DEPARTMENT REPORT
APRIL 9, 2002
1. Docket No. 127-01 Z; U.S. Highway 31 & 146th Street PUD (Rezone)
Petitioner seeks favorable recommendation of a rezone from the B-3 (Business) and R-l
(Residence) districts to a PUD/planned unit development district on 56.79 acres. The site
is located at the southwest comer of US Highway 31 and East 146th Street.

The applicant is proposing a retail and multi-restaurant development on the southwest comer of
146th Street and U.S. Highway 31. Please refer to the informational packet provided by the
applicant prior to this meeting for greater detail. In addition please see a revised copy of the
Ordinance enclosed with this transmittal. Several revisions have been made to accommodate this
new design. The Department has met with the applicant on several occasions to refine the design
and confirm that the Ordnance language as presented will yield the displayed building layout and
design.
Additional points to note:
1. The Department has engaged John Myers to review the Traffic Impact Analysis provided
by the Developer and assist in determining the appropriate level of improvements to
accommodate traffic today and to ensure that adequate areas are reserved for future use by
the State to provide for an interchange at the subject location. The Department will
require the following in order to support the PUD request:
a. The plan must illustrate that the right-of-way layout will accommodate reasonable
access onto and off of US Highway 31 for future construction of connections by
the State of Indiana. This area must be reserved exclusively for future right-of-
way. This shall be accomplished via a separate real estate commitment to be
prepared by the applicant and become effective upon adoption of the PUD
ordinance and approval of the first Preliminary Development Plan.
b. The plan must illustrate the construction improvements for Range Line Road
between US Highway 31 and 146th Street as well as improvements to intersections
and Range Line Road south of US Highway 31. The applicant shall commit to
constructing these improvements. This shall be accomplished via a separate real
estate commitment to be prepared by the applicant and become effective upon
adoption of the PUD ordinance and approval of the first Preliminary Development
Plan.
c. The applicant shall dedicate all necessary real estate within the bounds of the PUD
to provide for the construction of Range Line Road.
d. A separate exhibit shall be attached to the ordinance illustrating the areas to be
dedicated and reserved pursuant to the adoption of the ordinance.

2. The PUD requires future Preliminary Development Plan approval by the Commission.
The ordinance also requires future ADLS approval by the Commission. While the
language in the PUD ordinance provides each tenant a unique design and graphic image,
it also sets strict standards as to style and relationship that must be maintained between
the buildings. Please refer to the renderings provided by the applicant. It is the
expectation of the Department that the applicant will fully address this item at the
committee meeting.
4. The Department has requested a reforestation plan. The applicant is in the process of
producing said plan. It should be noted that the Department will not recommend that this
ordinance be forwarded to the City Council with a favorable recommendation without
this issue being resolved.
The Department is in favor of the proposed uses and design. The items mentioned above should
be resolved at the Plan Commission level prior to forwarding the proposed ordinance to the City
Council for consideration.
The Department recommends that the Special Studies Committee forward this item back to
the full Plan Commission with a favorable recommendation after all comments and
concerns have been addressed.
