
Meetings
8. Attend meetings to submit, review andex.plain the findings of the report including
-attendance at any zoning related meetin-gs.
D. FEES.
1. The lump sum fee to provide the services outlined in the Scope of Work items 1
through 7 is $28,800.00.
2. Meetings . All meeting times will be billed based on the hourly rate schedule.

SECTION I. EQUIPMENT AND INSTALLATION
1.1 In accordance with conditions set forth herein, Company agrees to install for Customer all necessary equipment to provide, operate
and maintain an outdoor lighting system. The cost of any additional electrical facilities required to provide energy to the System wjll not
be Included in the monthly terms of this Agreement.
1.2 The "Schedule of Rates, Classifications, Rules and Regulations for Electric Service" or General Terms and Conditions of Company
filed with and approved by the appropriate state regulatory entity, hereafter, "Commission" and all amendments thereto, shall be
deemed a part of this Agreement as if fully set forth herein.
1.3 A detail of the locations of the equipment constituting said outdoor lighting system, (hereinafter "Systemj is set forth in a drawing or
print marked EXHIBIT 'A', which is attached, and made a part hereof as if incorporated herein.

SECTION 111- SYSTEM MAINTENANCE PERFbRMED BY COMPANY
3.1 Normal maintenance includes the replacement or repair of any item included in the System. Maintenance is performed after
notification from the Customer that a problem exists and/or on a Company scheduled maintenance cycle. Company will stock only ,
the most common equipment and parts.
3.2 Normal maintenance covers ordinary wear and tear with proper use of the System. Repairs or replacements requested as a result of
Gustomer action will be performed on a time and material basis cost to the Customer where an estimate of costs will be provided to
the Customer before the work begins. Company reserves the right to charge Customer for repair costs incurred due to vandalism.
3.3 Maintenance does not include partial or full System replacement or major repairs due to System age. While many Systems last 15 to
25 years, different types of lighting equipment have different life spans. Lighting equipment manufacturers also discontinue equipment
from time to time. End of life for a System will be determined by the Company and discussed with Customer.
3.4 This item (3.4) is applicable to this Agreement. YES (Yes or No). When applicable, Company reserves the right to update or
modify the monthly maintenance charges to reflect changes in Company costs for materials and labor no more often than every
three years. In these unique Systems the monthly maintenance charges may be based on location, lamp source and wattage,
luminalre and pole styles that are uncommon to Company known standards.
SECTI T
4.1 Customer hereby agrees to pay Company the monthly costs set forth In accordance with the applicable tariff rate for the term of the
, Agreement. The' estimated monthly amounts due are summarized on Page 1 of this agreement and are current 'at the time the " '
Agreement was initiated. A monthly bill will be rendered and due each month In accordance with the applicable tariff rates and rules.
4.2 Should any change in the monthly costs be ordered by the local Commission, payments by Customer to Company for service shall
thereafter be made upon the basis of such new rates as changed and approved by the Commission
4.3 In addition, Customer shall reimburse Company any applicable third party pole contact fees, as specified in EXHIBIT B, Item 10,
Page 4. The poles to which this applies will be identified on EXHIBIT 'A' or on a drawing showing the pole locations.
SECTION V. - TERM OF AGREEMENT
5.1 Service under this Agreement shall commence as soon as practicable, and Company shall notify Customer in writing as to the date on
which service hereunder will commence.
5.2 The initial term of this Agreement during which Customer shall take and Company shall render service hereunder shall be TEN (10 )
years from the date when service commences hereunder ("Initial Term"), and after the Initial Term this Agreement shall continue in
force and effect for successive terms of ONE (1) year(s), unless terminated by either party ("Extension Period"). Either of the
parties upon at least SIXTY (60) days' prior written notice to the other may terminate this Agreement at the expiration
of the InitialTerm or at the expiration of any successive ONE (1) year(s), term, unless either party is in default or breach of this
Agreement. ' ,
SECTION VI. . OTHER TERMS AND CONDITIONS
6.1 The Other Terms and Conditions set out on EXHIBIT 'B', page 4, hereto are incorporated by this reference and made a part of this
Agreement as If stated fully herein.
6.2 This Agreement constitutes the final written expression of the terms and conditions of the Agreement between the parties. It is a
complete and exclusive statement of those terms and conditions, and this Agreement supersedes all prior negotiations,
representations, or agreements, either written or oral, with respect to the System provided by this Agreement. However, nothing
herein shall preClude the right of either party to commence an action for any unpaid bills, other damages, or any breach of such prior
agreements during the time the same were in effect.
6.3 'This Agreement, the construction of this Agreement, all rights and obligations between the parties to this Agreement, and any and all

