STATEMENT OF VARIANCE
Panattoni Development Company is requesting a development standards
variance from SI4.04.01 of the Carmel Zoning Ordinance in order to increase the
maximum allowable height of the buildings on the parcel from 35 feet to 50 feet in
the B-3 business zoning classification. A petition to rezone the parcel from R-l/M-
3 to B-3 has been recommended by the Carmel Plan Commission and is currently
pending before the Carmel Common Council.

OVERVIEW OF DEVELOPMENT AND
STATEMENT OF SUPPORT
Panattoni Development Company develops, leases and manages industrial,
office and retail projects in more than 85 cities throughout the United States.
Panattoni is proposing to develop the approximately 27 acres of undeveloped land
at the Northeast Comer of Pennsylvania and 122nd Streets in Carmel. (Please see
aerial photo under TAB 5.)
Adiacent Development
The site is adjacent to three distinct zoning districts. To the east the land is
zoned M-3 (Manufacturing Park District). Development in this area within the
Carmel Science and Technology Park includes industrial uses, warehousing and
distribution together with a health fitness facility and assorted office uses. To the
north is located the Kirk Furniture Showroom and Kirk Boat Sales and the Old
Meridian District. The U.S. 31 Overlay Zone is directly west of the site and across
Pennsylvania Street. General and medical office uses have been developed and are
planned as well as a potential hotel development. To the south across 122nd Street,
a helipad is located on the southeast comer of the intersection of 122nd Street and
Pennsylvania Street. The former Conseco Headquarters building and Conseco
corporate campus have been developed to the south and east of the site.
Variance Petition
Consistent with the Comprehensive Plan, Panattoni has filed a petition to
rezone the three parcels from M-3 and R-l to the B-3 Business District. The

purpose of the B-3 District is to provide a wide variety of commercial and office
uses. The B-3 District and the proposed development are consistent with and
compliment the existing zoning and development adjacent to the site. Panattoni
Development is proposing a commercial development consistent with the B-3
District composed of three office buildings, three floors in height, with up to
227,850 square feet of gross floor area. The development standard for the height of
buildings within the B-3 district is a maximum of 35 feet. In order to develop the
parcel with buildings that are consistent with and complimentary to the adjacent
u.s. 31 Overlay Zone and the "Conseco Campus" office development to the south,
Petitioner is requesting a variance to increase the maximum height of the buildings
to 50 feet. The variance is necessary for the development of the parcel to promote
and continue the development standards for the area and to fulfill the architectural
design approved by the Plan Commission. (Please see the building elevations and
renderings under TAB 6.)
