Deciduous trees will have a minimum 2" caliper (but will not exceed 4" caliper). Evergreens will be 6' to 8' high. The specific type of tree and location where planted will be approved by Mr. Scott Brewer, Carmel's Urban Forester. The trees will be planted prior to June 1,2003. Platinum Properties will also warranty these trees for a one year period from date of installation. The above commitment is contingent upon Platinum Properties receiving, prior to February 1,2003, written approval and authorization from the Lake Forest Home Owners Association to enter onto their property for the purpose of installing these trees plus any other associated work for the referenced project. We have now reviewed this primary plat and offer the following comments: 1. We have not received detailed construction plans for this project. Some of the comments made on this primary plat will apply when we do receive detailed plans. 2. The north and south entrances will require acceVdecellane construction. In addition, the northern entrance will require the construction of a left turn lane in the median of Hazel Dell Parkway to accommodate northbound left turns from Hazel Dell Parkway into the development. We will require detail including construction, landscaping, maintenance of traffic, etc. 3. As a reminder, we will not approve plans that include the verification requirement above the engineer's certification. 4. Sheets PI0l and PI02. Where is the outlet for the run of sanitary sewer parallel to Hazel Dell Parkway? We will not have any additional comments until detailed construction drawings are submitted for review. After almost 2 hours of discussion, including significant public, committee and staff input we were able to arrive at a plan that received a 4 to 1 positive vote. Voting in favor of a plan with the commitments described below and a reduction of density from 97 to 87 homes were Ron Houck, Norma Meighen, Dan Dutcher and Linda Flanders. Wayne Haney was opposed. Regarding our proposal, please consider that we have satisfied all Technical Advisory Committee (T AC) issues, including DPW and Fire Department, have a strong positive recommendation from staff and were previously given a 4-1 positive recommendation from the Subdivision Committee (March meeting), before the question of proper notice was raised at the March Plan Commission meeting. As requested, prior to the Subdivision Committee meeting on April 9, we re-confirmed that all public notices were given properly. This has been a long discussion, and for the sake of clarity, I have outlined the points that have been agreed to through this process and confirmed them with the Department of Community Development. LAND PLAN - revisions based on public and committee input: We have not connected our roadways to adjoining neighborhoods. Reduced density from the maximum allowable 104 homes to 87. Reduced the number of buildings from 20 to 16. Eliminated four buildings - all on the south end of the site. Have added over an acre of open park land to the south end of the site. Have added numerous "off-street" parking spaces to accommodate guests of residents. PRODUCT - expensive improvements to the architecture of the buildings Added significant brick to almost every building. Created offsets to emphasize individual home character of the buildings. Committed to abide by additional Staff architectural recommendations. Added shutters to the windows on the rear and side elevations of the homes. Committed to no floodlights on the homes. FINANCIAL CONCESSIONS to satisfy numerous requests of adjoining homeowners Added over 400' of 10' wood fencing to extend existing fence Agreed to clean up grade and seed common areas west and south (over 6 acres). SOUTH There are 27 homes that directly abut the 6 acre "north property" with their rear yards, decks, play areas, windows and porches directly exposed to the property in question. These residences have no existing buffer and would lose a significant number of trees to see this area developed. They obviously have been in favor of this plan. These residents live in both the Lake Forest and Brookfield neighborhoods. The residents to the south initially saw a plan that had 4 buildings in the southern 500' of the property. They were concerned, and continually expressed their concerns about the density and the view. After some discussions at their neighborhood meetings and at sub-committee we eliminated two buildings, added fencing and landscaping and increased the separation between the remaining buildings. Prior to and during the Subdivision committee it was obvious the people on the south still were not satisfied. As discussed above, after lengthy discussion Platinum Properties further agreed to eliminate 2 additional buildings. This now gives us a plan with a large (over I-acre) park on the southern portion of the site, enhanced with significant landscaping. In conclusion, we feel the process that has been created by the Plan Commission has worked. There has been lively debate and in the end a creative solution to a tricky site. As for the fulfillment of this plan, Platinum Properties, has been involved in the development of literally thousands of home sites in Carmel and Platinum Properties does what it says it will do. The builder of this community, Ryland Homes, also has an excellent reputation and has enhanced it with successful town home neighborhoods in City Center and Village of West Clay. We are requesting the installation of cul-de-sac's at all stubbed streets in the project to allow our apparatus to turn around without undo backing. 