Davis Coots Coots Henke & Wheeler 255 East Cannel Drive Carmel, IN 46032-2689 Re: CMC Cannel Office Center - Docket No. 147-01 DP/ADLS Dear Mr. Coots: At the meeting held March 19, 2002, the Cannel/Clay Plan Commission took the following action regarding the Development Plan! Architectural Design, Lighting, Landscaping & Signage petition filed for property located at the northwest comer of U.S. 31 and Main Street (131'1 Street). APPROVED: Docket No. 147-01 DP/ADLS, a petition for Development Plan and Architectural Design, Lighting, Landscaping & Signage. The Plan voted fourteen (14) in favor, zero (0) opposed, thereby granting the petition subject to the following: 1. That the applicant draft the same language in submitted "Restrictive Use Covenant" into "Commitment Concerning the Use and Development of Real Estate" in a form found acceptable by the Commission Attorney and upon approval, record and supply copy of the recorded document to the Department of Community Services. 2. That the windows adjacent to the stairwells at either end of the building be tinted to extent necessary to prevent visibility of the stairwells from the exterior of the building at all times of day and night. In order to assist the Department's review, please attach a copy of this letter when maldng application for permits regarding the improvements contained within this approval.
