My clients, Kite Development Company and Kosene & Kosene, own The Comer and The Centre shopping centers along Range Line Road, respectively, that will be affected by the proposed zoning ordinance amendment. My clients have two main concerns with the proposed ordinance: 1. The ordinance amendments relating to the "ADLS" requirements for the B-3/business district are unnecessary to regulate existing commercial buildings and shopping centers. The Comer and The Centre shopping centers are located in B-3/business zoning districts and additions over 10% of the existing structure subject the project to the review and approval of the Board of Zoning Appeals. The BZA considers twenty-five (25) different criteria when reviewing projects including building site coverage, lighting, landscaping and signage. Because of the extensive review criteria already contained in the current zoning ordinance, the current review and approval process through the BZA is adequate to address the zoning- related issues of a project. 2. If the zoning ordinance amendment was passed in its current version, it will not fairly or effectively regulate architectural design, lighting and landscaping. The ordinance proposal contains no definition of the term "ADLS," nor does it contain any filing requirements for the Plan Commission's review and approval. Also, the ordinance proposal contains no development standards for architectural design, lighting or landscaping. We ask that the Plan Commission exclude The Comer and The Centre shopping center properties from the zoning ordinance amendment.
