LEGAL NOTICE shall be published in the Noblesville Dailv Ledoer a MANDATORY twenty-five (25) days prior to
the public hearing date,:. The certified "Proof of Publication" affidavit for the newspaper must be available for inspection the
night of the hearing.
LEGAL NOTICE to all adjoining and abutting property owners is also MANDATORY, two methods of notice are
recommended:
1) CERTIFIED MAIL - RETURN RECEIPT REQUESTED sent to adjoining propE!rty owners. (The white receipt
should be stamped by the Post Office at least twenty-five (25) days prior to the public hearing date.)
2) HAND DELIVERED to adjoining and abutting property owners (A receipt signed by the adjoining and abutting
property owner acknowledging the twenty-five (25) day notice should be kept for verification that the notice was
completed)
REALIZE THE BURDEN OF PROOF FOR ALL NOTICES IS THE RESPONSIBILITY OF THE APPLICANT. AGAIN, THIS

Petition for Special Use Approval
Before the Carmel/Clay Board of Zoning Appeals
Petition SUA- -01
Explanation of Requested Special Use Approval:
Petitioner, Carmel United Methodist Church, requests Special Use Approval to permit the remodeling of
and an addition to the Carmel United Methodist Church. The real estate is zoned to the R-2/Residence District
and the B-3/Business District.
Special Use Approval is required by the following Sections of the Zoning Ordinance for Carmel and Clay
Township (the "Ordinance"):
I. Section 8.2 (Churches permitted by Special Use in the R-2/Residence District); and,
2. Section 14.2 (Churches permitted by Special Use in the B-3/Business District)
Further, Special Use Approval is required for any approved Special Use which proposes an expansion of greater
than ten (10) percent of the gross floor area (Section 21.5 of the Ordinance). The proposed 19,617 square foot
addition to the existing 53,673 square foot facility represents a 26 percent expansion.
A Petition requesting a Variance of Developmental Standards for maximum building height and for a portion of a
temporary paved parking area to be installed without curbing has been filed concurrently with this request.
Reasons Supporting the Special Use:
The addition to the Carmel United Methodist Church is proposed to provide the growing congregation and
Carmel community with additional classroom and community meeting space for this community focal point and
anchor. In addition, the proposal includes expanded off-street parking to ensure that the parking needs of the
existing church and its expansion are met in a design that maintains the character and integrity of the surrounding
area.
The addition is designed in an architectural style and ofa quality which complements the architecture of the
existing church and is compatible with the surrounding uses in the area.
I. The Special Use in Flood Plain District, Ordinance Z-160, Section 21.6 as amended does not apply and
all prerequisites have been met by Petitioner as verified by: a review of the applicable FEMA Flood
Insurance Rate Maps.
2. The Special Use will be consistent with the Character and Permitted Land Use of the zoning district and
CarmeVClay Comprehensive Plan because: the site design; architectural designs and details; and scale of
the addition have been developed in order to complement the existing facility and character of the
surrounding area.

the building addition and required additional off-street parking while maintaining open space and
landscaped areas. The scale and architecture complements both the existing facility and is of a style and

adequate off-street parking and landscaping are provided. The site design and architecture employed in
the addition maintain and enhance the character of the long-time religious use and provide a stable

Commercial uses planned and zoned along Range Line Road, and residential planned and zoned to the
east of the facility.

Release (CDR), you may pr.oceed to the Carmel/Clay Permit Services office
(571-2444) where you will apply for the local Improvement Location Permit
(ILP). IMPORTANT NOTE: Our office requires three sets of plans, stamped
"Received" by the State to accompany. your application. This also applies to
partial releases. If you have applied for and received a Foundation release,
however, the State does not return plans on those, so the requirement is .
waived at that stage.