2. Our office is requesting a set of plans showing the water distribution showing fire hydrant locations for this project. 3. Please find enclosed, a sheet showing turning radii for our apparatus. Our concern is with the street widths at intersections being only twenty feet (20') our ladder will not be able to make the turn onto the frontage road. Using these figures, please document that we will have adequate turning radius to make turns in either direction of the frontage road. 4. The street in the project that runs north and stub's, is over the allowable length for a dead end street or cul-de-sac. 5. Are these structures to be bricked or siding used on the exterior of the buildings? 6. Are these structures to be multi-story structures? 7. Will these buildings have a fire sprinkler system installed? 8. Are the streets in this project to be private streets? The project site is located within current City of Cannel Corporate Limits. 2. Jurisdictions: . Street and Right of Way - City of Cannel. . Water, Sanitary Sewer, Storm Sewer - City of Carmel. 3. Board of Public Works and Safety Approval Requirements: . Water and Sanitary Sewer Availability. · Commercial Curb Cut. Please provide an exhibit that shows the location of the curb cut(s) and acelVdecellanes if applicable; appropriate dimensions including drive width, overall width at the street, acelVdecel dimensions, rndii, etc.; and location of existing opposing curb cuts, if applicable. The exhibit should be 8 Y2 x 11 or of a size that can be reduced to 8 Y2 x 11 such as 8 Y2 x 14 or 11 x 17. . Temporary Construction Entrnnce. Same requirements as for the Commercial Curb Cut. . Consent to Encroach Agreements for any permanent improvement to be installed within dedicated easements and/or dedicated right of way (including landscaping). If an irrigation system is planned for this project, additional Water and Sewer Availability approval will be required from the Board. I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines for your use. Please use the Engineering Department deadlines for submissions to the Board. Any submission to the Board requires prior final approval by the Cannel Clay Plan Commission and/or the Board of Zoning Appeals and completion of review by the Technical Advisory Committee. This project will require IDEM permits for water mains and for sanitary sewers. Availability (acreage) Fees are based upon total acreage (legal description) @ $1,010.00 per acre for water and $1,365.00 per acre for sanitary sewer. Connection Fees are based upon the average user factor tables from Section 9-35 (water) and 9- 200 (sanitary) of our Utility OrdinaI)ce. The Connection Fees are $1,310.00 per EDU for water and $795.00 per EDU for sanitary sewer. Please provide this office with a listing of the proposed buildings by building number and the number of one, two and three bedroom units in each building. Multiply the total number of one-bedroom units by 0.54; the number of two-bedroom units by 0.81; and the number of three-bedroom units by 1.00. The total of these multiplications is the total EDU's. To arrive at the total Connection Fees, multiply the total EDUs by the Connection Fee for water ($1,310.00IEDU) and sapitary sewer ($795.00IEDU). I am enclosing copies of our Average User Factors for Water and Sanitary Sewers and our current fee schedule. I have also highlighted the Average User Factors that apply to this development Note: Any devimion from the Connection Fee calculations listed in our Ordinance will require Carmel Utilities and Board of Public Works and Safety approvals. 6. T AC ReviewlDrawings submitted for approval: We request that all comments and comment letters generated by this office be answered in writing and be accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for construction until all issues have been resolved. All Cannel Utility issues must also re resolved. The design engineer must certify all drawings submitted for final approval. This office will require a minimum of five-sets of approved drawings after all issues have been resolved. The drawings will be stamped approved and signed by both the City Engineer and Director Cannel Utilities. The Developer/Owner will receive one-set which is to be maintained on the construction site at all times. Cannel Utilities will receive two-sets. Our Public Works Inspector will receive one-set and one-set will be maintained in the Department of Engineering. If more than five-sets are requested to be approved, the additional sets must be submitted with the miriimum requirement of five- sets. 7. Be advised that any installation of signs, walls, irrigation systems, etc. within dedicated right of way andlor dedicated easements will require a Consent to Encroach Agreement between the OwnerlDeveloper and the City of Cannel. This Agreement requires Board of Public Works and Safety approval. 