The applicant seeks the following development standards variance approval: 5. Docket No. PZ-2023-00061 V UDO Section 2.04 – Maximum 18-ft accessory building height allowed; 25-ft requested (up to the roof peak). The 3.15-acre site is located at 10455 Laurel Ridge Ln. It is zoned S1/Residence (Laurel Ridge Subdivision Lots 9 &10). Filed by Adam Mears of Gradison Land Development, Inc. on behalf of Robert L Cook Living Trust. General Info: • The Petitioner proposes to build a tennis barn just north of the house and west of the tennis court. • Single family detached homes surround the subject site. • This 3.15-acre site is located in Laurel Ridge Subdivision. • The only variance requested and needed is for accessory building height. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Accessory Structure Height - • Building Height is measured from the ground, up to a point that is halfway up between the ridge and eaves. • A maximum 18-ft height is allowed for accessory structures, and 19 feet is requested. • This is a variance of 1 foot, or a 5.5% change. • When measured from the ground, up to the roof peak, the proposed tennis barn will be 25-ft tall. • Homeowners association approval has been granted. Remaining Review Comments: • Please provide the Publisher’s Affidavit from the newspaper. • Please provide the revised Architectural Elevations showing the proposed 25-ft height to the tallest roof peak. Final Comments: • The design and exterior materials and colors will complement the main house. • The Carmel Engineering Dept. has no concerns with the variance request. Also, the proposed 2nd driveway (and curb cut onto the street) is being done along a private street, and not a public street. • The Planning Dept. supports the variance request. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • After all comments have been addressed, the Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
