EXPLANATION
Pulte Homes was the contract purchaser of approximately seven (7) acres located just
north of 136lb Street, between Rohrer Road on the west and the Manon Trail and US 31 on the
east. The real estate is outlined on the aerial photograph included in this brochure.
By way of general background, Pulte Homes filed a Iequest to change the zoning of the
seven acres to permit sixty-six (66) three-stoIy, Georgian-style townhomes. This original
proposal was reviewed by the Plan Commi~sion during the public hearing which occurred on
February 21,2006, and was last reviewed by the Subdivision Committee on May 4,2006.
After the Subdivision Committee review of the original proposal on May 4, 2006. Pulte
Homes went back to the Mdrawing board" in an effort to address suggestions to reduce building
height and density. After much consideration, it was determined that it was not feasible for Pulte
Homes to reduce building height from three stories to two stories and, consequently, Pulte
Homes conferred with Will Wright and Steve Schu12 in an effort to redesign the product in the
land plan. As a result of those discussions, the land plan was revised to reduce density from
sixty-six (66) townhomes to thirty-eight (38) townhomes, and to also reduce the building height
of the townhomes from three stories to two stories. A conceptual drawing of the :revised land
pIan and the revised elevations are included in this brochure.
In an effort to obtain Subdivision Committee's input on the revised plans, Pulte Homes,
along with Steve Schutz. presented the revised plans on September S, 2006. At that time. it was
observed that the revised plans were different than the original plans and that, consequently, this
matter should be returned by the Subdivision Committee to the Plan Commi~on, so that the
Plan Commission could determine whether to permit the amendment of the plans and the
continuation of the Committee process. In this regard. the Subdivision Committee IIn$llntmously
recommended that the Plan Commission accept the revised plans as an amendment, and permit
this matter to Continue through the Committee process and return to the Plan Commission for its
recommendation to the Common Council.
Furtb.er to the Committee's nnAnimous favorable recommendation that the amendment be
accepted and that the revised plans not be treated as a ''new matter". the following are
noteworthy:
1. By the time most rezones proceed through the Plan Comm;!t.Clion and through the
Committee process. they are significantly cbanged and, consequently. the plans ultimately made
the subject of the Plan Commission's ultimate recomm~dation usually differ, in significant
respects. from the originally filed plans;
2. The revised plans for the Manon Trail. submitted to the Subdivision Committee
on September S. 2006, differ primarily because they incorporate two of the Subdivision's
Committee's suggestions; namely, a reduction in density and building height;
3. Whert\ as here, the Committee process has shaped the proposal and the revised
plans incorporate suggestions, it is respectfully submitted that the. Committee process is
effectively working and the revised plan should not be treated as a '-new matter," requiring re-
tiling and starting over again.
Forthese reasons, it is respectfully requested that, further to the Subdivison Committee's
UD8Jlimous favorable recommendation, the Plan. Commission accept the amendment established
by the revised plans, and pemrl.t this matter to continue and not be re-filed.