Dear Mr. Hill:
In response to your initial review of the development plans for Carmel United Methodist Church we
are forwarding the following revised plans and comments for your review and approval. The
following are our responses to your comments dated February 5. 2001.
1. No response required.
2. Per phone conversation with you on February 23, 2001, you indicated that John Duffy
responded that no additional fees would be required from the Church.
3. The City of Carmel did make improvements to 126th Street; these have been added to our
development plans. The survey, however, which was included in the original TAC submittal,
was performed prior to the completion of the improvements. Therefore, it does not show the
now-completed street improvements.
4. We have revised the plans to show the current right-of-way of Rangeline Road and 126th
Street.
5. The existing right-of-way encroachment at the northeast corner of the existing parking lot has
been referred to the owner for their action.
6. Per the surveyor, they have found no evidence that this 6th Street right-of-way parcel has
been officially vacated.
7. This island is only striped. The GD1.0 plan has been revised to show a different shading
pattern for paving being removed.

As shown on the accompanying plan G1.1, the asphalt area at the northeast corner near the
house has been changed to show curbing. At the south side of the property, however, the
Owner has requested additional, temporary, paved parking be constructed to handle their
parking needs during the construction process. This has not been shown to be curbed.
Laurence Lillig and Terry Jones, with the City of Carmel, indicated this is a valid request that
the Church may make to the Board of Zoning Appeals. The Church, however, will need to
give a reasonable time limit that this would be used for temporary parking. If they decide to
make it permanent parking, they would need to add curbs and landscaping per code.

The right-of-way lines have been clarified on the Drawings.
The arrow on the Drawing was pointing to a stop sign that was not shown. This has been
corrected. The dashed lines represented an old curb cut that was removed in the
reconstruction of the 126th Street frontage. This has been removed from our drawings.

11. On sheet SU1.1, the existing structures have been denoted and a schedule for the new
structures added.
12. The pipe inverts and materials have been added to sheet SU 1.1.
13. Fanning/Howey Associates, Inc. representatives have physically walked this north property
line and have found that the Church has kept their side of the property line cleaned out and
free draining. The only thing that was evident that the Church may need to do is remove a
small piece of concrete at the end of the existing culvert on their property. Other than this
correction, the Church has not restricted drainage flow. The corner of the property to the
north actually sits lower than the Church property and receives surface water from the
surrounding neighborhood. There also appears to be an existing drywell or other drainage
structure on this property, which has been filled with gravel and topped with an iron grate.
We feel that since this structure and the wet area actually falls on the neighbor's property,
they need to be involved in its correction.
We also have 'also included in these revised plans a copy of the erosion control plan that was
requested by Mr. John South at the Technical Advisory Meeting.

Carmel, Indiana; the Board of Trustees of the Carmel United Methodist Church; and the Carmel
United Methodist Church), as Trustees and not as individuals, whose address for tax purposes
is 621 South Rangeline Road, Carmel, Indiana 46032 ("Grantee"), for the sum of One Dollar
($1.00) and other valuable consideration, the receipt and sufficiency of which are hereby
acknowledged, certain real estate and any improvements located thereon in Hamilton County,
Indiana, as more particularly described in Exhibit A attached hereto and made a part hereof (the
"Real Estate").
The Real Estate is to be held by Grantee, in trust, that such Real Estate shall be kept,
maintained and disposed of for the benefit of the United Methodist Church and subject to The
Discipline of the United Methodist Church. This provision is solely for the benefit of the Grantee,
and the Grantor reserves no right or interest in said Real Estate. This conveyance has been
consented by the pastor of the Carmel United Methodist Church, Inc. and the Indianapolis East
District of the South Indiana Conference United Methodist Church, pursuant to the Consent
attached hereto.
The Consent of the District Superintendent of the Indianapolis East District of the South
Indiana Conference of the United Methodist Church in which district the Real Estate is located
and by the Pastor of said Grantee Church, all in conformity with the requirements of The Book
of Discipline of the United Methodist Church is attached hereto and incorporated by reference
herein as Exhibit B.
This Quitclaim Deed is being entered into to clarify and confirm that title to the Real
Estate shall be held in the name of Grantee hereunder.