greemen or any 'reason whatsoever shall not in any way affect
such oWnership by Company, nor deprive Company of the right
either to remove any or all property comprising the System or any
part thereof or to use the same in or in connection with the
rendering of other service by Company.
2. If Customer requests part or all of the System's removal before
the end of the System's useful life, including by reason of
termination of this Agreement, Customer must pay Company's
unrecovered costs of the System minus any salvage value, to be
determined at the sole discretion of Company, plus System
removal costs.
3. The obligations of Customer to pay the monthly invoice and any:
'applicable late fees or any.amount due and owing to Company as
a result of this Agreement or in connection with the rights and
privileges granted hereby, are Independent of the liabilities or
obligations of Company hereunder. Customer shall make all such
payments due to Company without any deductions, setoffs or
counterclaims against such payments on account of any breach or
default by or claims against the Company pursuant to this
Agreement or otherwise or on account of any claims against or
default by any third party.
4. Company's installation of the System is contingent upon obtaining
adequate written easements if necessary, and Customer agrees to
assist the Company when necessary In obtaining adequate written
easement Covering permission to install and maintain service lines
and facilities required for serving and providing the System.
5. Company is an Independent contractqr and not an agent or
employee of Customer and nothing contained in this Agreement
shall be so construed as to justify a finding of the existence of any
rela,tionship between Company and Customer inconsistent with
that status. Company shall have exclusive control of and
responsibility for its labor relations. .
6. Company does not warrant nor guarantee the safety of Customer
or any third party, nor does it warrant or guarantee the security of
Customer's property or any third party property, lighting levels, or
uniformity of lighting as a result of Customer's use of the System.
Company is not liable for any Injury to Customer, or any persons
or property arising out of the System use. THERE ARE NO
WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR ,USE, EITHER EXPRESSED OR IMPLIED,
PROVIDED BY COMPANY TO CUSTOMER.
7. If a breach or default occurs, the non-breaching party shall provide
the breaching party with a thirty (30) day written notice to cure
such default or breach, or if the defect cannot be cured within thirty
(30) days, the breaching party shall commence the cure of such
defect. If the breaching party fails to cure or to commence the
cure of the defect within the prescribed timeframe set forth herein,
the non-breaching party, at Its sole discretion, shall provide notice
to the breaching party of the immediate termination of this
Agreement. Events beyond Company's control, Including but not
limited to acts of nature, electricity outages, and inability to obtain
needed replacement parts, shall not constitute material breaches
of this Agreement.
8. The operation or maintenance of the System does not guarantee
security of Customer property or that of any third party or nature,
including attorney fees, against Customer caused in whole or in
part by Custome~s own negligence and/or its failure to comply
with the terms of this Agreement. It also does not guarantee that
initial lighting levels or lighting uniformity will be maintained.
9. Customer desiring a Company installed System on a public rlght-
of-way or on other property not under customer's jurisdiction must
provide the Company with written permission from the entity with
legal jurisdiction over that right-of-way or property, before
installation will begin. Customer must reimburse Company for any
easements to be obtained.
10. Company reserves the right to refuse to install Company
equipment on another's property, however, any Company
agreement to install System luminaires or other Company facilities
on poles or structures owned by a third entity is contingent upon
receiving written consent for such installation from that entity.
Customer will be required to reimburse the Company for monthly
fees charged for pole contacts for System attachments on poles
or structures not owned by the Company (i.e., owned by other
utilities or entities). This fee will be imposed only when the
System equipment is the only Company attachments on the pole.
Additionally, Customer will be responsible for the cost of upgrading
or mOdifying existing poles to allow for clearances required for the
System equipment. Company reserves the right not to install
Company equipment on any pole or structure other than one
, installed and owned by the Company.

