A plan dated 5/2102 was received by the Highway Department on 5/16/02. The Highway Department agrees conceptually with the plan for planning and general zoning considerations, however there are several issues that needed further investigation before any final construction or platllng approvals are granted by the Hamilton County Highway Department. The Issues are listed below. 1. A Traffic Study to be performed by A&F Engineering for this area in needed. The Study will needs to show that a 2012 Level of Service "C" and a 2022 Level of Service "D" can be achieved from the ramps through the 1461h Street intersection. The traffIC volumes shall be estimated assuming the ramps are Installed. 2. Minimum Right of Way along 146th Street shall be granted in accordance with the Hamilton County Thoroughfare Plan. From the Intersection of Western Way and 1461h Street to point 500' to the east and 500' to the west, the right of way is an 85' half. From that point to the eastern and western property line, the right of way is a 75' half. 3. The right of way dimensions for the Interior street are representative only. The exact width for this right of way will be determined by the Highway Department after a more detailed plan for the site and roadway engineering is completed. This may lead to adjustments in the building locations after the final determinations for right of way are completed. In that letter, a statement is made in the second paragraph, "Lauth estimates the development of this project will require the removal of approximately 7,244 inches of trees on the site." That is an enormous miscalculation. The revised site plan states of the 63.51 acres of this site, 27.29 acres are being excepted from consideration for the reforestation plan. Of the remaining 36.22 acres, 3.3 acres were inventoried by Vine & Branch, Inc., and found to contain 585 trees and 244 shrubs totaling 4,540 inches of plant stem diameter to be preserved. Using those figures, the 36 plus acres would represent at least 5,850 trees and 2,440 shrubs totaling 45,400 inches of plant stem diameter. That equates to 18,160 two and one half inch diameter landscape trees. The 7,244 inches of plant stem diameter represents the reforestation mitigation amount proposed by Vine & Branch, Inc. They have based this amount on figures I have provided them from the minimum site restocking recommendations (200 inches diameter/acre) from the State of Maryland's Forest Conservation Manuel (1991). This minimal reforestation amount represents trees planted in a hospitable environment (and protected from development and construction damage) that will grow over fifteen to twenty years to replace the removed trees and their value in services being lost to the City of Carmel. Preservation of existing trees in a fifty foot buffer strip required by ordinance along the west and south perimeters has been allowed to count for 4540 inches (or 65%) of that ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571-2417 o u mitigation amount. All recommended preservation procedures must be followed to protect these trees. The plan commits that the remaining 2704 inches of plant stem diameter will be planted on the site as trees and shrubs required by the PUD Ordinance. It is essential that this plant material, especially the large growing shade trees, be planted in areas that allow enough soil volume to allow them to mature. In parking lots, surrounding buildings, and possibly in streetscape areas, this may require connected soil volumes (trenches, vaults, or constructed soil volumes) for root growth. These soil volumes should be based on engineered graphic standards, and can be addressed in the ADLS review. This mitigation plan is acceptable if the commitment to supply the soil volumes required for healthy growth of these trees is made. On page 1 of the Clay Terrace Tree Preservation and Reforestation plan provided by Vine and Branch, Inc., item C of the TREE AND SHRUB COUNT lists 150 trees and 1,100 shrubs required along Highway US 31 and 146th Street. According to requirements found in the PUD draft Section 7.3 (B), the approximately 3600 foot perimeter of those two roadways would require 180 shade trees, 108 ornamental trees, and 540 shrubs. Lauth Property Group ("Lauth") has previously submitted to you a revised site plan, Planned Unit Development Ordinance and Tree Preservation Planning report for Clay Terrace that indicate the areas of trees that will be preserved and areas of new plantings for trees and shrubs. I am enclosing with this correspondence a revised reforestation area map based upon the revised site plan. Based on those documents, Lauth estimates the development of the project will require the removal of approximately 7,244 inches of trees on the site. In response to your recommendation and request, Lauth will commit to the preservation of existing trees and shrubs and the planting of new trees and shrubs on the site in for a total of 7,244 inches of total plant material. There are two points of clarification that I would bring up: 1. Your statement in bold that says, "A commitment by the developer for Tree Preservation Planning of the inventoried trees 'would weight in as to the acceptance of the inventory figures" is somewhat unclear. My position is that if the mature trees in the required 50-foot buffer are to be preserved and counted as a "reforestation credit," then a tree preservation plan must be in place for those trees. This plan should include Best Management Practices for preserving matures trees during construction, and individual specifications for this site, to insure their protection from injury and decline. This is required for all tree preservation projects. This requirement does not necessarily guarantee acceptance of specific amounts of inventory credits. 