8. Cannel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all water main and sanitary sewer main locations. 9. Cannel Utilities will provide a separate review of this project for water and sanitary sewer issues. 10. I am including copies of the following with this correspondence: . Street CutlRight of Way Permit and Bonding Requirements Any work in dedicated right of way not covered by a Performance Guarantee will require a Right of Way Permit and a License and Permit Bond. The bond amount will be determined by the number of instances of work in the right of way (curb cut, storm sewer work, etc.) @ $2,000.00 per instance. All open pavement cuts require Board of Public Works and Safety approval prior to start of construction. PROJECT COMMENTS 12. Provide drainage calculations supporting the use of the existing pond for detention purposes. We reserve the opportunity for further review and submission of comments regarding drainage upon receipt of such calculations. 13. Since the streets in this development are to be private, it is our assumption that the storm sewer system will be private. We will not accept the storm sewer system since most of the runs of pipe would be along narrow private streets and not within dedicated easements. 14. Although the streets are to be developed as private, at some point in the future the City may be requested to accept the streets as dedicated streets and right of way. This office would not be in favor of such a request, due to many concerns, such as: . It is our understanding that the street widths are to be 18-feet total. This office has received numerous complaints about (public) frontage roads in other, recently developed subdivision, which provided up to 20-feet from back of curb to back of curb. Even though the streets in this development are planned to be private, the City will be forced to address any complaints once the development is occupied. . The plan provides for very little extra public/guest parking. When this parking (and the extra two spaces behind the garage) is full, where will the overflow parking go? We would not want to encourage parking along the narrow streets or in areas of right-of way along Hazel Dell Parkway. . Snow plowing would be next to impossible. The streets and drives, although different materials, do not have any separation between them and plowing the streets would block the drives. The same goes for paving of any of these streets. . We do not accept inverted crown designs. Experience has shown that there are both safety and maintenance issues regarding this type of design. . Public Safety Concerns - Even if the streets are private, how will trucks (particularly fire vehicles) turn around in the northern and mid-section stub streets? 15. Provide a right of way pavement section for the portion of the curb cut(s) within the Hazel Dell Parkway right of way that meets our pavement requirements. We are including a pavement section from the Hazel Dell plans. 16. This office recommends that up to two curb cuts are justified for this development. One curb cut would be located and aligned with the existing median cut on Hazel Dell Parkway at the Brighton Woods Subdivision entrance which is located on the east side of Hazel Dell Parkway. The second curb cut, without a Hazel Dell Parkway median cut, would be further south on Hazel Dell Parkway. This office suggests the Developer work with our Parks Department in determining if any plans for the future Founders Park have been developed to a point to determine where the entrance may be. This would be the recommended location of the second curb cut. As proposed, the petitioner would have to provide adequate justification to this office and the Board of Public Works and Safety in order to warrant the three (3) curb cuts. Numerous curb cuts, while convenient for the development, are not conducive to maintaining the overall continuity of the parkway, it's multi-use path and the landscaping that was installed with the construction of Hazel Dell Parkway. . , " u u Mr. Keith Lash, PE January 15, 2002 Page 4 17. Construction activities in the right of way of Hazel Dell Parkway are a sensitive issue. The roadway and the multi-use paths are heavily utilized. Please be advised in advance, that the following conditions would apply to any construction activities on Hazel Dell Parkway: . The demolition of the existing multi-use path along Hazel Dell Parkway and the relocation/reinstallation of the path must be coordinated to minimize the period of time the path is not accessible to the public. It will be a requirement that each curb cut/asphalt path construction is completed and the path reopened within two-weeks, weather