3. The Proof of Notice will need to be received by this Department no later than noon, Friday,
August 18, 2006. Failure to submit Proof of Notice by this time will result in the tabling of the
petition.
4. The Filing Fee and Nine (9) Informational Packets must be delivered to BZA Secretary
Connie Tingley no later than NOON, Friday, August 18, 2006. Failure to submit Informational

agenda.
5. This Item will appear on the August 28, 2006 agenda of the Hearina Officer of the Board of
Zoning Appeals under Public Hearings.

1. The approyal ofthis yariance will not be injurious to the public health, safety, morals and general welfare ofthe
community because:
the sign will be fabricated by an experienced sign company and will be internally illuminated. The sign will be
installed by professionals using standard engineering practices.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
the surrounding areas of this site are similarly zoned and are developed with similar commercial development with
similar maior tenant signs.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
"dead space" figures into the sign area. thus reauiring a smaller sign size. possibly affecting the readability of the
sign from the roads. possibly causing a hardship to patrons/visitors to the site.

intensity of all site lighting, including:

1. Parking lot and service/storage area lighting;
2. Architectural display lighting;
3. Security lighting;
4. Lighting of pedestrian ways; and
5. Landscape lighting.
B. All site lighting shall be coordinated throughout the project and be of uniform
design, color and materials.
C. The height of light standards shall not exceed thirty (30) feet from the top of
the fIXture to the top of the pole base. The base of the pole shall not exceed
two (2) feet in height.
D. All exterior and street area lighting fIXtures shall be of the "shoebox" variety
which directs light downward. Any parking lot lighting or building lighting
illumination emanating from the Real Estate development shall not exceed
(i) 0.1 footcandle at the north right-of-way fine of East 96th Street and at the
eastern boundary of the Real Estate, and (ii) 0.3 foot candles at the western
boundary of the Real Estate.
Section 4.7 Sians. Signs for accessory uses, accessory retail, accessory service
commercial, and accessory supportive services shall be limited to lower level signs.
