The applicant seeks the following development standards variance approval: 1. Docket No. PZ-2023-00022 V UDO Section 2.10 Minimum 35-ft front yard building setback allowed (50' platted setback exists),34'11" requested. 2. Docket No. PZ-2023-00028 V UDO Section 2.10 Maximum 35% lot coverage allowed,54% requested. The site is located at 912 Auman Dr. East(Auman's Addition, Lot 77). The site is zoned R2/Residence. Filed by Mariana Rojdev,owner. Petitioner: Marian Rojdev: • I don't have any additional information to provide to what has already been provided in my info packet. Public Comments: John Carter,918 Auman E. Dr.: Concerns about drainage. There's an issue with the drainage in the neighborhood. The setback is also a concern. It changes the character of the neighborhood. Is there any way to push back the building 12-ft.? Robert Yunker,924 Auman E. Dr.: We have suffered drainage problems due to the City moving the storm drainage sewers to the fronts of the homes, and now the water has to travel upward. Rebuttal to Public Comments: Marian Rojdev: • Reasons for setback, R2 zoning dictates the 35' front setback. 50' setback is for our Auman Drive neighborhood. There are many homes that are being pushed forwarded to R-2 front yard setback of 35'. • The front yard is not safe for my kids to play in the front yard, so we prefer to have more room for them to play in the back yard. Department Report: Angie Conn • Platted 50' setback is per the neighborhood. The Petitioner had the two options—50' or 35' front yard setback. If this variance is denied,they can do a replat and have their front yard setback at 35 ft. • The Engineering Dept. is supportive and has been working with the drainage. The Petitioner has contributed to the Stormwater Funds. Board Comments: Leo Dierckman • Can Staff elaborate on the drainage issues and how to address them?Angie Conn: The neighbors can report the drainage issues and those concerns would be recorded with the Engineering Department. • Any improvements to this property will help mitigate any drainage issues occurring on their property. • I will grant the 1-inch variance for the front yard setback instead of having the Petitioner go through the replating process.