permitting. . Adequate signage will be required for path reconstruction activities, both north and south of the construction activity at the proper, safe crossing locations. . An approved traffic control plan will be required for the construction of the entrances and acellldecellanes on Hazel Dell Parkway. . The pavement of Hazel Dell Parkway must be protected during the construction of the entrances. . The contractor(s) is to be notified that parking will not be permitted in the travel lanes of Hazel Dell Parkway or in the dedicated right of way of Hazel Dell Parkway during construction activities. Motor vehicles and construction equipment are not to park or drive on the asphalt path at any time. . Pavement markings for road improvements will be required, including lane striping for the accelldecellanes and stop bars for the entrances. 18. You have indicated, on Sheets PI02 and P103, the existing Stub Street in the Lake Forest Subdivision (Lake Pointe Drive) tenninating in a cul-de-sac. This cul-de-sac does not exist. Does this project include plans to construct this cul-de-sac? 19. We reserve the right to provide additional comments when detailed construction plans have been provided. The above comments are based upon the Engineering Department's initial review. Please provide our office with a follow up letter and revised plans, indicating all revisions. A second review will focus only on revised items. It is critical that our office be made aware of all modifications made on the plans being re-submitted, particularly if any such changes are considered "new" or fall outside of our initial review. Written Testimony on behalf of the Lake Forest community is as follows: 1. Ground Water Level. Jones & Henry Engineers, Ltd. in an April 23, t 999 letter to Lake Forest, Subject: Lake Forest Development Lakes notes a general decline in groundwater levels in the vicinity of Lake Forest. The letter states that the City is concerned with the impact that lower groundwater levels have on their well n0.16. The letter suggests the potential of discharging portions of the storm water from Hazeldell Parkway and adjacent developments into the Martin Marietta Lake adjacent to the North Lake. This would have the benefit of recharging the ground water level in this area. The water level in City well no. t 6, the Lake Forest North Lake as well as the lake of the proposed development is direcdy related to the ground water elevation in this area. The only foreseeable resolution to this problem is to mise the ground wa.ter in this area. Should this development, or 311Y other, be approved, it would benefit the City, Lake Forest and the petitioner if the City Engineer would include the discharge of storm water from Haze1dell Parkway into the petitioner's lake. Petitioner has agreed to request this accommodation from the City Engineer. Dewatering necessary for development would further lower ground water levels in this area. Petitioner has agreed that any dewatering necessary during construction would direct the discharge into one of the lakes rather than into the storm sewer. 2. Landscape and Mound Maintenance Easement. There is a boundary fence atop a 6.5 ft. tall and 40 ft. wide earthen mound along the east property me of Lake Forest. The earthen mound includes a 20 ft. Landscape Greenbelt Buffer and Drainage Easement on the Lake Forest side and a 20 ft. Landscape and Mound Maintenance Easement on the petitioner's side. Petitioner has acknowledged the Landscape and Mound Maintenance Easement and agreed not to alter any portion of the earthen mound in any way that may disturb the stability of the boundary fence. This prohibition will also be included in the Tow:nhomes at HlU:el Dell Declaration of Covenants, Conditions, and Restrictions. -2- January 10, 2002 Petitioner has agreed to reserve an easement in the Townhomes at Hazel Dell Declaration of Covenants, Conditions, and Restrictions for Lake Forest to retain access to the Landscape . and Mound Maintenance Easement for upkeep and maintenance of the boundary fence. Petitioner has agreed to include in the Townhomes at Hazel Dell Declaration of Covenants, Conditions, and Restrictions a requirement to share equally with the Lake Forest Home Owners Association, any expense related to the upkeep and maintenance of the boundary fence. 3. Conservation Easement. The DNR Conservation Easement appears to appease those who opposed the plan proposed by the previous developer. The Lake Forest Homeowners Association Board of Directors has no objection to this notion. 4. Height of the Townhouses. Petitioner has agreed that the placement of outdoor lighting at the Townhomes of Hazel Dell will ensure that Lake Forest residents will not experience any glare from garage, security and/or any other lighting and that the height of the Townhouses will not obstruct reasonable vision, light or air. Petitioner has agreed to include in the Townhomes at Hazel Dell Declaration of Covenants, Conditions, and Restrictions a continuing restriction on the placement of lighting. 