FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because: based upon Petitioner's extensive experience in the management
and operation of full service hotels and conference centers, as proposed, 400 parking spaces will exceed
the cumulative needs of the hotel and conference center. The public health, safety, morals and general
welfare of the community will be enhanced by Petitioner's "right sized" parking design and the
elimination of excess, unused asphalt parking areas.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because: the size and design ofthe parking areas and the reduction in the
number of spaces will enhance the site and contribute to the overall development ofD.S. 31 corridor
without any adverse effect upon the adjacent properties.
3. The strict application ofthe terms ofthe Zoning Ordinance to the property will result in practical
difficulties in the use of the property because: if the Petitioner is required to meet the parking space
requirements under the Zoning Ordinance, the overall site design, landscaping and effective use of the
property as a full service hotel and conference center will be significantly negatively impacted and
thereby frustrate the successful operation of a full service hotel and conference center on the property.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes
of this Board, which are incorp rated herein by reference and made a part hereof.

FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because: this variance will allow for an additional ground sign that is critical
to provide safe and efficient access to the property as a destination full service hotel and conference
center from Pennsylvania Street.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because: the additional ground sign will provide the necessary
identification of the entrance to the property to promote safe and efficient access to the property from
Pennsylvania Street without any effect upon the use or value ofthe adjacent properties.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because: without the additional ground sign, the access to the
property is adversely affected which will have a significant, detrimental effect on the safe, efficient and
successful use and operation of the property as a destination full service hotel and conference center.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance

FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because: the increased size of the sign area for the wall signs and ground sign
is necessary to provide adequate recognition, identification and awareness of the property as a
destination full service hotel and conference center. This is essential in order to meet the needs of
public health, safety, morals and the general welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because: the proposed sign area for the wall signs and the ground sign is
consistent in character and architectural scale with the signage and development of the adjacent
properties, and as such, will have no effect on the use and value of those properties.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use ofthe property because: the permitted sign area will not allow Petitioner to
provide appropriate and effective signage that considers and allows for the number of letters in the
name, adequately addresses the need of the general public and the community to recognize the property
as a destination full service hotel and conference center and promotes customer awareness of the
property which is absolutely critical to the successful use and operation of the property as a full service
hotel and conference center.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes
of this Board, which are incorporated herein by reference and made a part hereof.

FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because: (a) it is essential that the general public recognize and the customers
and patrons of the hotel and conference center be aware of the location of the hotel and conference
center; and (b) the general public, as well as the customers and patrons will primarily access the
property from U.S. 31 and Pennsylvania Street. The two wall signs, (to be located on the north and
south facades), and one ground sign, (adjacent to Pennsylvania Street), will address these needs of the
general public and the customers and patrons for recognition and awareness ofthe property.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because: the purpose of the proposed signs and sign locations is to provide
customer awareness and public recognition ofthe property as a full service hotel and conference center,
without having any impact on the adjacent properties.

3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because: the general public and customers and patrons of the hotel
and conference center will primarily access the site from U.S. 31 and Pennsylvania Street, (roads
oriented north and south). Signage on the east and west facades, as required by the ordinance, would
severely and adversely effect the identification of and access to the property and the successful operation
of the property as a destination full service hotel and conference center.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes
of this Board, which are incorporated herein by reference and made a part hereof.
