1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
Allowing more lot coverage is not injurious to the public as the project will still provide all
required storm detention so no additional impact will be realized off the property. In addition, the
layout provides a fire lane around the building to promote safe access by the fire department.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
Two adjacent properties along Old Meridian are zoned UC which allow 100% lot coverage and the
PUD across the street has close to 100% coverage already. Allowing this lot coverage would be
consistent in this area of town.
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the
use of the property because:
Due to the size and shape of the parcel and the necessary size of building to make a project viable
a reduction in building size is not possible. The other required elements contributing to the lot
coverage is the fire loop road which is not possible to remove due to fire safety requirements.
DECISION
ILLS THE FORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.
2-2O 3 -dOo V is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof. J

Petitioner: Cross Development
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
A roadway would be out of place and unexpected around two sides of a private property in an area
where this is not common. The installation would also be incompatible with the pedestrian walking
area introducing cars &traffic into a quiet back of house space and could cause a safety concern.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
No other sites have roads cutting through them and is not compatible with the context of the area.
Allowing further traffic into the property on a road would also negatively affect adjacent properties
more than the current proposal which keeps cars to the west half of the property.
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the
use of the property because:
Installing a road and right of way through the site would severely limit the use of the property by
the owner and would prevent the large pedestrian walking trail and amenity area current proposed

IT S THEREFORE thq decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.
FZ' 20Z3 -OOo 3 is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.