5. Easement. The Lake Forest Homeowners Association Declaration of Covenants, Conditions, and Restrictions require approval of two-thirds of the membeJ:Ship to transfer or dedicate Common Areas to a public utility for such purposes. Provided such easement is necessary, the Lake Forest Homeowners Association Board of DirectoJ:S will recommend and seek such approval no later than the annual meeting to be held on the third Thursday of March. Committee meeting tonight. I did meet with Keith Lash, Paul Rioux, and one other gentleman (can't remember his name) on Friday morning last week. I want to provide you with the following comments regarding that project. Also, in case it is still possible to require them to do so, I would like to put in my recommendation that this project go to TAC again, as I really feel both the layout/design and change of density/use have substantially changed since the previous project (Hazel Dell Pond) was reviewed. I am slightly concerned with the volume of traffic generated by 99 units (2-car garages each) onto private streets only 18 feet wide. This seems like a high generator onto Hazel Dell.. ..Anyway, my comments include: . Generally, drainage should not present a problem, as I believe both this and the previous project could illustrate adequate capacity in the existing pond, or with minimum modifications necessary. I would NOT want to see the storm sewers be the City's (within easements) since most of the runs of pipe would be along the narrow, private streets. . I don't think they have the utility connections worked out yet. They are not clear on where they can bring in sanitary, although they have about three different directions to go, there are easement deficiencies and/or pavement cuts that may be required. These really need to be clear before approval would be able to be given. . The private streets are problematic, in that although they are to be developed private, they may eventually be requested to be taken over by the City and I would NOT be in favor of that. This is due to many concerns: (1) Although the drawings show 20', I was told the widths of the streets were to be 18'; we have already had numerous complaints about the (public) frontage road in Plum Creek Farms, and I believe we were able to cause modification from the original proposed width to enlarge the widths to 20'. Even though they are private, we may get complaints. AND, we may be forced in the future to take them on as City streets. (2) The plan provides for very little extra public/guest parking. When this parking (and those extra 2 spaces behind the garage) is full, where will overflow parking go? I hate to think anyone would park along the road or in grassy areas along Hazel Dell. I believe more parking for guests should be provided. (3) Snow plowing would be next to impossible. The streets and drives, although different materials, do not have any separation between them and plowing the roads would block in the drives. The same goes for paving any of these streets. (4) Inverted crown - we do not accept the inverted crown designs. Experience has shown that there are both safety and maintenance issues regarding this type of design. I would not want to set any precedence by beginning to accepf this type of design. . Public safety of the private streets - Even if private, how will trucks turn around in the northern and mid-section stub streets? I do not have the exact widths and what the Carmel Fire Department can maneuver, but I would make sure the Fire Department has reviewed this layout/design for approval. . Multiple curb cuts onto Hazel Dell. I did discuss this with the developer and engineer. For the Hazel Dell Pond development, I believe only one curb cut was to be provided, at the location of the current median cut. I understand that at first, an additional three (3) cuts were proposed, which has been reduced to two (2). I think only ONE additional curb cut, without a median cut, would be justified. And this is only based upon the plan showing 75 units south ofthe median cut entrance. This means up to 150 vehicles at full capacity, not counting guests. As I am aware of the extreme sensitivity to additional curb cuts on Hazel Dell (and the obvious opposition to any new median cuts) I would like to discuss this with the Mayor and the other Board of Public Works members to verify their concurrence. Additionally, I would like them to work with the Parks Department in determining if any plans for the future Founders Park have been developed far enough to determine where the entrance may be. This would be where I would recommend that second curb cut be located across from. . Encroachments into the Hazel Dell RW - I am aware that there may be numerous requests to have additional amenities located within the existing RW of Hazel Dell. This may include landscaping, lighting, signs, paths/group sidewalks, irrigation system. All of these would have to be reviewed and included within a Consent to Encroach 1 '. - u u - agreement prepared by City Legal and signed by our Board of Public Works.
