1) While property is zoned S-1 Residential, current use is anything but residential. The only uses are
non conforming uses, and include:
i) Mineral extraction (aggregate mining)
ii) Asphalt plants
ni) Cement plants
iv) Pre cast 4:oncrete fabrication (septi4: tanks)
v) Truck maintenance and repair
vi) Truck hauling
vii) Recycling
2) Standard treatment for non-conforming uses is to allow them to continue, but not expanded or
modified.
Property is in transition:
· Property is zoned S-1 Residential, however Comprehensive Plan designates it as an "employment
area".
. Annexation of this property eliminates the state exemption for mining that has previously prevented
Carmel from regulating the mining activities on this property.
. Rezoning a portion of this property is a modification of its non-conforming use.
. Mining and non-mining related activities have become a nuisance for surrounding residential
development. By allowing the "I was here first" argument to go unchallenged, the perpetrator of the
nuisance (Martin Marietta) is appropriating the rights of residential property owners to the quiet
enjoyment of their property. Standards for coexistence need to be established.
In the past, conflicting state and City land use laws have prevented the City from regulating responsible
land use on this property. However, this conflict ended with Annexation, and now the City has the
ability to establish reasonable regulation. This request to rezone a portion of this property constitutes a
modification of the non-conforming use of this property, and now brings this property under Cannel's
jurisdiction.
Summary
Modifying existing non-conforming uses makes these uses subject to regulation. As long as the
status quo was maintained, regulation issues were moot. But the actions of annexation, rezoning, and
development are just the initial steps to changing the use and character of this property. Now is the time
to address how to bring this property within the Comprehensive Plan before adding yet one more
use to this property.

The Petitioner of this rezone request cannot resolve these issues. He is not the owner of the property
responsible for the non-conforming uses. Martin Marietta must address these underlying issues in order
for the Plan Commission to manage the development of this area.
Because of the lack of regulation by Carme~ our Homeowners Assoc. has a petition in Hamilton County
Superior Court asking the Court to define legal uses on this property. This litigation can be dismissed if
the Plan Commission addresses the issues outlined above. This is your jurisdiction, and we hope you do
so.

As you will recaU. I represent Kingswood Homeownen Association and in that capacity, I
am making the fonowing request.
Tbisletter is to provide public input to Docket No. 144-01Z, a Rezone Application for
Glendale Partners for certain property at the comer of Gray Road and 9~ Street, scheduled tor
public hearing on Deceumer 18, 2001. As you are a\Vare, this property is the subject oran action
pending in Superior Court relative to existing uses that we believe are not permitted in the S-l
Classification for this property. We wish to place before the Plan Commission the fonowing issues
to be addressed with respect to this application.
This property has not been subdivided, nor are we aware of any pending applications to do
so. Ifultimatelyapproved, this application will provide for dual zoning on a single parcel of property.
Since the application has been submitted by Glendale Partnen ~imder contract" with Martin
Marietta, but Martin Marietta is not a party to the AppJi~tion. the request for rezone is on
speculation. In this regard, the application is inCiOmplete and should be dismissed.
While the subject property is zoned 8-1 (residential), its current use includes commercial,
industrial and business uses not permitted in S..1 zoning. We believe that any action to rezone this
property should include a remedy for these non confonnmg uses.
If current uses on the section to be re;z:oned are to be transferred to the remaining property
not to be rezoned, we believe this requires disclosure. In paniClJlar, any uses to be transterred
should comply with the zoning oCthe property to which it is being tranSferred.

This letter serves to acknowledge receipt of a bansmittal containing the plans for the above-mentioned
project. After reviewing the plans the Highway Department (HCHD) has the following comments:
1. In accordance with the Hamilton County Thoroughfare Plan, additional right of way is required at the
Intersection of 96111 Street and Gray Road. On Gray Road, the right of way from the Intersection to a
point 500' to the north Is a 75 half. From that point to the northern property line the right of way Is 60'.
On 961h Street, the right of way from the Intersection to a point 500' to the east Is an 85 half. From that
point to the eastern property line the right of way is a 75' half. A 50' triangular cut is also needed at the
intersection of 9611I Street and Gray Road.
2. A non-access easement wUI need to be Included in the right of way dedication. The non-access
easement should be behind the right of way, and cover the entire parcel except for the location of the
entrances.
3. Gray Road Improvements will be needed as part of this project. Typical improvements include
widening roads to current County specifications, deep patching when necassary, wedging and
resurfacing the road, InslaDing three-foot stone shoulders or a median on Gray Road. After the HCHD
has had a chance to review the area, the developer will be notified of the necessary Improvements.
4. Because of the proposed enbance on 96th Street, the location of the enbance must be far enough east
to prevent any traffic from crossing in front of the raised median. The entrance will be a right In / right
out only. The entrance wUl need to include acceVdecellanes and tapers. The dimensions for the decal
lanes are 100' taper. 150'lane and 100' accel taper. All lanes must be 12'In width. As required of
other developments. a $10,000.00 contribution will be required for the median Installation on 961h
Street.
5. Any entrance on Gray Road wUI need to be located at the far north edge of the property, a minimum of
500' from the intersection. The entrance will need to include accelldecellanes and tapers. The
dimensions for the decellanes are 100' taper, 150' lane and 100' accel taper. All lanes must be 12' In
width.
