7. Docket No. 148-01 CA (Commitment Amendment) - Hazel Dell Corner
Petitioner seeks Commitment Amendment approval to revise the list of special uses
permitted on Lots 2, 3, and 4 within the Hazel Dell Comer Subdivision. The site is
located at the northwest comer of East 131 st Street and Hazel Dell Parkway. The site is
zoned B-3/Business.
Filed by Paul G. Reis of The Reis Law Firm for Plum Creek Partners, LLC.
The Public Hearing on this item was held on December 18th. There were no comments from the
public and the Commission sent the item to the Special Studies Committee without additional
comments. The Special Studies Committee forwarded the item back to the Full Plan
Commission with a favorable recommendation for hearing at the January 15 meeting date. The
following was discussed at the Special Studies meeting:
The following uses would be eliminated from the list of "Permitted Special Uses":
· Automobile Service Station (a redundancy, since this was already eliminated as a
Condition of the approval of Docket No. 80-00 PP)
· Car Wash
· Laundry/Dry Cleaning Plant
· Second Hand Store
The following use was amended as follows:
· Dry-Cleaning Establishment, Drop-off & Pick-up Only
The following use requires clarification by the petitioner:
· Show Room
The following use was added to Lot 4 only:
· Restaurant, 2500-4000 square feet, one only
Some of the changes made by the applicant (see attached) vary from that discussed at the Special
Studies Committee meeting on January 8th. Prior to the Plan Commission meeting the applicant
requested that the item be sent back to the Special Studies Committee for further discussion.
The Department recommends that the Special Studies Committee forward this item back to
the full Plan Commission with a favorable recommendation after review and approval of
all modifications.

Dear Members of Carmel/Clay Plan Commission:
Following our presentation and discussion at the Special Studies Corrunittee meeting held on
January 8, 2002, I have consulted with my client, Plum Creek Partners, LLC, concerning the
Amended Commitments and list of permitted Special Uses tentatively agreed to last evening. I am
enclosing with this letter a summary of the proposed Amended Commitments as well as a revised list
of permitted Special Uses for your review and consideration prior to the January 15, 2002 Plan
Commission Meeting. The proposed Amended Commitments and the revised list of permitted Special
Uses vary from the Corrunitments and list of permitted Special Uses which were reviewed and
discussed at the Committee meeting.

The Original Commitments for Hazel Dell Comer will be amended in part with P9~ct to
a portion of the Real Estate currently owned by Plum Creek Partners, LLC ("Plum
Creek") and designated as the Plum Creek Real Estate as follows:
Summary of Amended Commitments
For Hazel Dell Comer
(a) The permitted Special Uses to be permitted on the Plum
Creek Real Estate will be modified as shown on the attached
list.
(b) The gross square footage of any restaurant use on the Plum
Creek Real Estate shall be between 1,400 square feet and
4,000 square feet.
(c) Any restaurant use on the Plum Creek Real Estate shall not
include: a drive-thru window design feature that includes the
use of a reader/menu board(s) (whether freestanding or
attached to a building); any in-vehicle ordering system;
and/or a drive-up, pick-up window. A restaurant may include
a walk-up or carryout window.
(d) On the future Lot 4 of the approved Primary Plat of
Subdivision for Hazel Dell Comer, the total gross square
footage for restaurant use on the future Lot 4 shall not exceed
50% of the total gross square footage of all buildings located
on the future Lot 4.
