7. The Petitioner proposes to redevelop the subject property with a new McDonald's restaurant
featuring drive-through service with three (3) incidental drive-through signs, replacing an existing
McDonald's restaurant that currently features drive-through service with three (3) incidental drive-
through signs. The Petitioner proposes that three (3) signs be used as a part of the drive-through
operation: (1) a "preorder" board containing II square feet and a height of 5.3 feet; (2) A "menu"
board containing 44 squ~e feet and a height of 6.8 feet; and (3) A customer order display board
containing 4.6 square feet and a height of 4.5 feet, requiring a variance of Sec. 10-240 of the
Carmel/Clay Zoning Ordinance, which permits a menu sign with a maximum area of sixteen (16)
square feet and a maximum height of six (6) feet.

Petitioner, McDonald's Corppration, seeks a variance of Sec. 10-240 of the Carmel/Clay Zoning
Ordinance, which permits a menu sign containing a maximum of 16 square feet and 6 feet in height, in
order to permit three (3) signs incidental to a drive-through service for a fast food restaurant, featuring a
preorder board containing 11 square feet and a height of 5.3 feet, a menu board containing 44 square feet
and a height of 6.8 feet and a customer order display board containing 4.6 square feet and a height of 4.5
feet, all in conjunction with a. replacement of an existing McDonald's restaurant with a new McDonald's
restaurant.

FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The approval of this variance will not be injurious to the public health, safety, morals and general welfare
of the community because the proposed signs will improve efficiency of the drive through window (a
permitted use) and will improve traffic flow in and out of the community.
2. The use and value of the are~ adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:

substantially adverse manner because the use of the site is not changing and is a permitted use. This .site
will still be used as a McDonalci's store. The proposed signage will be better screened by the proposed
landscape plan. The variance ~ill allow a major upgrade of a "grandfathered"property in an overlay
district, which will allow for consistency in development along Highway 431, and will thus improve,
adjacent property values. '
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:

variance, which could result in an economically unviable operation of a permitted use.

Keystone Way. A new signage agreement is currently being negotiated with the owners of the
Wilson Office Plaza. No problems are anticipated and a copy of the signed agreement will be

The Everbrite LED Customer
Order Display helps ensure drive-
thru order accuracy, and
enhances speed of service by
displaying the menu items as
ordered. In addition, the unit is
an acoustically designed duplex
speaker post to optimize both
inbound and outbound sound
quality.
LED Display
. Unit is capable of displaying 9
lines of menu items with a 20
character descriptor. Orders
greater than 9 lines will
automatically scroll.
· Interface software
automatically updates 85% of
the menu items up to 20
characters maximum. Those not
updated can be manually revised
by the store.
· Unit displays price, tax and
total.
· Last item ordered briefly blinks
to draw customer's attention.
· Display utilizes high quality
Hewlett-Packard super bright red
LED's. Average life expectancy is
11 years with an operating range
of _350 to 1500 F.
· Unit offers optimal visibility
even in direct sunlight.
· Unit continuously monitors
ambient light and adjusts display
brightness.
Protective Features
· Units are designed for outdoor
weather conditions.
· Thermostatically controlled
"silent" fans (2) are utilized to
cool the unit's electronics. In
addition, the unit automatically
shuts down if the internal
temperature raises too high,
(> 1500 F) so as to protect the
display, and re-starts when
lowered (<1300 F).
· A thermostatically controlled
heater is installed for the power
supply in the event the ambient
temperature is lower than 300 F.
Operational

including an inner
polycarbonate/aluminum front .
face and is fully enclosed in a
metal housing within the ABS
plastic shell.
· The greeting message is
designed to turn off after 30
minutes without taking orders so
as to minimize the visibility of
the display, especially at night.
The unit is reactivated with the
first keystroke.
Installation
· Unit height can be field
adjusted.
. Retrofittable to existing speaker
post foundation/anchor bolt
patterns.
· Unit is modular in design so
that the LED display and housing
could be moved from speaker
post to a menu board or a m
location in the future.
Troubleshooting
· A quick check of the display
functionality can be made by
triggering an on/off switch on
the back of the unit and
observing a random program
run through its countdown
sequence.
. The cable, connections,
software and display can also be
evaluated by use of software
programs developed by the
LED display and P-O-S vendors.