11. Company shall not be liable for any claims, demands, cause of
action, liabilities, loss, damage or expense of whatever kind or
nature, including attomey fees, against Customer for actions
involving a structure not Company-owned on which the Company
has placed Company-owned equipment at Customer request.
Additionally, the Company will not be responsible for any repairs
needed by the structure that is not owned by Company. If the
structure becomes unsuitable, or unsafe to support Company-
. owned equipment the Company retains the right to remove the
equipment from the structure. If Company equipment is removed
under these conditions Customer will owe Company a prorated
amount for the removed equipment plus removal costs minus
salvage value.
12. When changes are requested by Customer at any time after the
System is installed and before the normal end of System life,
Company will evaluate and estimate the costs of the changes.
The changes will be made after the Customer pays the agreed
upon amount if any to make changes. Changes include such
Items as relocating poles, changing luminaire styles (post top,
rectangular cutoff, floodlight), their locations, wattage, and lamp
source (i.e., metal halide, high pressure sodium). Any such
agreed upon changes will be documented either on a new
Agreement or on an Amended Agreement. New equipment added
to the System will require a new Agreemer:1t.
13. If any part, term, or provision of this Agreement Is adjudged to be
contrary to the law governing this Agreement by a court of
competent jurisdiction, the validity of the remaining parts, terms,
and provisions shall not be affected thereby.
14. this Agreement, and all the terms and provisions hereof, shall be
binding upon and inure to the benefit of the parties hereto and their
respective heirs, executors, administrators, successors, personal
representatives, and/or permitted assigns.
15. Each party to this Agreement represents that it is sophisticated
and capable of understanding all of the terms of this Agreement,
that it has had an opportunity to review this Agreement with its
. counsel, and that it enters this Agreement with full knowledge of
the terms of the Agreement.
16. No delay of or omission in the exercise of any right, power or
remedy accruing to any party under this Agreement shall impair
any such right, power or remedy, nor shall it be construed as a
waiver of any future exercise of any right. power or remedy.
17. Neither party shall assign this Agreement without the prior written
consent of the other party, which consent, if given shall not relieve
the party of making such assignment from full responsibility for the
fulfillment of its obligations under this Agreement.

Dear Dennis:
My comments for the above referenced plans are as follows:
1. ''Natural Open Space" areas are those areas left in their 'natural' state (i.e.
woodlands). Those common areas that are graded, seeded, and otherwise landscaped
(including storm water management structures) are considered "Designed Open
Space," and should be shown as such. Several Designed Open Space areas on this
plan do not meet the definitions found in Chapter 7 of the Carmel/Clay Land Use
Regulations. All "Open Space" areas on the plan need to fit those definitions.
2. Open Space common areas must be protected by delineation and definition in the
covenants and restrictions of the subdivision and on the primary plat. They need to
be separated from drainage and utility easements graphically on the plat.
3. No landscape plans have been submitted for this subdivision.
4. Plans do not meet the perimeter buffering requirements found in "Appendix A" of
the Carmel Clay Land Use Regulations. Perimeter buffering is required even where
private lots border the parcel.