2. In "Other comments," you have stated that I would prefer "Trees with a large growth potential in Islands - not parking lot areas. Ornamentals could be in the smaller planting areas in the parking areas." This may have been a mistake in your notes. Jon Dobosiewicz (DOCS Planner) and I have both asked for large maturing shade trees in parking lot islands. especiallv in the very large connected planting strips parallel (east-west) to the entry drives on the western side of the development. These very large planting strips within the parking areas have larger soil volumes that allow for increased root growth, and hence larger mature size for shade trees (vs. smaller ornamental varieties). The other parking lot islands should also be planted with shade trees. Shade trees are essential in proper parking lot design to help mitigate "urban heat island effects" by lowering temperatures, and by intercepting rainfall and mitigating increased stormwater flow from the addition of so much increased hard surface run-off. The following are responses to your comments: 1. Two 8 Y2" X 11" copies of the property exhibit are enclosed. 2. Two sets of sample photographs of the type of proposed buildings are enclosed. The PUD Ordinance has been revised to include additional architectural design requirements. 3. The proposed setbacks are identified in the PUD Ordinance. 4. The comments in Scott Brewer's letter dated November 6, 2001 concerning landscape areas and plantings have been addressed. a. Landscaped areas have been identified along 146th Street and Range Line Road. b. Landscaping has been provided along the perimeter of the parking areas. c. A landscape screen and fence has been provided along the western and southern boundaries of the property. d. We have added a 15% overall landscape requirement to the PUD Ordinance. 5. Parking Requirements: a. Parking setback requirements have been added to the PUD Ordinance. b. Loading requirements can be found in Section 10.2 of the PUD Ordinance. c. The parking requirements have revised to include additional parking ratios for the non-retail uses. The parking ratio for the retail uses is proposed to be 1 parking space for every 250 square feet of gross floor area. This ratio is an average of the ratios found in the Carmel/Clay Zoning Ordinance for various retail uses. The revision to the Ordinance and the letter from Hamilton County dated November 13,2001 address this issue. 9. Steve Fehribach is working with John Myers to address any issues with the Traffic Impact Analysis. This project will include the extension of Rangeline Road from U.S. 31 on the south to 146th Street on the north. This real estate is located within the tax incremental financing district specifically established to facilitate the construction of roadway improvements for the 146th Street and U.S. 31 area, including this proposed section of Rangeline Road. The 70 acre Site was investigated for 3 wetland criteria to determine if an area is classified as a wetland. All three criteria must be present for an area to be a regulated wetland under normal circumstances. These three 3 criteJ' I'lr~ as followed: 1. The area must have hydric soil. A hydric soil is defined as a soil that is saturated, flooded or ponded long enough during the growing season to develop anaerobic conditions in the near surface zone. 2. . The area must have a predominance of hydrophytic or wetland . vegetation (e.g., sedges, cattails, reed-canary grass, water tolerant trees and shrubs) or be capable of supporting this vegetation. 3. The area must have evidence of wetland hydrology. Wetland hydrology is defined as periodical inundation or saturation of soils to the surface at some time during the growing season. Provide property exhibit illustrating property included in rezone application. 2. Pictures/exhibits of the type of proposed buildings would be helpful. There should be an entire section of the ordinance devoted to architectural design. The ordinance should establish the theme of the development so that the Plan Commission has a basis on which to review future ADLS applications (building design, landscaping, signage, lighting, etc.). I can't say enough about this aspect. If you are not in a position to convey the commitments to quality this development will represent you are wasting your time. There are to many other critical and challenging issues. You want the Plan Commission on your side regarding aesthetics. 3. Identify proposed setbacks. A zero setback along Range Line will not be supported by the Department without the provision of more specific language as to building design, parking requirements, and landscaping. 4. Landscaping (address Scott Brewers letter dated November 6th) a. No greenbelts have been identified for 146th Street or Range Line (not acceptable) b. Landscaping should be provided along the perimeter of the parking areas. c. Provide a screen between this area and residential to south and west (similar to wall and landscaping used for Lowe's development). d. 5% interior not adequate, should be 1 O%of parking lot surface area at minimum. Looking for minimum islands of 400 s.f. (min 10' width) with three trees and 15 shrubs 5. Parking requirements: a. Identify parking setbacks, none have been identified. b. No loading requirements have been identified c. 1 space for 250 s.f. of gross floor area does not work for permitted uses such as multi- family, restaurants, nursing home, etc. Revise, be more use specific. Include garden center in calculation. Retail should be one space per 200 s.f. gross floor 6. Present a sign plan and include language in ordinance. 7. Revise ordinance language whereby the Plan Commission would be approving a preliminary DP with the rezone and a fmal DP would go to the Department for administrative review. Respond to formal comments made by John Myers upon completion of Traffic Impact Analysis. It is my understanding that the Traffic Impact Analysis is currently in "draft form". Please confirm. I am requesting that you Table this request for a minimum of one month. I do not feel that the proposed ordinance is currently prepared with the level of detail necessary for the Plan Commission to conduct any meaningful review of the proposed development.