Hello everyone:
Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the November 21 TAC meeting. Please feel free to copy and distribute this email
or attach it to your meeting minutes.
Hayden Run (Secondary Plat); Lakes at Hayden Run (Primary Plat); and The Ridge at Hayden
Run (Primary Plat)
Please have the developer or their representative contact the District to discuss these
projects as we only seem to have plans for Section 1 on 23 acres. The District has not
received the plats for the other named sections and it is unclear if Section 1 of Hayden
Run is the same as any of the listed TAC agenda items. An offsite interceptor and lift
station must be constructed by the District before any of this project will be able to
receive sanitary sewer service, so the Developer should ensure that proper coordination
with the District is achieved as soon as possible.
The Hamptons (Primary Plat)
The District has not received the plat for this development; please have the developer
provide plans for the District to review. Service to this site is also dependent on the
construction of the same offsite interceptor and lift station which must be constructed by
the District near the Hayden Run developments. The Developer should ensure that proper
coordination with the District is achieved as soon as possible.
Shelbourne Park
The District has not received the plat for this development; please have the developer
provide plans for the District to review. Since the District has not received any plans or
plats, service to this site may also dependent on the construction of the same offsite
interceptor and lift station which must be constructed by the District near the Hayden Run
and Hamptons developments. The Developer should ensure that proper coordination with the
District is achieved as soon as possible.
North Haven Replat
While this project is technically in the service area of Carmel Utilities, the District
has advised the petitioner's attorney of the location of the District's 16" force main in
96th Street. If this project has any impact on utilities in 96th Street, the District
should be notified and Holey Moley should be contacted.
Village of West Clay, Commercial/Apartment Building 3
The plans received by the District show the removal of a portion of existing 8" line and
construction of a new section of 8" sewer and 6" lateral. Approval of the sewer plans by
the District's engineering consultant will be required. Building permits should NOT be
issued unless the District has issued its connection permit.

To follow on our comments from the last two TAC meetings, the District has reviewed the
plans and notes that the sewer connection is proposed through core drilling a manhole.
District specifications need to be added to the plans and special permit conditions will
apply for the core drill. The District still has not received any revised plans as yet.
Building permits should NOT be issued unless the District has issued its connection
permit.
As a final general comment, the last few TAC meetings have included a number of projects
where the District has not been provided any plans to review in advance. Please remind all
TAC applicants to provide plans directly to the District at our main office address at:
10701 N. College Avenue, Suite A, Indianapolis, IN 46280-1098.

Hello Gentleman....
I know this is no shock to either one of you but I will not be able to attend this months TAC meeting due to prior
commitment and responsibility to work the radio in Dispatch that day. We will be short on manpower that day due to
Vacations, I will have to cover the radio. But I do have a few things that I would like for either one of you to pass on for me
or even have your own input on these issues as you see fit....1 welcome any and all comments from you both to the
Petitioners of the projects:
HAYDEN RUN: Please make sure they recieved my address list for Section 1. I faxed it to Dennis Olmstead.
LAKES@ HAYDEN RUN & THE RIDGE@ HAYDEN RUN: Laurence..I'm going to leave this up to you to decide ref
whether or not we should let these names stand or noUts just like Haverstick...1 know thats what Centex will probably say.
Another alternative would be to name them Hayden Lakes & Hayden Ridge...! don't have a problem with these
names..it would be better for Plice and Fire to find it if it was named this way instead of the other. Let me know what they
say.
THE HAMPTONS: If the street layout stays the same, I will need approx. 13 street names submitted to me that they want
to use.
SHELBOURNE PARK: If layout stays the same throughout developmenLI will need at least 6 street names submitted to
me; also in Section 2 the street cut off will be Lot 37 and Lot 48(This is a circle street).
NORTH HAVEN: Myself and Gary Hoyt waiting to have a meeting with them to discuss street layout in order to get names
approved for addressing purposees.
VILLAGE OF WEST CLAY:COMMERCIALlAPARTMENT BUILDING#3: Address has been assigned to
building......12720 Meeting House Road. Please pass this on to Keith Lash.
No other comments on other projects at this time.

In reviewing the plans, I find that along 141 st Street you have the required
path. But I can not find that the paths are identified or the width (10' asphalt
width required) of the path.
Please provide an updated drawing showing the path, its width and material
of construction.

Upon review of the plans for The Ridge at Hayden Run, S-1 Primary Plat, these additional
requirements will need to be addressed:
Our office is requesting a set of plans showing fire hydrant locations for the entire development.
I am also sending a specification sheet for our longest piece of apparatus, of which I have a
concern with the turning radii. Could you please provide a statement that the design you are
submitting will allow for the turning of this truck in the cul-de-sacs depicted on the plans.
